RESOLUTION NO 23-2001

TITLE:
A RESOLUTION CALLING AND GIVING NOTICE OF AN
ELECTION FOR THE PURPOSE OF SUBMITTING PROPOSED
AMENDMENTS TO THE HOME RULE CHARTER TO THE
VOTERS OF THE CITY.
WHEREAS, Section 16.8 of the Wheat Ridge Home Rule Charter and Section
31-2-210 of the Colorado Revised Statutes permits the City Council to submit
proposed Home Rule Charter amendments to the voters of the City; and
WHEREAS, the Council wishes to place before the voters at the November 6,
2001 election two ballot measures concerning amendments to the Charter.
NOW, THEREFORE, BE IT RESOLVED by the Wheat Ridge City Council, that:
Section 1. Notice And Call Of Election.
Pursuant to Section 16.8 of the Home Rule Charter and
Section 31-2-210(41. C.R.S., the City Council hereby gives notice of and calls an
election to be held in the city on November 6, 2001, for the purpose of submitting
proposed amendments to the Home Rule Charter to a vote of the registered
electors of the City.
Section 2. Full Text of Proposed Amendments.
The following proposed amendments to the Charter are hereby submitted to
the voters of the City for their consideration at the general election to be held
November 6, 2001.
Proposed Amendment 1:
Amend subsection (b)(1) of Section 5.7 of the Charter as follows:
Sec. 5.7. Executive Sessions
(b) An executive session may be convened only on the following matters'
(1) Legal Consultation. The city council may convene an executive
session under the following conditions

(A) A suit has been filed against the city or the city has
received formal written notice that a suit against the city
is imminent.
(B) The city council is considering instituting legal action
against another party.
(C) The city council has knowledge of violations of the law
and is considering the possibility of criminal prosecution.
(0) CONFERENCES WITH THE CITY ATTORNEY FOR THE
PURPOSE OF RECEIVING LEGAL ADVICE ON SPECIFIC
LEGAL QUESTIONS.

The ballot title for the proposed Charter Amendment shall read as follows:

Proposed Amendment 2.
Amend subsection (bl(3) of Section 5.7 of the Charter as follows:

The ballot title for the proposed Charter Amendment shall read as follows.

Section 3. Effective Date. This Resolution shall be effective upon adoption.
