A RESOLUTION COUNCIL TO AUTHORITY STATING OPPOSITION OF THE WHEAT RIDGE CITY LEGISLATION LIMITING MUNICIPAL LAND USE WHEREAS, the Wheat Ridge City Council has been made aware of numerous bills pending in the current session of the Colorado General Assembly which propose various limits upon local government land use authority; and WHEREAS, the 32,000 residents of the City of Wheat Ridge have repeatedly expressed their support for the protection of their established residential neighborhoods through the exercise of land use authority by the City; and WHEREAS, the residents of the City of Wheat Ridge have on many occasions and in many forums expressed concern about the erosion of the land use regulatory protections for their neighbor hoods; and WHEREAS, the Wheat Ridge City Charter has been amended by a vote of the residents of the City to specifically impose limitations on the height and density of development in order to protect existing Wheat Ridge neighborhoods; and WHEREAS, the Wheat Ridge City Council takes seriously the state-sponsored Smart Growth planning process, one of the results of which was to emphasize local control of land use decision- making, and WHEREAS, it is both the obligation and the desire of the Wheat Ridge City Council to communicate the strong opposition of its citizens to Lhe several measures pending in the Colorado General Assembly which would limit the City's ability to provide the protections those citizens have and will continue to demand. NOW, THEREFORE, BE IT RESOLVED by the Wheat Ridge City Council, that: Section 1: The Wheat Ridge City Council, on behalf of its citizens, herewith expresses its opposition Lo the following measures currently pending in the Colorado General Assembly: a House Bill 96-1124: concerning the resolution of disputes arising from the imposition of land use restrictions; ,j "I:::' ~cl;: 7;~ I b. House Bill state and programs; 96-1232' concerning local authority for delineation of environmental c House Bill 96 -12 74, concerning restraint on the use of private property by governmental entities; d. House Bill 96-1303. property development included in specific concerning the protection of rights established in property development plans; e. House Bill 96-1305: concerning remedies available to property owners for violation of constitutional property rights by governmental entities; f Senate Bill 96-36: concerning the protection of agricultural lands by units of local government, g. Senate Bill 96 -48: concerning the administration of permits for areas and activities of state-wide interest; h. Senate Bill 96-61: concerning measures to lmprove the efficiency of the county planning process, l. Senate Bill 96-69: concerning impairment of property rights. regulatory Section 2: The City Council herewith expresses its support for the position of the Colorado Municipal League on these measures. Section 3: A copy of this Resolution shall be immedi- ately forwarded to representatives of the City of wheat Ridge in the Colorado House and Senate. Section immediately. 4.
