HomeMy WebLinkAbout08/26/1985 CITY COUNCIL MINUTES CITY OF WHEAT RIDGE, COLORADO AUGUST 26, 1985 The City Council Meeting was called to order by the Mayor at 7 30 P m Councilmembers present Tony Flasco, Larry ~1erkl, Moe Keller, Nancy Snow, Randy West, and Dan Wilde Clyde Hobbs arrived at 7 35 P m Also present City Clerk, Wanda Sang City Administrator, Tom Palmer; City Attorney, John Hayes Public Works Director, Rodqer Young staff; and interested citizens Motion by Mr seconded by Mr absent at that Wilde West meeting for the approval of the Minutes of August 12, 1985 Mrs Keller asked to abstain because she was Motion carried 5-0 with Mrs Keller abstaining CITIZENS' RIGHTS TO SPEAK There was no one present to speak PUBLIC HEARINGS AND ORDINANCES ON SECOND READING Item 1 Proposed amendment to the Wheat Ridge Comprehensive Plan, Section V Transportation, Subsection III, Street Classification and Standards, and Major Streets Plan (Case No. WPA-85-1) Public Works Director, Rodger Young, and City Engineer, Ric Minetor, presented the proposed changes to the Major Street Plan on the Comprehensive Plan Speaking in opposition were Mark Matulik, 3293 Simms, regarding the flood plain issues of Lena Gulch; is concerned about bridges to be constructed across Lena Gulch Penny Bedell, 11597 W 38th Place, regarding the 104 signatures on petitions circulated in opposition to any street changes Lillian Smith, 3179 Vivian Street, 32nd Avenue as a major artery; street is already four lanes and is capable of taking care of traffic 2 schools cross this street; make street safe for children Phyllis Lancaster, 4076 Everett Street, strange ideas are coming out of City Hall, but undoubtedly this beats all It is madness to make 44th Avenue wider, when it is right next to an interstate also addressed destruction of residential areas, lakes Allan Goulding, 3195 Simms, Wheat Ridge isn't growing anymore, why more streets; why does Wheat Ridge have to be a corridor for other areas CITY COUNCIL INUTl _ August 26, 1985 Page -2- Jim Rogers, 3875 Robb Street, Greenbelt lS the Crown Jewel of this City, doesn't want a bridge across it; consensus of people at meeting was to leave streets the way they are Tony Ficco, 12425 W 38th Ave , consensus of people at this meeting lS 32nd, 38th, and 44th are no trouble John area 38th Jerman, objects Avenue; 11694 W to bridge Wadsworth 37th Avenue, letter on behalf of residents in his across Simms Street; suggests some improvement on to Young field is a hazard; bike paths are a joke Phil Plummer, 10398 W 35th Avenue, opposes dividing up the Greenbelt or placing any additional streets in that area Earl Moyer, 3722 Simms Street, feels this is an idea which has come & gone; bridge across Simms should have been built 20 years ago; why now, when area is developed; objects to any idea destroying our Greenbelt Don Lancaster, 4076 Everett, basically agrees with most remarks except 38th Avenue opposes staff's plan Martha Shacklett, 3592 Simms, wrote letter to Council; also presented petitions; feels before changes are made, should go to the vote of the people Roger Knight, 3370 Simms, feels signals should allow longer times each way; Wheat Ridge is at its limit Robert Smith, 10600 W 35th Avenue, questions feasibility of W 35th being a minor collector; street doesn't go anywhere James Weir, 3363 Simms, agrees with Street Committee; urges Council to take note of Committee's recommendations Claudia Worth, 4650 Oak Street, objects to street width; wants Wheat Ridge to keep its identity and narrow streets; wants consideration of hazardous waste which could be moved over our streets if they were wider Leon Lewis, 11615 W 35th Ave , addressed what widening would to to his home Ida Lewis, 11615 W 35th Ave, concurs with previous speaker; stated a street light is needed at 32nd & Swadley, instead of widening the streets Motion by Mr FIasco that in view of the overwhelming public feeling in this matter, the street committee recommendations as set forth in their memorandum of August 20, 1985, be adopted, and the standards set out by staff be tabled indefinitely; seconded by Mr West Discussion followed Motion was temporarily withdrawn so people who signed up and wanted to speak could do so CITY COUNCIl INUTf August 26, 1985 Page -3- Louise Turner, presented petition with 83 names in opposition to 38th Avenue West of Wadsworth; 52 names opposing the standards in general, especially as they apply to Dover Street and Dudley Street; 84 names objecting to the street proposals in general would make suggestion on 38th Avenue to look at recent development done by Ficco's rlice drainage swails which would carry far more water than curb & gutters, and are far more ascetic Harold Lynch, addressed 32nd Ave and wants a poll taken of those people in that area that use 32nd Ave Dougal Graham, 3330 Chase, stated citizens are afraid of Council because too often they have had bait and switch; populace has affection for Comprehensive Plan; read preamble to Comprehensive Plan; what is done to streets is defacto zoning Janice Thompson, 12290 W 42nd Ave , addressed Ward Road intersection; owes to each and every resident a moratorium on any building until decision is made if Kipling & Ward Road will connect Linda Slater, 3501 Parfet, addressed 35th West of Parfet extension; doesn't know they would want to increase traffic next to schools Michael Hartland, 25 Skyline Drive, recently moved back to this area; also addressed 32nd Avenue Luther promwell, 3383 Simms, called Wheat Ridge specifically on whether the City was preparing to go across Lena Gulch before they bought home and was told they will not; street will not handle more traffic on Simms Robert Biddinger, 3840 Estes, trusts the Council that they will do what is right for the citizens; favors widening 38th Ave somewhat Linda Swanson, 3982 Rolf Court, addressed money; the workover of her street (chip & seal) was done because the City couldn't afford to pave the street; if we can't afford to pave, how can we afford this Wilda McLendon, 4310 Dover, is concerned about 41st & Dover; what about children walking to and from Wilmore Davis school; how could 41st be considered a major collector when there is a school Art Gurrero, 11675 W 35th Ave , stated his street is being done for a second time because it didn't take the first time; asked about crime being more prevalent with wider streets Ruth Kahre, 9020 W 32nd Ave , consider population projection by DRCOG; there is no need for wider streets Vivian Waterman, not a resident of Wheat Ridge, asyed to give consideration & attention to 44th & Youngfield to benefit the people ln Fairmont CITY COUNCIL"-'f'JINUTlc..,,-:- Augus t 26, 1985 - Page -4- Mr Flasco's motion and second were put back on table Discussion followed Mrs Snow amended the motion that the Comprehensive Plan show Simms as a local street instead of a collector street; seconded by Mr West; carried 7-0 Motion by ~1rs Snow to add to 4 in street committee recommendations "without going through the residential neighborhood"; seconded by Mrs Keller Discussion Mr Hobbs called for the question; seconded by Mr West; carried 6-1 with Mrs Keller voting No Vote on question failed 3-4 with Councilmembers West, Keller, and Snow voting yes Motion by Mr Merkl to delete Item 5 of Street Committee recommendation Motion died for lack of second Motion by Mr Hobbs to change c of Item 1 leaving local as a width of 50 or 40 ft ; seconded by Mr West; failed 2-5 with Mr West & Mr Hobbs voting yes Vote on motion as amended carried 7-0 Motion by Mr FIasco to have a study on Ward Road & Young field area, and have it on a Study Session in 90 days Planning Department and Public Works do the study and have a Public Hearing with area residents before it comes in on Study Session; seconded by Mr Hobbs; carried 7-0 ORDINANCES ON FIRST READING Item 2 Council Bill 202 - An Ordinance providing for the approval of rezoning from Restricted Commercial (R-C) to Planned Commercial Development (PCD) and approval of an Outline and Final Development plan and Plat on Real Property located at 7615 and 7777 West 38th Avenue and 3825-35 Wadsworth Blvd (aka Wilmore Nursery) (Case No WZ-85-18) (LVW Investment Company and The Charles S Golding Company) Council Bill 202 was introduced by Mrs Keller on first reading; title read by Clerk; Motion by Mrs Keller that Council Bill 202 be approved on first reading, ordered published, public hearing be set for Monday, September 23, 1985 at 7 30 P m in City Council Chambers, Municipal Bldg , and if approved on second reading, take effect 15 days after final publication; seconded by Mr Hobbs; carried 7-0 Item 3 Council Bill 203 - An Ordinance amending Section 20 C , Planned Commercial Development District, General Regulations, of Appendix A of the Code of Laws of the City of Wheat Ridge Council Bill 203 was introduced by Mrs Snow on first reading; title read by Clerk; Motion by Mrs Snow that Council Bill 203 be approved on first reading, ordered published, public hearing be set for Monday, September 23, 1985 at 7 30 P m in City Council Chambers, Municipal Bldg , and if approved on second reading, take effect 15 days after final publication; seconded by Mr Hobbs carried 7-0 CITY COUNCIL-1'1INUTE~:- August 26, 1985 Page -5- DECISIONS, RESOLUTIONS, AND MOTIONS Item 4 Motion by Mr Hobbs that the payment for the 1984 Audit of the Workman's Compensation Insurance be approved in the amount of $lO,363 00, and charged to Account No Ol-610-62l; seconded by Mrs Snow; carried 7-0 Item 5 Motion to accept the appraisal for the Davis Property Motion by Mr Wilde to accept the appraisal, but not to purchase the property; seconded by Mr Snow; carried 7-0 CITY ADMINISTRATOR'S MATTERS ~1r Palmer informed Council that bids to clean up the Davis property will be opened on September 6, 1985 CITY ATTORNEY'S MATTERS John Hayes addressed a letter he received from City of Northglenn regarding taxation of motor fuel Northglenn asks for support What does Council want? Discussion followed Motion by Mrs Snow to have Northglenn officials and attorney for their comments on the October Study Session; seconded by Mr Merkl; carried 7-0 Mr Hayes stated he has prepared 3 Ordinances; wants comments--if there are none, Ordinances will be on first reading on 9/9/85 He presented a request for help on Mountain Bell and AT&T at the City attorneys' luncheon All other City Attorneys said "go get 'em Tiger!" Some items regarding 35th & Allison need to be cleared up At Executive Session Council agreed to pay $1,000 each to Mr & Mrs Lundy and Mrs Simon, for a total of $2,000 We need a motion for payment Motion by Mr West to approve payment; seconded by Mr Hobbs; carried 7-0 A change was made on C B 192 from first to second line got left out of ordinance; needs approval of Council to do some administrative work Motion by Mrs Snow for approval; seconded by Mr Hobbs carried 7-0 Mr Hayes request Executive Session under Section 5 7(b)(1)(3) and 5 7(b)(3) regarding Lena Gulch Motion by Mrs Keller to hold Executive Session; seconded by Mr Flasco; carried 7-0 ELECTED OFFICIALS' MATTERS Mrs Keller stated that a doctor in her district requests a smoking ordinance similar to Boulder's and other cities Motion by Mrs Keller that this be on October Study Session; seconded by Mr Wilde; carried 6-l with Mr Merkl voting No CITY COUNCI IINUTE August 26, 1985 Page -6- Mr Merkl asked Mr ln Panorama Park to bid Palmer about the terrible condition of tennis courts Mr Palmer stated the tennis courts renovation is out Mr Flasco addressed Congress of Local Governments session for local officials only regarding transportation charge for it is $100 for entity and $16 00 for individual on September 28, 1985 You are allowed to listen but not to talk Motion by ~1r Flasco to have those of Council who want to be allowed to attend and the Mayor make reservations; seconded by Mrs Snow; carried 7-0 He also asked for a report on contract--will it be finished are going to be finished Mr Mountain Bell 44th Ave on time; Minetor since we awarded the wants report on exactly when stated we are waiting for we Motion by Mrs Snow to give the City Attorney the authority to file an injunction against Mountain Bell; seconded by Mr Merkl; carried 7-0 Mr Wilde reminded Council of Liquor Hearing on August 29 at 7 00 p m Motion by Mrs Snow to postpone this hearing until a later date because there won't be a quorum Mr Hobbs addressed the handouts Mrs Snow sent to her District and had copied at City Council budget's expense Should Council pay for her handouts? Mrs Snow stated, yes, this was for her constituents to have input on City business Mr West moved for adjournment after Executive Session lack of second ~1otion died for Mrs Snow addressed Federal Grants going to large cities instead of smaller cities Moves that small cities get together to change standards for Urban Systems money; seconded by Mr Merkl; carried 7-0 Mayor Stites addressed expenditures of council funds followed Discussion Motion by Mrs Snow to adjourn after Executive Session; seconded by Mr West; carried 5-2 with Mr Merkl and Mr Flasco voting No EXECUTIVE SESSION WAS HELD Meeting adjourned at 11 35 P m 1 ~L){clk cJu/Z?
