AN ORDINANCE APPROVING DEMOLITION OF TWO MUNICIPALLY-OWNED BUILDINGS LOCATED AT 6287 WEST 48TH PLACE. WHEREAS, Charter Section 165 requires approval, by ordinance adopted by a three-quarter majority of the City Council, prior to the sale or disposal of buildings or land owned by the City; and WHEREAS, the City Council wishes to dispose of two City-owned buildings located at 6287 West 48th Place, the Jaidinger house and barn, by demolition of the same, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO' Section 1. Pursuant to the authority vested in it by the Section 165 of the Wheat Ridge Charter, the City-owned structures (Jaidinger house and barn) presently located at 6287 West 48th Place are hereby approved for immediate disposal by demolition Section 2. The demolition of the Jaidinger house and barn shall include 1 The City shall remove and give to the Wheat Ridge Historical Society any artifacts they may desire 2 The demolition shall be completed in such a manner as to protect the existing plant material from damage as much as possible The demolition of the horse shed and former chicken coop to the east of the main house shall be completed in such a manner as to remove and preserve for later use all lumber dating from the 1860's 3 The demolition and earth work shall be limited to the house and barn and the grounds immediately adjacent to the house and barn The foot print and associated lateral supporting soils of the house and barn shall be backfilled and stabilized Section 3. Safety Clause The City Council hereby finds, determines, and declares that this Ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public and that this Ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare The City Council further determines GED\53027\340149.02 that the Ordinance bears a rational relation to the proper legislative object sought to be attained Section 4. Severability: Conflictina Ordinances Repealed If any section, subsection or clause of this ordinance shall be deemed to be unconstitutional or otherwise invalid, the validity of the remaining sections, subsections and clauses shall not be affected thereby. All other ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed Section 5. Effective Date This Ordinance shall take effect fifteen days after final publication, as provided by Section 5 11 of the Charter INTRODUCED, READ, AND ADOPTED on first reading by a vote of 7 to 1 on this 8th day of January, 2001, ordered published in full in a newspaper of general circulation in the City of Wheat Ridge and Public Hearing and consideration on final passage set for February 12, 2001, at 700 o'clock pm., in the Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by a vote of 7 to 1 , this 12th day of February ,2001 SIGNED by the Mayor on this 13th day of Februarv ,2001 ATTEST First Publication January 12, 2001 Second Publication February 16, 2001 Wheat Ridge Transcript Effective Date March 3, 2001 GED\53027\340149.02 -2-
