RESOLUTION NO. 1547
TITLE:
A RESOLUTION AUTHORIZING CONDEMNATION OF PROPERTY
INTERESTS FOR THE CITY OF WHEAT RIDGE COMMUNITY CENTER
AND RECREATION PROGRAM
WHEREAS, the City of Wheat Ridge, Colorado, is involved
in a program to provide a community center and related recreational
facilities in the vicinity of 9110 W. 44th Avenue; and
WHEREAS, construction of said
(hereinafter the "Project") will provide
recreation and related facilities; and

WHEREAS, acquisition of the property interests described
in Exhibit A attached hereto and incorporated herein by this
reference (hereinafter the "Property"), is necessary for the
completion of said Project; and
WHEREAS, negotiations to purchase the Property have, to
this point, been unsuccessful; and
WHEREAS, the City of Wheat Ridge has determined that it
is necessary to acquire the Property, and that, in the event that
good faith negotiations do not result in voluntary granting of the
fee title in the Property, it is necessary that the City of Wheat
Ridge acquire said interest in said real property through the use
of the City's power of eminent domain as reserved to the City in
its Home Rule Charter and in Article II, Section 15 of the
Constitution of the State of Colorado and in C.R.S. ~~ 38-1-101, et
~, and 38-6-101, et sea.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WHEAT RIDGE, COLORADO, THAT:
1. The City Council hereby finds that the Project will
serve a public purpose by providing community meeting, recreation
and related facilities. The City Council further finds that it is
necessary to acquire the Property to achieve said public purpose.
2. The City Council does hereby declare its intent to
acquire the Property from the Owner(s) and all others having an
interest therein.
3. The City Council specifically authorizes that
negotiations between the City and the Owner (s) of the Property
continue in good faith, but in the event such negotiations are
unsuccessful, acquisition of the Property from the record Owner(s)
thereof and all other owners having an interest therein, through
use of the City's powers of eminent domain based upon the City's
powers of eminent domain granted by the Constitution of the State
of Colorado, by the Home Rule Charter and by Statutes of the State
of Colorado, is hereby authorized.

4. A copy of this Resolution shall be forwarded to the
record Owner(s) of the Property.

A tract of land located in the Southwest One-Quarter of the
Northeast One-Qu8rter of Section 22, Township 3 South, Range 69
West. described as follows:
Commencing at the intersection of the South line of West 44th
Avenue and the West line of said Northeast One-Quarter. of
Section 22; Thence East along the South line of West 44th
Avenue which is parallel with the South line of said Northeast
one-Quarter, a distance of 253.0 feet to the TRUE POINT OF
BEGINNING; Thence South and parallel with the West line of said ~
Northeast One-Quarter, 8 distance of 300.0 feet; 'thence East J
and parllllel with the South line of West 44th Avenue and the
South line of said Northeast One-Quartet, a cHstance of 100.0
feet; Thence North and parallel with the west line of said
Northeast One-Quarter. a distance of 300.0 feet to a point on
the South right of way li.ne of West 44th Avenue; Thence west
along said South right of W8Y line, a dist8nce of 100.0 feet to
the true point of beginning. Except that part of the above
