TITLE:
RESOLUTION SUPPORTING JEFFERSON COUNTY COALITION OF CITIES PROPOSED
CHANGE IN DISTRIBUTION AND PURPOSE OF ONE-HALF CENT COUNTY-WIDE
SALES TAX: AND SUPPORT OF CITY OF EDGEWATER IN SEEKING JUDICIAL
CLARIFICATION OF VESTED NATURE OF MUNICIPAL DISTRIBUTIONS OF TAX
REVENUES
WHEREAS, the citizens and taxpayers of the City of Wheat Ridge have a
direct interest in the distribution and use of proceeds from the county-wide
one-half cent sales tax approved by the Jefferson County voters on November 7,
1972; and
WHEREAS, the present county-wide sales tax purports to earmark for
Open Space purposes the municipal share of such sales tax proceeds, notwith-
standing the changing public needs and priorities of this community; and
WHEREAS, the County Open Space Fund presently makes available for
municipal expenditure only 50% of the funds allocated to the municipalities
pursuant to the registered motor vehicle formula contained in the implementing
Sales Tax Resolution adopted by the Jefferson County Board of County Commissioners;
and
WHEREAS, these issues of municipal concern are currently underqoing
litigation in a suit, Civil Action No. 79CV2l40, filed by the City of Edqewater
against the Jefferson County Board of County Commissioners to clarify the amount
and purpose for which municipal allocations from the county-wide sales tax may be
expended; and
WHEREAS, different funding distribution alternatives reflecting these
municipal concerns and which would also provide for the financing of a new
County Jail and Justice Center are being explored by the Jefferson County
Coalition of Cities; and
WHEREAS, the City Council of the City of Wheat Ridge supports a change
in the administration and use of county-wide sales tax funds through either
judicial interpretation or action of the electorate for the benefit of the
taxpayers of both the City and the County;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
Wheat Ridge, that:

1. Support is publicly expressed for the efforts of the Jefferson
County Coalition of Cities in ititiating a proposed change in the distribution
and purposes of the present one-half cent county-wide sales tax.
2. Support is also expressed for the legal efforts of the City of
Edgewater ln seeking judicial clarification of the vested nature of the
municipal distributions of tax revenues in order that the proceeds thereof
may be expended by elected local officials in accordance with local municipal
determination of public needs and priorities.
