TITLE:
RESOLUTION REFERRING TO THE REGISTERED ELECTORS OF THE
CI'rY OF WHEAT RIDGE THE QUESTION OF THE PROPOSED
ENACTMENT OF AN ORDINANCE PROVIDING FOR THE IMPOSITION
OF A THREE PERCENT (3%) TAX UPON SALES MADE WITHIN THE
CITY OF WHEAT RIDGE, COLORADO.
WHEREAS, Chapter XI, Section 11.1 of the Home Rule Charter
of the City of Wheat Ridge, Colorado, provides, in pertinent
part, that no " . . . sales tax shall be levied after the
approval of this Charter until such tax shall be approved by a
majority of the electorate voting at a regular or special
municipal election;"
WHEREAS, the Code of Laws of the City of Wheat Ridge,
specifically Section 21-7 thereof, presently provides for the
levy and collection of "a tax on all sales of commodities and
services specified in Section 21-4 and not otherwise exempted in
Section 21-5 in the amount of two (2) percent of the purchase
price," which two percent (2%) sales tax rate was approved by a
vote of the electorate prior to approval of the City's Home Rule
Charter;
WHEREAS, the City Council of the City of wheat Ridge, after
consideration of the costs necessary to be incurred in providing
quality governmental services to the citizens of the City of
Wheat Ridge, has determined that it is necessary and appropriate
to submit to the electorate the question of increasing the sales
tax imposed and collected by and within the City of Wheat Ridge
from two percent (2%) to three percent (3%) of the purchase price
paid for defined goods and services, as specified in a Council
Bill which, if enacted as an Ordinance, would effect such a sales
tax increase;
WHEREAS, the provisions of C.R.S. 31-10-108, as made
effective within the City of Wheat Ridge pursuant to the
provisions of Sections 2.1 and 2.2 of the Home Rule Charter of
the City of Wheat Ridge, provide for the setting of an election
by a Resolution adopted by the City Council;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Wheat Ridge, Colorado, as follows:
1. At the regular municipal election of Tuesday,
November 3, 1987, the question shall be placed before the
registered electors of the City of Wheat Ridge as to whether the
City Council should adopt an ordinance which increases the sales
tax charged by the City of Wheat Ridge from the current level of
two percent (2%) to an increased level of three percent (3%).
2. If the majority of electors casting ballots on said
question at such municipal election vote for the adoption of such
an ordinance increasing the sales tax rate to three percent (3%),
the City Council shall, at its next regular meeting following
such election, adopt such an ordinance. If the majority of
electors casting their vote on such question at such municipal
election vote against adoption of such an ordinance increasing
the sales tax from two percent (2%) to three percent (3%), the
Council at its next regular meeting following such election shall
vote to defeat such an ordinance.
3. The City Clerk is hereby specifically authorized and
directed to perform all tasks necessary and lawful to place such
question on the ballot for the regular municipal election of
November 3, 1987, and thereafter to certify the results in
conformance with applicable state law.
