TITLE.
A RESOLUTION APPROVING AN AMENDMENT AND AUTHORIZING
THE MAYOR AND CITY CLERK TO EXECUTE THE FIRST AMENDMENT
TO THE INTERGOVERNMENTAL AGREEMENT CREATING THE
JEFFERSON COUNTY HAZARDOUS SUBSTANCE RESPONSE
AUTHORITY
WHEREAS, in 1984 the City of Wheat Ridge executed an Intergovernmental
Agreement to join the Jefferson County Hazardous Substance Response Authority (Authority);
and
WHEREAS, the current provisions of the Authority's Intergovernmental
Agreement relating to amendments to the Agreement has presented operational problems for the
Authority; and
WHEREAS, the Authority has proposed an amendment to the IGA which will
simplifY and help to resolve voting problems experienced by the current IGA; and
resolution.
WHEREAS, the City of Wheat Ridge has the authority to amend the IGA by
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Wheat Ridge that the first amendment to the Intergovernmental Agreement concerning the
Implementation of a County Hazardous Substance Response Authority, Section XVII of said
Agreement, is hereby approved (copy attached) and be it further resolved by the City Council
that the Mayor and City Clerk are authorized to execute said first amendment to the
Intergovernmental Agreement on behalf of the City of Wheat Ridge.
DONE AND RESOLVED this 12th day of February, 1996.

IMPLEMENTATION OF A COUNTY
HAZARDOUS SUBSTANCE RESPONSE PROGRAM
CURRENT LANGUAGE:
XVII. AMENDMENT
This Agreement may be amended by the partIes from tIme to trme, but any amendment
shall be m wnting and approved by all parties to the Agreement.

This Agreement may be amended by the parties from trme to time, but any proposed
amendment shall be in wntlllg and sent to eachJUflsdictlOn Via a system showing delIvery was
made. It shall bc amcnded only upon an approval vote of two-thirds of those parties respondmg
to the request no latcr than SIXty days from onginal mailmg.
PLEASE NOTE: Due to the broad type of agencies involved withlll this Intergovernmental
Agreement, thIS proposed language will reqUIre the Authonty to msure each Junsdletion received
the proposed amendment, and walt a suffiCIent pcriod of tIme to allow each of them to process
the amendment.

ThIS First Amendment to the Intergovernmental Agreement, dated for reference purposes
only thIs day of , 1996, IS made and entered into by and between the
thirty-one Junsdietions currcntly Involved in thc program.
WITNESSETH.
WHEREAS, the partIes entered mto an Intergovernmental Agreement creating thc
Jefferson County Hazardous Substance Rcsponse Authonty (thc "IGA") to operate and managc
the County's Hazardous Matenals Response Team, and
WHEREAS, the partIes intend to modIfy the IGA so the Authonty ean bettcr servc its
purposes.
NOW, THEREFORE, for and in conSIderatIon of the covenants and conditIOns set forth
hercm, and for other good and valuable conSideratIOn, the sufficIency of whIch IS hcrcby
acknowlcdged, the partIes agree that the IGA shall be, and hereby is, amended as follows,
SectIOn XVII AMENDMENT, of the IGA is amended to read as follows:
