TITLE: AN ORDINANCE AMENDING SECTION 26-106 OF THE
ZONING AND DEVELOPMENT CODE ADOPTING AN AMENDED
LAND USE REVIEW PROCESS CHART (CASE NO. ZOA-03-15)
WHEREAS, the city IS ll1terested in expeditlllg review of land use cases.
WHEREAS, there are occasions when pre-applicatIOn meetmgs and neighborhood
mcetmgs are not necessary.
WHEREAS, eXlstmg review process chart does not dlflerentwte between the ulflerent
types of planned development applicatIOns,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT
RIDGE, COLORADO THAT:

Code IS hereby amended with addition of the followmg chart:

B Procedure and notice
General
a. Prior to any public hearing before the planlllng commiSSIOn, the
City shall be reqUired to hold a neighborhood meetmg accordmg to
the reqUirements of SectIOn 26-109 A. (See Section 26-1 ()9 A. for
reqUirements. )
Section 3. Section 26-114, Special Uses, be amended with the additIOn of the followmg
language as paragraph C 2. With paragraphs 2,3. and 4 renumbered as paragraphs 3. 4, and 5

Prior to submittal of an application for a speCial use, the applicant shall be
reqUired to hold a neighborhood mput meetmg according to the
reqUirements of Seclion 26-109 A. (Sce SectIOn 26-109 A. for
requirements. )
Section 4. Safety Clause. The City of Wheat Ridge hereby finds, determmes, and
declares that thiS ordmance IS promulgated under the general police power of the City of Wheat
Ridge, that It IS promulgated for the health, safety, and welfare of the public and that thiS
ordinance IS necessary for the preservation of health and safety and for the protectIOn of public
convelllence and welfare The Clty Council further detenmnes that the ordinance bears a rations
relation to the proper legislative object sought to be attamed.
Section 5. Severability. If any clause, sentence, paragraph. or part of thiS ZOlllng
code or the application thereof to any person or circumstances shall for any reason be adjusted by
a court of competent JUrisdictIOn mvalid. such Judgment shall not affect apphcatlon to other
persons or circumstances
Section 6. Supersession Clause. If any prm'ISlOn, reqUirements or standard
established by thiS ordinance IS found to connlct with sllmlar prOVISions, reqUirements or
standards found elsewhere m the Code of Laws of the City of Wheat Ridge, which are m
eXistence as of the date of adoption of thiS ordmance, the proVISions, reqUirements and standards
here shall supersede and prevaIl
Section 7. ThiS ordmance shall take effect upon adoptIOn, as permitted by the Charter
