RESOLUTION NO. 1218

TITLE:
A RESOLUTION ADOPTING AN ANNEXATION POLICY FOR THE
CITY OF WHEAT RIDGE.
WHEREAS, Colorado Revised Statutes, Title 31, Article
12 sets forth specific legal and procedural requirements for
municipal annexation; and
WHEREAS, in addition to such legal and procedural
requirements, the City of Wheat Ridge desires to establish its
own basic annexation philosophy as set forth by a set of policy
statements; and
WHEREAS, such policy statements will guide the City
Council and staff when reviewing future requests or proposals for
annexation and will provide a framework for decision making.
NOW, THEREFORE, BE IT RESOLVED that the following
policy statements are hereby adopted by the Wheat Ridge City
Council in furtherance of establishing an annexation philosophy
for the City of Wheat Ridge:
POLICY NO.1: The majority of owners of land or the owner(s) of
the majority of land included within the area
proposed for annexation are in favor of the
annexation.
POLICY NO.2: The annexation area is proposed to be developed in
conformance with the City of Wheat Ridge's
Comprehensive Land Use Plan for the area or
adjacent to the area.
POLICY NO.3: The owner(s)/developer(s) will install all
necessary utilities and public improvements and
expand or upgrade existing facilities to meet City
standards where necessary, at their expense.
Adequate proof of capacity to serve, including
inclusion within or plans for creation of a
special service or improvement district as well as
capability to finance such improvements will be
required.
POLICY NO.4: The area proposed for annexation can be adequately
and cost effectively serviced by City police,
public works, parks and recreation and other City
agencies, at a positive cost/revenue position for
the City within a reasonable time frame.
POLICY NO.5: There is a reasonable relationship (i.e., social,
economic or physical) between the City of Wheat
Ridge and the area proposed for annexation.
POLICY NO.6: Area to be annexed will be rezoned within 90 days
of annexation to Agricultural-One, or to another
category if proposed for specific development and
in compliance with normal rezoning criteria.
