BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEA T RIDGE
COLORADO, THAT
Section 1. Upon applIcation by LIsa AIello. approval of a zone change In Wheal Ridge,
Colorado, Case No WZ-OI-02, and based on recommendatIOn of approval from Ihe Wheat RIdge
Plannmg CommIssIOn and pursuant to findmgs made based on lestlmony and eVidence presented al a
pubhc heanng before the Wheat RIdge CIty Council, Wheat Ridge maps are hereby amended 10
exclude from the Agncultural-One Dlstnct and to mclude m the Planned CommercIal Developmenl
DIstrIct the follow1l1g described land.

26-121 of the Code of Laws of the City of Wheat RIdge

ordmance IS promulgaled under the general polIce power of the City of Wheal Ridge, Ihat 11 IS
promulgated for the health, safety, and welfare of the publIc and thaI tillS ordInance IS nccessary for the
prcservatlOn of health and safety and for the protectIon of publIc conve111ence and welfare. The CllY
Council furthcr deterrnmes that the ordmance bears a ratIonal relatIOn to the proper legIslatIve obJecl
sought to be attamed.
Section 4. SeverabIlIty. If any clause, scntcnce, paragraph, or part of thiS ZonIng ('miL 1'1 thl'
applIcatlOn thereof to any person or circumstances shall for any reason be adjusted by a court 01
eornpetentJurisdlctlon mvalId, such Judgment shall not affecl applIcatIon to other persons or
Circumstances.
Section 5. SupersessIOn Clause. If any provIsIOn, reqUIrement or standard estabhshed by this
Ordmance IS found to conflIct with simIlar provIsIOns, reqUIrements or standards found elsewhere In the
Code of Laws of the City of Wheat RIdge, whIch are m eXistence as of the date of adoptIOn of thIS
Ordmance, the provISIOns, reqUIrements and standards herem shall supersede and prevaIl
Section 6. ThIS ordInance shall take effect 15 days after final publIcatIOn.
