TITLE: RESOLUTION AUTHORIZING THE NEGOTIATIOn AND AcnUISITION
OF THE T'7ELLER PROPERTY LOCATED N:' 1010.5 W. 33TH AVENUE

WHEaE~S, the City is interested in the acquisition of
land for dual public uses of ODen s~ace and storm drainage along
Lena Gulch; and
WHEREAS, the City shows in the Comprehensive Development
Plan a trail along Lena Gulch which also connects to Clear Creek
in the vicinity of Kipling Street; ann
'^lHEREAS, the City Comprehensive Development Plan shows
a green Parks and Open Space designation on the Future Land Use
Hap for the total Lena Gulch corridor and Clear Creek corridor;
and
m-IE"tEI'\.S, the City is working with the Urban Drainase and
Flood Control District to construct storr1 drainage improvements
along Lena Gulch, which improvements contain a trail and a grass
lined channel, wherever possible, to maintain the oDen cbaracter
of the gulch area; and
WHEREAS, Jefferson County Open Space Funds can be used for
buying ODen spaces and providing trails; and
~HEREI'\.S, the Urban Drainage and Flood Control Funds can be
used for the purpose of buying structures; and
\JHEREAS, the completion of this project will require the
donation or purchase of land In fee or the donation or purchase of
easements of portions of the property at 10105 W. 38th Avenue; and
WHEREAS, in the event a donation is not agreed to by the
owner, then it will be necessary to neqotiate a fair and equitable
price based on a qualified appraisal for the property needed by
the City;
~lO:J, THEREFORE, BE n' RESOLVED by the Ci ty Counci 1 of the
City of Wheat Ridge, that City Staff be authori~ed to request froB
the owner of the property at 10105 W. 38th Avenue the donation in
fee or in easements, as required, of property needed by the City
at 10105 W. 38th Avenue; and
BE IT FURTHER RESOLVED by the City Council of the City of
Wheat Ridge, that City Staff be authorized to negotiate a purchase
price for easeDents or fee title ownership, purchase and prepare
documents for closing the property at 10105 TV. 33th Avenue, if
necessary, sublect to final aDnroval by Council of the purchase
nrice; and
BE IT FuRTHER RESOLVED that Jefferson County Open Space
be requested to a/prove the use of ODen Space Funds for all of
the proper expenses involved in the anDraisal and purchase of
the property.
