TITLE:
AN ORDINANCE PROVIDING FOR THE APPROVAL OF
A SPECIAL USE PERMIT TO ALLOW CASINO BUS
DROP-OFF AND PICK-UP ON COMMERCIAL-ONE
ZONED PROPERTY LOCATED AT 12100 WEST 44TH
AVENUE, CITY OF WHEAT RIDGE, COUNTY OF
JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT
Section 1. Upon applIcatIOn by Bart MacGIllivray for BartMac Corp for approval of a
speCIal use permit in Wheat RIdge, Colorado, Case No SUP-00-01 and based on
recommendatIOn for approval from the Wheat RIdge Planning CommIssion and pursuant to
findings made based on testimony and evidence presented at publIc hearIng before the Wheat
RIdge CIty Council, Wheat RIdge maps are hereby amended to deSIgnate a SpeCIal Use Permit
on the followmg described land.
LOTS 1 THROUGH 4 INCLUSIVE, SHUMWAY RESUBDIVISION, CITY OF
WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO
Section 2. CondItIons.
1 The speCIal use permit be Issued to Bart MacGillIvray.
2. No casmo bus parklllg be allowed on adJacent publIc streets
3. The Idlmg of buses be subJect to the CIty of Wheat RIdge nuisance regulatIons
(SectIOn 15-26, OffenSIve DIscharges) WIth the Idllllg of diesel engllles limIted to
a maxImum of 15 consecutIve mlllutes.
4 A maxImum of approximately one casillo bus per hour be allowed in and out of
the hotel.
5 The casillo bus 10admg/parklllg space be marked or SIgned.
Section 3. Vested Property RIghts. Approval of this speCIal use permIt does not create a
vested property rIght. Vested property rIghts may only arIse and accrue pursuant to the
proVISIons of SectIOn 26(G)ofthe Code of Laws of the City of Wheat RIdge
Section 4. Safety Clause. The City CounCIl hereby finds, determmes, and declares that
thIS ordlllance is promulgated under the general police power of the CIty of Wheat RIdge, that It
IS promulgated for the health, safety, and welfare ofthe publIc and that thIS ordlllance IS
necessary for the preservatIon of health and safety and for the protectIOn of public convenIence
and welfare. The CIty Councll further determmes that the ordlllance bears a ratIOnal relation to
the proper 1egls1atlve obJect sought to be attained.
Section 5. SeverabilIty. If any clause, sentence, paragraph, or part of thIs Zomng Code
or the application thereof to any person or CIrcumstances shaH for any reason be adJusted by a
court of competent JUrIsdIctIOn invalid, such Judgment shall not affect applIcatIOn to other
persons or CITcumstances.
Section 6. SupersessIOn Clause. If any proviSIOn, reqUIrement or standard establIshed by
thIs OrdInance is found to conflIct WIth simIlar proviSIOns, reqUIrements or standards found
elsewhere III the Code of Laws of the City of Wheat RIdge, whIch are In eXIstence as of the date
of adoptIon of this Ordlllance, the proviSIOns, requirements and standards hereIn shall supersede
and prevail.
Section 7. ThIs ordmance shall take effect ---.lL days after final publIcatIOn.

Avenue, Wheat RIdge, Colorado.
