SERIES OF 1991
TITLE:
A RESOLUTION OF THE CITY OF WHEAT RIDGE URGING THE
GENERAL ASSEMBLY OF THE STATE OF COLORADO TO REPEAL THE
PROHIBITIONS AGAINST LOCAL REGULATION OF UNDERGROUND
STORAGE TANKS AS SET FORTH IN COLO. REV. STAT. 8-20-508,
AND REPEALING THE LIMITS ON FINANCIAL LIABILITY OF
OPERATORS OR OWNERS OF PETROLEUM UNDERGROUND STORAGE
TANKS AS SET FORTH IN SECTION 8-20-509, COLO. REV. STAT.
WHEREAS, the City of Wheat Ridge is a home rule municipal
corporation operating pursuant to the provisions of Article XX,
Section 6, of the Constitution of the State of Colorado and the
Home Rule Charter adopted by the electors of the City of Wheat
Ridge in 1978;
WHEREAS, the City Council of the City of Wheat Ridge sincerely
believes that the regulation of underground storage tanks used for
storage and dissemination of petroleum products is a matter which
should be regulated at the local level, not at the statewide level;
WHEREAS, the experience and belief of the City Council of the
City of Wheat Ridge is that the limitations upon liability granted
to owners and operators of such underground storage tanks which
have in fact leaked, allowing unhealthy and damaging petroleum
product to escape into the soil and environment, is unfair to the
taxpayers who support the State's treasury.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Wheat Ridge, Colorado that:
1. The City Council of the City of Wheat Ridge, Colorado,
as the legislative body of and within the City of Wheat Ridge, does
hereby respectfully urge the General Assembly to repeal the
prohibition against more stringent local requirements set forth in
Colo. Rev. Stat. 8-20-508, and to repeal the limits of financial
responsibility against owners or operators of petroleum underground
storage tanks as set forth in Colo. Rev. Stat. 8-20-509.
