HomeMy WebLinkAbout12/09/1985 CITY COUNCIL MINUTES CITY OF WHEAT RIDGE, COLORADO DECEMBER 9, 1985 The City Council Meeting was called to order by the Mayor at 7 30 P m Councilmembers present Kent Davis, Tony Flasco, Rod Johnson, Moe Keller, Randy West Larry Merkl, Doris Ibbison, and Claudia Worth were attending a conference in Seattle Also present City Clerk, Wanda Sang; City Admi.nistrator, Tom Palmer; City Attorney, John Hayes; Director of Community Development, Charles Stromberg; Director of Parks, Richard Bredt; Police Commander, Ed Ray; staff and interested citizens APPROVAL OF MINUTES Motion by Mr West for the approval of the Minutes of November 25, 1985; seconded by Mr FIasco; carried 5-0 PROCLAMATIONS OR CEREMONIES Mayor Stites and Commander Ed Ray presented PPA Award to Shantelle McCune (two years old) for her actions on November 27, 1985, in calling for assistance for her baby sitter who had fallen and knocked himself unconscious CITIZENS' RIGHTS TO SPEAK There was no one present to speak PUBLIC HEARINGS AND ORDINANCES ON SECOND READING Item 1 A Council Bill 216 - An Ordinance providing for the approval of rezoning from Agricultural-One to Restricted Commercial on land located at the northeast corner of Miller Street and West 44th Avenue, City of Wheat Ridge, County of Jefferson, State of Colorado B An application by Richard Garramone for approval of a consolidation plat for property located at the northeast corner of West 44th Avenue and Miller Street Motion by ~1r Davis to continue this item until December 16, 1985 at the request of the applicant; seconded by Mr FIasco; carried 5-0 CITY COUNCIL MINUTES Item 2 December 9, 1985 Page -2- Council Bill 217 - An Ordinance repealing and reenacting Section 21-21 and Section 21-23 of Chapter 21, Article II of the Code of the City of Wheat Ridge, Colorado, pertaining to Taxation of Telephone Exchanges Council Bill 217 was introduced on second readj.ng by ~1rs Keller; tj,tle read by the Clerk Ordinance 643 was assigned Motion by Mrs Keller for the adoption of Ordinance 643 and to raise franchise fee to $121,000.00; seconded by Mr West; carried 5-0 Item 3 Council Bill 218 - An Ordinance authorizing the Jefferson County Emergency Telephone Service Authority Board to establish an E9l1 Service User Charge of up to and including forty cents per telephone service subscriber line Council Bill 218 was introduced on second reading by Mrs Keller; title read by the Clerk Present and sworn in by the Mayor was Will Burt, 12250 W 35th Avenue, and Commander Ed Ray, of the Wheat Ridge Police Department, who explained the Ordinance Discussion followed Motion by Mrs Keller for the adoption of Ordinance 644; seconded by Mr Davis Mr FIasco stated that he will be voting No, because he thinks it is a little premature, you can't use the money for a year, and also that he objects to giving a blank check to anybody (Mr Merkl, Mrs Ibbison, and Mrs Worth had left sealed votes ) Motion carried 7-1 with Mr Flasco voting No Item 4 Council Bill 219 - An Ordinance to dispose of a municipally owned property by accepting the highest stated bid, which bid will, if awarded, result in the sale of unimproved property owned by the City of Wheat Ridge, located at the southwest corner of West 38th Avenue and Depew, which parcel i.s approximately 7,109 5 square feet Council Bill 219 was introduced on second reading by Mr Davis; title read by the Clerk. Ordinance 645 was assigned Motion by Mr FIasco for the adoption of Ordinance 645; seconded by Mr West; (Mr Merkl, Mrs Ibbison, and Mrs Worth had left sealed votes ) carried 8-0 Item 5 ORDINANCES ON FIRST READING (NO PUBLIC TESTIMONY) Council Bill 222 - An Ordinance vacat i.ng a portion of Owens Street in the Bickley Subdivision within the City of Wheat Ridge, County of Jefferson, State of Colorado Council Bill 222 was introduced on first reading by Mr Davis; title read by the Clerk Motion by Mr Davis that Council Bill 222 be approved on first reading, ordered published, public hearing be set for Honday, January 13, 1986 at 7 30 P m in Ci,ty Council Chambers, Municipal Bldg , and if approved on second reading, take effect 1 day after final publication; seconded by Mr West; (Mrs Worth had left a sealed vote ) carried 6-0 CITY COUNCIL MINUTES December 9, 1985 Page -3- Item 6 Council Bill 223 - An Ordinance repealing and reenacti.ng, with amendments, Chapter 21, Taxation, Article 1, Retail Sales, of the Code of Laws of the City of Wheat Ridge Council Bill 223 was introduced on first reading by Mr Flasco; title read by the Clerk Motion by Mr FIasco that Council Bill 223 be approved on first reading, ordered published, public hearing be set for Honday, January 13, 1986 at 7 30 P m in the City Council Chambers, Municipal Bldg , and if approved on second reading, take effect 15 days after final publication; seconded by Mrs Keller Mr Hayes stated that there were two typo errors that were corrected Makes a substantive change Section 21-9A-9th line-end of first sentence- proposes adding the following sentence "This 2% vendors fee is disallowed on any delinquent report Motion by Mr FIasco to accept changes; seconded by Mr West; (Mrs Worth had left a sealed vote ) carried 6-0 DECISIONS, RESOLUTIONS, AND MOTIONS Item 7 Resolution 965 - authorizing reimbursement from City of Wheat Ridge's attributable share of the Jefferson County Open Space Fund for Parks and Open Space Development Motion by Hr Johnson; (Mr carried 8-0 FIasco that Resolution 965 be adopted; seconded by Hr Merkl, Mrs Ibbison, and Mrs Worth left sealed votes Item 8 Resolution 966 - approving and authorizing support for maintaining the Desi.gnation of the Denver Regional Council of Governments (DRCOG) as the Area Agency on Aging (AAA) Motion by Mr FIasco that Resolution 966 be adopted; seconded by Hr West; (Mr Merkl, Mrs Ibbison, and Mrs Worth left sealed votes) carried 8-0 Item 9 Motion by Mr FIasco for the approval that the Mayor be authorized to sign the contract with Employee Assistance Programs, Inc ; seconded by Hrs Keller; (Mr Merkl, Mrs Ibbison, and Mrs Worth left sealed votes ) carried 8-0 CITY ADMINISTRATOR'S MATTERS Mr Palmer addressed Hazardous Route Designation and stated that Mrs Worth asked to have this item placed on the January Study Session Mrs Keller asked that it be put on the December 16 Agenda Consensus to put Resolution on December 16 Agenda was 5-0 CITY COUNCIL MINUTh~~ December 9, 1985 Page -4- CITY ATTORNEY'S MATTERS John Hayes addressed the Rocky Mountain News report titled "Don't pass laws you won't enforce" Mr Hayes also addressed letters of apology he wrote to l8 past and present Council Members The letter was read into the record ELECTED OFFICIALS' MATTERS Mrs Sang addressed the January 28 Jeffco Goverment Meeting that Wheat Ridge will be hosting at the Applewood Inn Jefferson High Choir will perform Rod Johnson addressed a conversation between himself and Quality Inn on truck parking Ordinance Present and sworn in by the Mayor was Mr Spangler, 8179 W 81st Drive, Arvada, representing Quality Inn He gave an outline of truck parking at his place of business Mr Hayes suggested a Special Use Permit be obtained through the Planning Commission Motion by Mr Davis to allow staff to double advertising for Planning Commission and City Council meetings; seconded by Mr Johnson Mr FIasco stated that he will be voting No because he has a problem with other Motels Motion carried 3-2 with Mr FIasco and Mr West voting No Mr Davis stated that he doesn't feel that John Hayes owes anyone an apology Mr West stated that he agreed with Mr Davis on Mr addressed a post card type stationary in addi tion to a envelope Hayes, and formal letter & Mr FIasco stated that he also agrees with Mr letters of apology He asked Mr Palmer about without Certificate of Occupancy Mr Palmer been cited and will face Municipal Court Mr pamphlet from DRCOG Davis on Mr Hayes' people living in house stated that they have FIasco addressed the ADJOURNMENT Motion by Mrs Keller to adjourn; seconded by ~1r Johnson carried 5-0 Meeting adjourned at 9 25 P m 7 / APPROVED ay CITY COUNCIL ON DECENBER 16, 1985 BY A VOTE OF ~ TO () :l:~;/ A, ,~j Kent Davis, Council President
