TITLE:
RESOLUTION APPROVING PROPOSED THIRD AMENDMENT TO
INTERGOVERNMENTAL AGREEMENT WITH PARTICIPATING ENTITIES
TO THE EMERGENCY TELEPHONE SERVICE AUTHORITY CONCERNING
IMPLEMENTATION OF AN E-911 EMERGENCY TELEPHONE SERVICE
WHEREAS, Section 14.2 of the Home Rule Charter of Wheat
Ridge provides express authority to enter into intergovernmental
agreements providing for cooperative efforts between governments;
and
WHEREAS, the city of Wheat Ridge and participating
entities to the Emergency Telephone Service Authority wish to
jointly improve the efficiency of the emergency telephone
authority; and
WHEREAS, in the spirit of cooperation, the City of Ridge
agrees to allow the Emergency Telephone Authority to convey
property/equipment to a Public Safety Answering Point ("PSAP") when
the property/equipment is kept on the premises and operated by the
PSAP;
NOW, THEREFORE, BE IT RESOLVED by the city Council of the
City of Wheat Ridge, Colorado, as follows:
1. That certain proposed Third Amendment to
Intergovernmental Agreement concerning implementation of an E-911
Emergency Telephone Service, attached hereto, is hereby approved.

Re: NOTIFICATION OF PROPOSED AMENDMENT TO IGA CREATING THE EMERGENCY
TELEPHONE AUTHORITY
Dear Mayor:
The Board of Directors of the Emergency Telephone Authority ("E911 Board") propose the attached
amendment to the Intergovernmental Agreement ("IGA") which established the Emergency Telephone Service
Authority (the "Authority"). This amendment allows the Authority to convey property\equipment to a Public
Safety Answering Point ("PSAP") when the property\equipment is kept on the premises and operated by the
PSAP.
Since all PSAPs are presently required to purchase insurance for all Authority equipment on their
premises, this amendment allows PSAPs to simply include Authority property\equipment in their individual
inventories. Thus, the Authority satisfies state statue inventory requirements (Colorado Local Government
Uniform Accounting Law, Section 29-1-506 C.R.S.) and eliminates expensive inventory costs. Please note this
proposed amendment provides that if a PSAP terminates its membership in the Authority or defaults under
the terms of the Agreement, the property shall be returned to the Authority. Conversely, if the IGA is
terminated by agreement of a majority of the parties, the property and equipment shall remain in the ownership
of the PSAP.
One technical note: "the IGA may be amended by a written agreement executed and approved by not less
than 75 percent of the Participating Entities who convey a position on the proposed amendment within sixty
(60) days after all of the Participating Entities have been given written notification of the proposed amendment.
At least 50 percent of the Participating Entities must convey a position on this proposed amendment." In
simpler terms, we need your Council to either execute the proposed amendment or indicate in writing it does
not approve the amendment. Please send your Council's response to me at POB 3-D. Arvada, Colorado 80001-

THIRD AM )MENT TO INTERGOVERNME. .L AGREEMENT
CONCERNfN'G IMPLEMENTATION OF AN E-911 EMERGENCY
TELEPHONE SERVICE
THIS THIRD AMENDMENT to the Intergovernmental Agreement concerning the
implementation of an E-911 Emergency Telephone Service (the "Agreement") is dated for reference
purposes only this 1st day of October, 1996.
WITNESSETH
WHEREAS, the undersigned governmental entities (the "Participating Entities") are all parties
to the Agreement; and
WHEREAS, the Agreement provides that it may only be amended as provided in the Second
Amendment to the Agreement which is attached hereto as Exhibit A; and
WHEREAS, the parties to the Agreement are desirous of permitting the Authority to convey
ownership of equipment and property used in the operation of emergency telephone service to the
party who uses such equpment when it is located on said party's property.
NOW, THEREFORE, in consideration of the mutual covenants set forth herein, the
Participating Entities do hereby amend the Agreement as follows:
1. Article V is hereby amended by the addition of a new paragraph at the end of Article V as
follows:
The Authority may conveyor transfer ownership of property and equipment purchased
for the operation of emergency telephone service to a party to this Agreement if such
property or equipment is located on the party's property and operated by such party.
2. Article Xl of the Agreement is hereby amended by the addition of the following sentence
after the third sentence in Article XI::
Any property or equipment which has been purchased with Authority funds for a party
or conveyed to a party by the Authority shall be reconveyed to the Authority by the
defaulting party within fifteen (15) days after the defaulting party's membership has
terminated as set forth above.
3. Article XII, Section'"B is amended by the addition of the fullowing sentence:
Any property or equipment which has been purchased with Authority funds for a party
or conveyed to a party by the Authority shall be reconveyed to the Authority by the party
terminating its membership within 180 days after giving written notice of the party's
intent to terminate its participation in the Authority.
4. Article XII, Section C is amended by the addition of the following sentence at the end of
Section C:
Upon such termination any property or equipment previously transferred to a party
shall remain the property of said party.
5. Article XII, Section D is amended by the addition of the following language at the end of the
first and only sentence in Article VII, Section D:
"as provided in Section XL"
6. Except as amended herein and as amended by the First and Second Amendment to the
Agreement, the Agreement shall be and remain in full force and effect.
IN WITNESS WHEREOF, the parties have executed this Third Amendment to the Agreement.
