RESOLUTION NO. 1521

TITLE.
RESOLUTION ON SENATE BILL 10 AND SENATE BILL 187 - BILLS
RELATING TO TELECOMMUNICATIONS SERVICES
WHEREAS, the City of Wheat Ridge (the "City") encourages unrestricted entry
into the telecommunications field; and
WHEREAS, the City wants to ensure that all consumers benefit from
competition and expansion of the telecommunications industry; and
NOW THEREFORE BE IT RESOLVED by the Wheat Ridge City Council that
Senate Bill 10 and Senate Bill 187 be supported in concept but amended to provide
that
1) Governmental entities are able to recover the full costs associated with
the use of public rights of way, including costs of maintenance and
operation of the rights of way and the depreciation of the streets resulting
from multiple street cuts and equipment in the rights of way
2) Governmental entities be allowed to require in-kind services including
provisions for Public, Education, and Government (PEG) Access, the
free use of channel capacity for these uses and the ability to collect
monies or services to provide PEG programming
3) Governmental entities retain the ability to enforce customer service
standards that provide both performance standards and that provide a
process for aggrieved consumers to resolve complaints
4) Governmental entities retain the ability to maintain the current revenue
that the City collects from telecomm unication providers which includes
monies from local exchange providers, long distance providers and cable
providers.
BE IT FURTHER RESOLVED that the City would like S.B 10 and S B 187
amended to address the City's concerns
