HomeMy WebLinkAboutResolution-1996-1545 RESOLUTION NO 1 ~L. ~ Series of 1996 TITLE RESOLUTION APPROVING INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF WHEAT RIDGE, AND THE TOWN OF MOUNTAIN VIEW RELATING TO THE USE OF NON-RESIDENT VOUCHERS FOR RECREATION PROGRAMS WHEREAS, the parties referenced in the title of this resolution wish to enter into an agreement to allow the Town of Mountain View to use a voucher system for its residents; and WHEREAS, the City of Wheat Ridge has agreed to accept vouchers from residents ofthe Town of Mountain View in payment for the non-resident fee portion of of recreation program fees; and WHEREAS, the Town of Mountain View agrees to use the vouchers on the applicable programs as listed and offered by the City of Wheat Ridge Recreation program; and WHEREAS, The Town of Mountain View agrees to monetarily reimburse the City of Wheat Ridge for all vouchers presented by the City of Wheat Ridge to Mountain View; and WHEREAS, Section 14.2 of the Home Rule Charter of the City of Wheat Ridge requires that all intergovernmental agreements entered into by the City be approved by resolution, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Wheat Ridge, Colorado, as follows. 1 That certain Intergovernmental Agreement between the City of Wheat Ridge, Colorado and the Town of Mountain View, relating to the use of non-resident vouchers for recreation programs, wluch is attached hereto, is hereby approved, 2 The Mayor and City Clerk are authorized to execute said Intergovernmental Agreement. I-"J':'L~A Lv.......(,,/~ Dan Wilde, Mayor ATTEST Wanda Sang, City Clerk INTERGOVERNMENTAL AGREEMENT BETWEEN THE TOWN OF MOUNTAIN VIEW AND THE CITY OF WHEAT RIDGE REGARDING THE USE OF TOWN OF MOUNTAIN VIEW VOUCHERS FOR CITY OF WHEAT RIDGE PARK AND RECREATION ACTIVITIES THIS AGREEMENT is entered into this day of 1996, by and between the TOWN OF MOUNTAIN VIEW, COLORADO, a municipal corporation (hereinafter referred to as "Mountain View" or the "Town") and the CITY OF WHEAT RIDGE, COLORADO, a municipal corporation (hereinafter referred to as "Wheat Ridge" or the "City"), and collectively referred to as "the Parties." WHEREAS, Mountain View and Wheat Ridge are duly incorporated under the laws of the State of Colorado and are authorized to enter into this Intergovernmental Agreement under Colo. Rev. Stat. ~~ 29-3-201, et sea. . WHEREAS, Mountain View will issue vouchers to its residents that may be used by Mountain View residents as payment, or partial payment, for services offered by the City of Wheat Ridge Parks and Recreation Department; WHEREAS, vouchers issued by ties; and Mountain View seeks to have Wheat Ridge accept the Town for City Parks and Recreation activi- WHEREAS, to Mountain View, vouchers received. Wheat Ridge would then forward the vouchers back and the Town would reimburse the City for the NOW, THEREFORE, in consideration of the foregoing recitals and mutual covenants and promises set forth below, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, Mountain View and Wheat Ridge agree as follows: 1. Mountain View agrees to issue two types of vouchers to its residents: five dollar ($5.00) vouchers and eighty-five dollar ($85.0) vouchers, in an amount not to exceed one thousand eight hundred fifty dollars ($1,850.00), as specified hereinbelow. a. Four five dollar ($5.00) vouchers per person/ per year with a total of up to 200 vouchers, disbursed on a first- come first-served basis. ($1,000.00 total.) b. Ten family vouchers for the City swimming pool ($85.00 value), also disbursed on a first-come first-served basis. ($850.00 total.) 2. Mountain View reserves the right to number and type of vouchers issued; provided however, modi fy the that in no GED\53027\157565 2 07/02/96 (3 20pml event shall the total amount of the vouchers issued exceed one thousand eight hundred fifty dollars ($1,850.00). Mountain View agrees to notify Wheat Ridge in the event the Town determines it is necessary to modify the number and type of vouchers issued. 3. Only one voucher may be used per program in Wheat Ridge, with the sole exception of swimming lessons as discussed in paragraph 4 hereinbelow, with the intent of the vouchers being to cover the cost of the nonresident fee otherwise charged to resi- dents of the Town of Mountain View. 4. Two vouchers per session may be applied to swimming lessons to cover the nonresident fee of ten dollars ($10.00) per session, with the intent of the vouchers being to cover the cost of the nonresident fee otherwise charged to residents of the Town of Mountain View. 5. Wheat Ridge agrees to honor and 'accept the vouchers issued by Mountain View without restriction except as provided in paragraph 6 hereinbelow, and then forward the vouchers b3ck to the Town for reimbursement to Wheat Ridge 6. The Parks and Recreation Department of the City of Wheat Ridge shall have the sole discretion to make the determina- tion of which programs are not subj ect to the vouchers, the following programs shall not be subject to the vouchers: a. Programs contracted through pri vate businesses; such programs as of the date of this Agreement include Jazzercise and Sereff Taekwon Do. b. Drop-in fee programs and facility rentals. 7. Wheat Ridge reserves the right to determine based on its convenience the manner in which it will send the vouchers to Mountain View for reimbursement. Mountain View will reimburse Wheat Ridge whenever it receives from the City the accepted voucher, whether received individually or in bulk. 8. By entering into this Agreement, neither Wheat Ridge nor Mountain View shall be considered as acting for the other or as an agent for the other. The Parties agree that they are and shall remain responsible for their own negligent acts and omissions.
