HomeMy WebLinkAboutResolution-1999-0038 RESOLUTION NO. 38 See Resolution 44 SERIES OF 1999 TITLE: A RESOLUTION AllTHORIZING JEFFERSON COUNTY OPEN SPACE TO SECURE A SURVEY, APPRAISAL, PHASE I ENVIRONMENTAL ASSESSMENT, TITLE COMMITMENT, NEGOTIATE FOR THE ACQUISITION OF 3.5 ACRES, MORE OR LESS, OF PROPERTY INCLUDING WATER RIGHTS LOCATED AT 10551 W.41't AVENUE AND ALL COSTS OF ACQUlSITION BE PAID 100% FROM THE JEFFERSON COUNTY SHARE OF THE OPEN SPACE FUND, SAID PROPERTY TO BE USED FOR PARK AND RECREATION PURPOSES. WHEREAS The City of Wheat Ridge Master Plan has identified the deSire to acqUire additIOnal park land along the Clear Creek Greenbelt, and the property located at 10551 W 41 st A venue will meet the Parks and Recreation need for park land m this area of Wheat Ridge, and WHEREAS The use ofthe property shall be for Parks and Recreation purposes which may Include, but not be limited to, anyone or more of the following: wildlife habitat, walkmg paths, turf/passive play fields tree and shrub plantmgs, and natural areas With the final use determmed by a senes of public neighborhood meetings, and WHEREAS The City of Wheat Ridge deSires to purchase the land and an} associated water rights. and WHEREAS The City of Wheat Ridge does not have suffiCient fundmg to purchase all the current Parks and Recreation land needs m the CIty NOW THEREFORE BE IT RESOLVED BY THE CITY OF WHEAT RIDGE CITY COUNCIL THAT I) The Jefferson County Open Space Department be authonzed to secure a survey, appraisal, phase I environmental assessment, title commitment, and negotiate for the acquisition of3.5 acres, more or less, of property including water nghts located at 10551 W 41 ,t Avenue, said property to be used for parks and recreatIOn purposes. 2) The acquisitIOn of the property may be Included In a legacy grant applicatIOn. 3) All structures to be cleared from the property pnor to closing. 4) All costs of acqUisition be paid 100% from the Jefferson County share of the Open Space Fund.
