HomeMy WebLinkAboutOrdinance-1997-1104 CITY OF WHEAT RIDGE, COLORADO INTRODUCED BY COUNCIL MEMBER DiTullio Council Bill No 51 Ordinance No. 1104 Series of 1997 TITLE AN ORDINANCE AMENDING CHAPTER 22 OF THE WHEAT RIDGE CODE OF LAWS, CONCERNING SALES AND USE TAXES WHEREAS, the votes of the City have approved an Increase of one-half (1/2) percent in the sales and use tax imposed by the City, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO Section 1 Section 22-56 of the Wheat Ridge Code of Laws IS amended by the addition of a new subsection (c), to read as follows (c) Notwithstanding subsections (a) and (b) of this section, the sales tax rate imposed by this section shall be increased to two and one-half (2-1/2) percent of the purchase price, effective January 1, 1998 and terminating on December 31, 2002, or such date as a total of $12,350,000 has been raised, in the manner and as authorized by the one-half (1/2) percent increase approved by vote of the Wheat Ridge electorate on November 4, 1997, whichever occurs first Upon such termination, this subsection (c) shall also terminate and be deemed repealed Section 2 Section 22-66 of the Wheat Ridge Code of Laws IS amended by the addition of a new subsection (cl, to read as follows (c) Notwithstanding subsections (a) and (b) of this section, the use tax rate imposed by this section shall be increased to two and one-half (2-1/2) percent of the purchase price, effective January 1, 1998 and terminating on December 31, 2002, or such date as a total of $12,350,000 has been raised, in the manner and as authorized by the one-half (1/2) percent increase approved by vote of the Wheat Ridge electorate on November 4, 1997, whichever occurs first Upon such termination, this subsection (c) shall also terminate and be deemed repealed Section 3 Safetv Clause The City Council hereby finds, determines, and declares that this Ordinance is promulgated under the general police power of the City of Wheat (iLD\53027'2()l) J.:;O () I Ridge, that it is promulgated for the health, safety, and welfare of the public and that this Ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare The City Council further determines that the Ordinance bears a rational relation to the proper legislative object sought to be attained Section 4 Severabilitv: Conflicting Ordinances Repealed If any section, subsection or clause of this ordinance shall be deemed to be unconstitutional or otherwise invalid, the validity of the remaining sections, subsections and clauses shall not be affected thereby All other ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed Section 5 Effective Date This Ordinance shall take effect upon passage, as permitted by the Charter INTRODUCED, READ, AND ADOPTED on first reading by a vote of R to 0 on this 8th day of December , 1997, ordered published In full in a newspaper of general Circulation in the City of Wheat Ridge and Public Hearing and consideration on final passage set for December 22 , 1997, at 7 00 o'clock pm, in the Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by a vote of 7 to 0 , this 22nd day of December , 1997 SIGNED by the Mayor on this 71rrl day of l)p('pmher , 1997 ATTEST I -----j '\ , \ '- \ 'J '.' \ ,_ WANDA SANG, CITY CLERK First Publication December 12, 1997 Second Publication January 2, 1998 Wheat Ridge Transcript Effective Date December 22, 1997 (iU)\';3()2T.2h'Jl1() () I -2-
