TITLE: RESOLUTION AUTHORIZING THE CITY TO INI'fIATE CONDEMNATION
PROCEEDINGS IN ORDER TO ACQUIRE PORTIONS OF THE HERR
PROPERTY LOCATED AT 10200 WEST 38TH AVENUE IN w~EAT RIDGE
HHEREAS, the City requires the acquisition of easements on
land for storm drainage along Lena Gulch; and
~mEREAS, the City Council in Resolution 678, Series of 1980,
authorized an appraisal for the acquisition of portions of property
at 10200 West 38th Avenue needed in order to complete this project,
and
WHEREAS, negotiations have failed to produce a result satis-
factory to the needs of the City in connection with this project;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of liheat Ridge that the City Attorney be authorized to initiate
imnediate action in the condemnation of the following parcels of
land located at 10200 West 38th Avenue:
1. As permanent easement, a parcel described in the
attached description: Lena Gulch Drainageway Acquisition No. 2.104
(Exhibit A). Said easement shall be used for storm drainage.
2. As a temporary construction easement, a parcel described
ln the attached legal description: Lena Gulch Drainageway Construc-
tion Easement No. 2.104c (Exhibit B)
DONE AND RESOLVED this 13th
day of April, 1981.
