CITY OF WHEAT RIDGE, COLORADO
September 28, 1987
The City Council Meeting was called to order by the Mayor at 7 30 p m
Councilmembers present Tony Fiasco, Doris Ibbison, Rod Johnson, Larry
Merkl, Moe Keller, Randy west, and Claudia ~orth Kent Davis was
absent Also present City Clerk, wanda Sang, City Administrator, Mike
Smith, City Attorney, John hayes, Chief of Police, Howard Jaquay,
Director of Parks, Richard bredt, staff and interested citizens
APPROVAL OF MINUTES of September 14, 19b7
Motion by Mrs Ibbison for the approval of the Minutes of September 14,
1987, seconded by Mrs Worth, carried 7-0

LOCAL LIQUOR LICENSING AUTHORITY MATTERS
Item 1. Application for Change of Corporate Officers for Caravan West,
Inc , dba Caravan West, 11221 W 44th Avenue, Wheat Ridbe
Applicant David Case, 9728 Milwaukee Ct , Golden, was present and sworn
in by the Mayor Motion by Mrs Worth to approve the Change of
Corporate Officers for Caravan West, Inc , dba Caravan west, 11221 West
44th Avenue, Wheat Ridge The new corporate officers will be President,
David H Case, Treasurer, Betty Lee Channel This is a Class T, Tavern
Liquor License with extended hours, seconded by Mrs Keller, carried

Meredith Heckert presented the case Present and sworn in by the Mayor
was Henry Battjes, engineering representative, who gave presentation
regarding the development

Sworn in by the Mayor were the following
Clement D. Bisant, 2980 Newland, who approved the plan and would like to
seeit go forward.
Rick Concalves, 4474 Brentwood, Engineer for City of Edgewater, who
concurs with Wheat Ridge City staff that if the plan goes forward the
drainage will not be a problem
Ron Selstad, 2890 Lamar, who favors development, but wants modification,
concerns included chemical residues from when greenhouses were on the
property, paving and hard surfaces at an R-1 site
Lillian Flem~, 63b3 W 29th Avenue, who suggested [uoving building 6
feet to the rear and to change parking area, plan for beautification in
an h-1 area
Dorothy Thompson, 3014 Chase Street, wrlO statea she does not oppose
plan, but has the sallie concerns as Mrs Fleming
Dougal Grahau" 3330 Chase, who seconded the suggestions of previous
speakers
Discussion followed
Consensus was 7-0 for a fact finding session
Motion by Mr Johnson that Case No MS-87-2, a request for approval of a
consolidation plat and for approval of a waiver to portions of Section
27 1, be approved in accordance with Exhibit "D" for the following
reasons 1 All requirements of the Subdivision Regulations have been
met 2 All minimum requirements of Section 4 of the Zoning Ordinance
have been met 3 Staff and Planning Commission recommend approval
With the following conditions 1 That there be a six foot solid fence
and a 15 foot strip of landscaping along the eastern property line 2
The westerly drive and curb cut be paved or it be landscaped if the
western cut is not desired 3 The applicant enter into a reciprocal
joint parking agreement with the City for overflow parking from Stites
Park 4 That the front parking be modified to allow for compact cars
ana difference in parking lot size be allocated to landscaping, seconded

Council Bill 311 was intrOduced on second reading by Mrs Worth, title
read by the Clerk, Ordinance No 729 assigned Meredith Heckert
presented the case Applicant Reed Becerra and his attorney George
Holle~ were present and sworn in by the Mayor

Mr Holley explained that they are not planning on applying for a
package liquor store license, but a 3 2% Beer Retail liquor license
Discussion followed
Motion by Mrs Worth that Council Bill 311 (Ordinance 729) be approved
for the following reasons 1 Commercial-One zoning would be
compatible with adjacent zoning and land use 2 The request is in
conformance with the Comprehensive Plan and the Fruitdale Valley master
plan 3 It will correct a nonconforming situation With the
following condition 1 Future site plan approval be required with any
building expansion or redevelopment, seconded by Mrs Ibbison, carried

rezoning from Restricted-Commercial and COllimercial-Une to
Commercial-One on land located at 9160 West 44th Avenue, City
of Wheat Ridge, County of Jefferson, State of Colorado
(Case No WZ-87-8) (Anthony Perko)
Council Bill 312 was introduced on second reading by Mr Merkl, title
read by the Clerk, Ordinance No 730 assigned Meredith Reckert
presented the case Anthony Perko, 99~1 City View Drive, Morrison,
owner of the property, was present and sworn in
Motion by Mr Merkl that Council Bill 31~ (Ordinance 730) be approved
for the following reasons 1 The property is within the City of Wheat
Ridge, and all notification and posting requirements have been met 2
It is compatible with the land use on the north, east and west, and with
land use to the south if appropriate screening is provided 3 It is
in conformance with the Commercial Activity Center designation on the
Comprehensive Plan With the following condition 1 A 6 foot high
screening fence be built on southern property line and if outside
storage is to be used, that the east and west sides also be screened,
seconded by [vjr West, carried 7-0

Council Bill 313 was introduced on second reading by Mrs Ibbison, title
read by the Clerk, Ordinance No 731 assigned Meredith Reckert
presented the case Present and sworn in by the Mayor was applicant

Motion by Mrs Ibbison that Council Bill 313 (Ordinance 731) be approved
for the following reasons 1 The proposal is in cunformance with the
Comprehensive Plan 2 It will be compatible with adjacent land use if
proper buffering design elements are utilized 3 Staff and Planning
Commission recommend approval With the following conditions 1 no
parking, exterior lighting or mechanical equipment be allowed on the
south and east sides of the site 2 That visual buffering landsca~ing
barrier be constructed along the east side of the site, seconded by Mr
West, carried 7-0

Center Urban Renewal Plan
Motion by Mr Johnson that the public hearinbS on Cases WPA-87-3 and
URP-87-1 be continued until October 12, 1987, seconded by Mr West,
carried 7-0

Motion by Mr Johnson that Council Bill 316 be approved on first
reading, ordered published, public hearing be set for Monday, October
12, 1987 at 7 30 p m in City Council Chambers, Municipal Bldg , and if

DECISIONS, RESOLUTIONS, AND MOTIONS
Item-12. Resolution 1052 - authorizing the City of wheat Ridge to enter
into an Intergovernmental Agreement with the County of
Jefferson in order to provide for the performance of certain
duties by the County Clerk
Resolution 1052 was introduced on second reading by Mr Flasco, title
read by the Clerk
Motion by Mr Flasco to approve Resolution 1052, which authorizes the
Mayor to sign the Intergovernmental Agreement between the City of Wheat
Ridge and the County of Jefferson to provide for the performance of
certain duties by the County Clerk, seconded by Mr West, carried 7-0
Ite~-11~ Motion to approve the Judges for Municipal Election, Payment
to Judges, and Polling Places
Motion by Mrs lbbison to approve any of the Judges on the attached list
as available and determined by the County and the City Clerk In the
past we have used 4 judges for each precinct, so we need a total of 32
judges Payment of $65 be made to each regular judge, $70 to each
supply Judge (no mileage) The following locations are to be used as
polling places

CITY ADMINISTRATOR MATTERS
Mike Smith told Council they need to set another budget session to wrap
up the budget
CITY ATTORNEY'S MATTERS
John Hayes stated it is essential that an Ordinance for pay schedules
for Elected Officials be brought in on October 12, with Public Hearing
on October 26, and to give him figures for this Ordinance
Motion by Mr Merkl that figures stay the same, seconded by Mr Johnson,
carried 7-0
John Hayes addressed the Rock property--it has not been acquired because
of resolution of a quiet title action, that has been resolved and
Rock property is available, subject to a current appraisal

Motion by Mr Merkl to move the October 5 Study Session to October 19
for meeting with Financial Advisory Committee, seconded by Mrs Keller,
carried 4-3 with Councilmembers Johnson, West, and Flasco voting No

Claudia Worth has been approached by some very upset neighbors living in
the vicinity of the truck stop, asked where we are on that Mr Hayes
stated that he received a call from the attorney for the property owner,
who indicated that both the letter we requestea and proposal to do
something with the land was forthcoming Also, on Friday, Mrs Keller
gave him information that the manager of the truck stop had been in
contact with owner of property who wanted hinl to police that area,
which the manager is very willing to do She asked Chief Jaquay about
the enforcement of the Parking Ordinance
