TITLE :
AN ORDINANCE AMENDING SECTION 2-53(d) OF THE WHEAT
RIDGE CODE OF LAWS. CONCERNING VOTING RULES FOR THE
BOARD OF ADJUSTMENT

COLORADO. AS FOLLOWS:
Section 1. Section 2-53(d) of the Wheat Ridge Code of Laws is
amended to read:
(d) Notwithstanding any other provision
in this section, the following voting rules
shall be in effect for all matters requiring
decision by the board of adjustment TO GRANT
ANY VARIANCE. WAIVER OR TEMPORARY BUILDING OR
USE PERMIT UNDER SECTION 2~61 (a) OR (b) (or
for any matter requiring decision by the
planning commission or the city council under
Section 26-6(D) of the Zoning Ordinance of the
city) :

ALL OTHER ACTIONS SHALL BE TAKEN BY MAJORITY
VOTE OF THE MEMBERS PRESENT.
Section 2. Safety Clause. The City Council hereby finds,
determines, and declares that this Ordinance is promulgated under
the general police power of the City of Wheat Ridge, that it is
promulgated for the health, safety, and welfare of the public and
that this Ordinance is necessary for the preservation of health and
safety and for the protection of public convenience and welfare.
The City Council further determines that the Ordinance bears a
rational relation to the proper legislative object sought to be
attained.

Section 3. Severabilitv. If any clause, sentence, paragraph,
or part of this Ordinance or Application thereof to any person or
circumstances shall for any reason be judged by a court of
competent jurisdiction invalid, such judgment shall not affect,
impair or invalidate the remainder of this Ordinance or its
application to other persons or circumstances.
Section 4. Effective Date. This Ordinance shall take effect
fifteen days after final publication.
