TITLE:
AN ORDINANCE CONCERNING A CORRECTION TO
THE AMENDMENTS TO THE WHEAT RIDGE CODE OF
LAWS TO PROVIDE FOR INCREASED PENALTY
LIMITS
WHEREAS, pursuant to C.R.S. !j 13-10-113(1), any person convicted of
violating a municipal ordinance in a municipal court of record may be incarcerated
for up to one year or fined up to $1,000.00 or both; and
WHEREAS, Section 1-5 of the Wheat Ridge City Code of Laws, as well as
numerous individual penalty sections, were amended by Council Bill No. 17,
Ordinance No. 1120, Series of 1998, which increased the penalties to the
maximum penalties permitted by C.R.S. !j 13-1 0-113( 1); and
WHEREAS, a correction needs to be made, as one such revIsion to the
Wheat Ridge Code of Laws was erroneously omitted from Ordinance No. 1120.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO AS FOLLOWS:
Section 1. Conformina Chanaes: Fine. The first sentence of Section 16-
4(b) is hereby amended to read as follows:
Every person who, at the time of commission of the offense, or at
least eighteen (18) years of age, and who was subsequently convicted
of or pleads guilty or nolo contendere to a violation of any provision of
this chapter shall be punished by a fine of not less than twenty-five
dollars ($25.00) but not to exceed nine hundred ninety nine dollorG
($000.00) ONE THOUSAND DOLLARS ($1,000.00), or by
imprisonment not exceeding one hundred eighty (180) dOYG ONE
YEAR, or by both such fine and imprisonment.
Section 2. Safety Clause. The City Council hereby finds, determines and
declares that this ordinance is promulgated under the general police power of the
City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of
the public and that this ordinance is necessary for the preservation of health and
safety and for the protection of public convenience and welfare. The City Council

further determines that the ordinance bears a rational relation to the proper
legislative objective sought to be attained.
Section 3. Severability; Conflictina Ordinances Reoealed. If any section,
subsection or clause of this ordinance shall be deemed to be unconstitutional or
otherwise invalid, the validity of the remaining sections, subsections and clauses
shall not be affected thereby. All other ordinances or parts of ordinances in conflict
with the provisions of this ordinance are hereby repealed.
Section 4. Effective Date. This Ordinance shall take effect fifteen days after
final publication, as provided by Section 5.11 of the Charter.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to 0 on
this 13th day of December, 1999, ordered published in full in a newspaper of
general circulation in the City of Wheat Ridge and Public Hearing and consideration
on final passage set for January 10 , 2000, at 7;00 o'clock p.m., in the
Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by
a vote of 7 to 1 , this 10th day of January, 2000.
