TITLE: RESOLUTION AUTHORIZI:JG THE H}\.YOR TO SIGN A PURCI-:L'\SE
CONTRACT, PURCHASE SUBJECT TO FINAL COUNCIL APPROVAL,
FOR PORTIONS OF PROPERTY LOCATED AT 4100-4154 KIPLING
STREET IN WHEAT RIuGE, ALSO KNOWN AS THE VAN HOOSER
PROPERTY.
WHEREAS, the City Council in Resolution 651, Series
1979, has authorized the acquisition of portions of the Van
Hooser property under the Jefferson County Open Space Fund,
subject to the Fund being reimbursed by the City and Urban
Drainage and Flood Control District; and
WHEREAS, to expedite the beginning of construction on
the Lena Gulch storm drainage project, the Mayor and City Staff
have negotiated for the purchase of ~ortions of the Van Hooser
prooerty to be bought by the City and Urban Drainage and Flood
Control District and Jefferson County Open Space Fund;
~JOH, THEREFORE, BE IT RESOLVED by the City Council of
the City of Wheat Ridge that the Mavor be authorized to enter
into a purchase contract at the appraisal price for: a construction
easement on the property; a tract on the western end of the property,
bordering Kipling Street, containing 105,113 square feet; a tract
east of Kipling and south of West 41st Avenue containing 29,375
square feet, and
BE IT FURTHER RESOLVED that the City work with Jefferson
County Open Space on the purchase of the 1.12 acres of
land north of Independence Court, associated with the foot bridge
project, which may need to be purchased in the same transaction
with the two western narcels. This shall be purchased at the
appraisal price, and
BE IT FUqTHER RE20LVED that the ~urchase contract, with
its full list of stipulations, will be subject to final Council
anproval, and
BE IT FU~THER RESOLVED that Jefferson County Open Space
be sent a cooy of the ourchase contract so that it can consider
reimbursement to the City and the Urban Drainaoe and Flood Control
District for all of the proper expenses involved in the acquisition
of those portions of the Van Hooser prooerty which aualify for
the use of Ooen Soace Funds.
