WV-99-02) WITHIN THE CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO )D~' WHEREAS, right-of-way was previously dedicated for Lamar Street east of 6400 West 44th Place (heremafter, the "subJect nght-of-way"); and WHEREAS, the subJeet right-of-way lIes wlth1l1 the CIty of Wheat RIdge, County of JefTerson, State of Colorado, and WHEREAS, the subJect nght-of-way is not needed for any publIc purpose, and WHEREAS, no land adJoining the subject right-of-way will be left wIthout access to the publIc street system as a consequence of its vacatIOn. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO THAT: Section 1. Vacation. The following portIOn of Lamar Street, a dedleated street wlthll1 the CIty of Wheat Ridge, County of Jefferson, State of Colorado, is hereby vacated. The East 25 feet of the North 120.2 feet of the South 280,2 feet of Block 8, Lake VIew SubdIvIsIon Jefferson County, Colorado Total area be1l1g approxImately 3,500 square feet. Section 2. Conditions. rhe CIty will retain the utility easement per the reeommendation of the Public Works Department. That the property bell1g vacated be striped for three or four parkll1g spaces. ') Section 3. Vesting. Upon the vaeatIon accomplished hereby, tItle to the property vacated shall revert to abuttl11g property owner of record m the manner set forth in SectIOn 43-2-302, C.R.S Section 4. Safety Clause. The CIty Council hereby finds, determines, and declares that this ordll1ance IS promulgated under the general poliee power of the CIty of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the publIc and that thIS ordinance IS necessary for the preservatIon of health and safety and for the proteetlOn of publIc convemenee and welfare, The CIty JlE(EITIOlIO '0913892 Council further determ1l1es that the ordmance bears a ratIOnal relation to the proper legislative object sought to be attained. ~ Section 5. Severability. If any clause, sentenee, paragraph, or part of thIS Ordinance Code or the applicatIOn thereof to any person or circumstances shall for any reason be adjusted by a court of competent Junsdiction 1I1valId, such judgment shall not affect application to other persons or CIrcumstances. Section 6. Effective Date. This ordmance shall take effect 15 days after final publieation as provided by the Charter.
