BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT
Section 1, Upon apphcatlOn by CraIg Molenaar, approyal of a rezonmg In Wheat Ridge,
Colorado, Case No WZ-02-14, for property located at 6015 West 40'h Ayenue and based on a
reeommendatlOn for approyal from the Wheat RIdge PlannIng CommIssIon and pursuant to the findmgs
made based on testimony and eYldence presented at a public heanng before the Wheat RIdge CIty
CounCil, Wheat Ridge maps are hereby amended to exclude from the Commerelal One Dlstnct and to
mclude m the ReSidential One C zone dlstncts the follow111g described land,
A PARCEL OF LAND LOCATED IN THE NORTH ONE HALF OF THE NORTHEAST ONE
QUARTER OF THE SOUTHEAST ONE QUARTER OF THE SOUTHWEST ONE QUARTER
OF SECTION 24, TOWNSHIP 3 SOUTH RANGE 69 WEST OF THE 6TH PRINCIPAL
MERID1AN, DESCRlBED AS FOLLOWS
BEGINNING AT THE SOUTHEAST CORNER OF THE SAID NORTH ONE HALF WHICH IS
THE TRUE POINT OF BEGINNING, THENCE DUE NORTH 75 FEET, THENCE AT RlGHT
ANGLES DUE WEST 193 FEET, THENCE AT RIGHT ANGLES SOUTH 75 FEET, THENCE
AT RIGHT ANGLES DUE EAST 193 FEET TO THE POINT OF BEGINNING EXCEPTING
THEREFROM ANY PORTION WITHIN THE RIGHT OF WAY FOR HARLAN STREET,

Section 3, Safety Clause, The CIty CounCIl hereby finds, determmes, and declares that thiS
ordInance IS promulgated under the general polIce power of the City of Wheat Ridge, that it is
promulgated for the health, safety, and welfare of the publIe and that thiS ordmance IS necessary for the
preservatlon of health and safety and for the protection ofpubhc convemence and welfare The City
CounCil further determmes that the ordmance bears a ratIOnal relation to the proper legIslatIVe object
sought to be atta111ed.

Section 4, Seyerablltty, If any clause, sentenee, paragraph, or part of thIs Zonmg Code or the
applIeatJon thereof to any person or CIrcumstances shall for any reason be adjusted by a eourt of
competent JurisdletlOn myahd, such Judgment shall not affeet applIcatIOn to other persons or
Clrcumstanees,
Section 5. Supersession Clause, If any provISIon, reqUIrement or standard establIshed by thIS
Ordmance IS found to confhet WIth SimIlar prOVIsions, reqUIrements or standards found elsewhere III the
Code of Laws of the CIty of Wheat RIdge, whIch are m eXIstence as of the date of adoptIOn of thiS
Ordmance, the prOYISIOnS, requirements and standards herem shall supersede and preY31L
