HomeMy WebLinkAbout01/25/1988 CITY COUNCIL MINUTES CITY OF WHEAT RIDGE, COLORADO January 2~988 The City Council Meetinb was called to order by the Mayor at 7 30 p m Councilmembers present Kent Davis, Tony FIasco, Doris Ibbison, Larry Merkl, Moe Keller, Nancy Snow, Randy West, and Claudia Worth Also present City Clerk, Wanda Sang, City Administrator, Mike Smith, City Attorney, John Hayes, Public Works Director, Ric Minetor, staff, and interested citizens PROCLAMATIONS OR CEREMONIES Mayor Wilde read Proclamation into the record for Wheat Ridge High School Symphony Winds Month - March, 1988 They will perform at Carnegie Hall in March Terry McEwen, director, was present to accept the proclamation APPROVAL OF MINUTES of January 11, 1988 Motion by Mrs Ibbison for the approval of the Minutes of January 11, 1988, seconded by Mr West, carried 8-0 CITIZENS' RIGHTS TO SPEAK Terry McEwen, Eric Daniel, Cindy West, and Mike Durel, all of the Wheat Ridge High School Symphony Band, relayed their commitment to the community, and thanked Council for their contribution Lou Ficco, 11315 W 38th Avenue, spoke regarding the Applewood Shopping Center, doesn't feel the City should subsidize a development, all sales tax should go into General Fund Tony Ficco, 12425 W 38th Avenue, reiterated Lou Ficco's opinions Louise Turner, 11256 W money back to shopping speakers 38th Avenue, doesn't feel putting that amount of center is logical, agrees with the previous two Martha Shacklett, 3592 Simms, is upset about an article in the Sentinel regarding subsidizing the Applewood Shopping Center LOCAL LIQUOR LICENSING AUTHORITY MATTERS Item 1 Application for a new Class J-1 - 3 2% Beer License for Metru Oil Company, dba Vicker's #2349, located at 6601 W. 44th Avenue, Wheat Ridge, Colorado Present and sworn in by the Mayor were John Stonebreaker, 700 E Speer Blvd, representing the applicant, Max Scott, Oedipus, Inc , explained petition prucess, Louis Auerbach, Regional Merchandise Manager, 10647 W Chitaguie Mt , Littleton, Helen Cordovano, 6505 W 45th Ave, Robert ~den, 6505 W 45th Avenue:-Gary-MCGee:-6437 W 44th Place, John Alcamo, 4365 Otis, all spoke in favor of the application CITY COUNCIL MINUTES January 25, 1988 Page -2- There was a question an8 answer period Motion by Mr Merkl for an Executive Se~sion for fact finding, seconde8 by Mrs Worth, carried 8-0 Motion by Mrs Snow to approve the application for a new J-1 3 2% Beer Retail License from Metro Oil Company, dba Vicker's #2349, 6601 W 44th Avenue, Wheat Ri8ge, for the following reasons (1) All applications and fees required by statute have been filed an8 paid, (2) Notice of hearing and posting of the premises have been accomplished according to statutory requirements, (3) The applicant is entitled to occupancy uf the premises by virtue of a signed lease agreement dated 11/10/87 (4) The officers and directors of Metro Oil Company have been investigated and cleared by the FBI and CBI (5) The evi8ence a8duced at the Public Hearing on January 25, 1988 established that the desires of the residents of the neighborho08 under consideration are for granting this license, as evidenced by petitions bearing 66 signatures in favor of issuance 20 signatures in opposition, and 14 signatures evi8encing no opinion, and a liquor survey that ~hows 188 signatures in favor, and 81 opposed And an ad8itional comment--no one needs beer, cigarettes, or lottery tickets either, but if you go with the free enterprise system, I believe this company, Vickers, has a right to compete and the neighbors have a right to state their 8esire for a liquor license at that location, seconded by Mr Davis, carried 8-0 Item~~ Application for a new Class J-1 - 3 2% Beer License for Metro Oil Company, dba Vicker's #2358, located at 12300 W 44th Avenue, Wheat Ridge, Colorado John Stonebreaker again acted as representative for Vickers Speaking in favor and sworn in by the Mayor was Julie Ward, 11673 W 44th Avenue, #2 The Wheat Ridge surveyor, Jordan Mencher, was present and answered Council's questions Motion by Mr Davis to approve the application for a new J-1 3 2% Beer Retail License from Metro Oil Company, dba Vicker's #2358, 12300 W 44th Avenue, Wheat Ri8ge, for the following reasons (1) All applications and fees required by statute have been filed and paid, (2) Notice of hearing and posting of the premises have been accomplished according to statutory requirements, (3) The applicant is entitled to occupancy of the premises by virtue of a signed lease agreement dated 11/10/87 (4) The officers and directors of Metro Oil Company have been investigated an8 cleared by the FBI and CBI (5) The evidence adduced at the Public Hearing on January 25, 1988 established that the desires of the residents of the neighborhood under consi8eration are for granting this license, as evidenced by petitions bearing CITY COUNCIL MINUTES January 25, 1988 Page -3- 48 signatures in favor of issuance 41 signatures in opposition, and 11 signatures evidencing no opinion, also that the Oedipus results on the survey show 175 signatures in favor of issuance and 95 signatures opposing, and that issuance of this license is consistent with the neeas of the neighborhood under consideration, seconded by Mr Flasco, carried 8-0 Item }. Application for a Special Events Permit from Sts Peter and Paul Church Marian Jordan, 4095 Jay Street, was present and answered questions Motion by Mr Merkl to approve the Special Events Permit for Sts Peter and Paul Church, at the location of 3900-3920 Pierce Street, Wheat Ridge, to dispense malt, vinous and spirituous liquor un February 13, 1988 between the hours of 7 00 p m and 12 00 midnight in the ~chool gym, seconded by Mr Flasco, carried 8-0 PUBLIC HEARINGS AND ORDINANCES ON SECOND READING Item 4. Council Bill 327 - An Ordinance amending Section 5-94 1 Public Improvements Required of the Code of Laws of the City of Wheat Ridge by exempting streets de~ignated as "Exempt Local Streets" from the provisions of said Section 5-94 1 Council Bill 327 was introduced on second reading by Mr West, title read by the Clerk, Ordinance No 743 assigned Motion by Mr West for the approval of Council Bill 327 (Ordinance No 743) on second reading, seconded by Mrs Worth Mr FIasco will vote No, because certain streets will never have curb, gutter, and sidewalk, thinks it's a dangerous precedent to set this in writing and establish another classification Motion carried 7-1 with Mr Flasco voting No Ite~~ Snow and Ice Control Policy Public Input and Discussion Mayor Wilde made the opening remarks on this item Ric Minetor, Director of Public Works, stated that he believes the costs do not justify major changes to our current policy He would recommend that we adopt a snow emergency ordinance which would include a prohibition of parking along designated routes as well as towing offenders He would also recommend parking restrictions subsequent to a major storm to facilitate plowing of side streets In addition he feels that we should include in our policy a statement that all ~treet~ will be plowed if the snowfall is greater than 12 inches, and that side streets will not be plowed if there is less than 12 inches of snowfall This will remove any ambiguity as to when the street~ will be plowed He feels the council needs to determine if there is significant support for a sidewalk clearing ordinance Lee Greg~, 3645 Marshall Street, thinks the City did a good job clearing the snow, addressed storm drainage Ted Kush, 4000 Newman, would like to see City contract out snow removal and assess everyone in City at end of year for that removal CITY COUNICL MINUTES January 25, 1988 Page -4- Martha Shacklett, 3592 Simms, spoke regarding the removal of slush on her street Louise Turner, 11256 W 38th Avenue, stated she saw nothing wrong with snow policy, but it depends when you start and when you finish, she was interested in the $150,000 figure Don Lancaster, 4076 Everett, complimented Ric and City on the good job they did, feels there should be some way to handle the bus stop Dorothy Thompson, thanked City for plowing her street Clerk read a letter from Ron Webber into the record from Helen and Ray Willis, 7465 W 48th Circle, into Ibbison read letter from Mr Kemper into the record Ray Carlyle answered questions on speed of plows and of street Mrs Worth suggested the City people to clean sidewalks for depth, sidewalks, snow route, clear snow Mayor read letter the record Mrs plowing to middle look into using Community Corrections Senior Citizens Discussion included snow 4-wheel drive, parks department helping ORDINANCES ON FIRST READING Item 6. Council Bill 330 - An Ordinance providing for the approval of rezoning from Residential-Three (R-3) to Planned Commercial Development (PCD) and for approval of an Outline Development Plan on land located at approximately 3790 Wadsworth Boulevard, City of ~heat Ridge, County of Jefferson, State of Colorado (Case No WZ-87-15) (Ralph A Brienza) Council Bill 330 was intruduced by Mr Davis on first reading, title read by Clerk Motion by Mr Davis that Council Bill 330 be approved on first reading, ordered published, publiC hearing be set for Monday, February 22, 1988 at 7 30 p m in City Council Chambers, Municipal Bldg , and if approved on second reading, take effect 15 days after final publication, seconded by Mr Merkl, carried 8-0 DECISIONS, RESOLUTIONS, AND MOTIONS Item 7. Motion by Mrs Worth that $160,550 be paid to CIRSA/WC for the City's 1988 pool contribution to be charged to Account #01-610-621, seconded by Mr West, carried 6-2 with Councilmembers FIasco and Davis voting NO Item 8. Motion for approval of the proposed revision to the Wheat Ridge Planning Commission By-Laws, relating to Petitions Motion by Mr Flasco to place this on the March 7 Study Session and to review all Boards and Commi~sions, seconded by Mr West, carried 6-2 with Mrs Worth and Mrs Snow voting No CITY ADMINISTRATOR'S MATTERS Mike Smith informed Council that, in compliance with their request made in January, on Monday, February 1, 6 30 pm, the Police Department will present a review of the STEP program--the purpose and how it will be implemented CITY COUNICL MINUTES January 25, 1988 Page -5- Motion by Mr Merkl that the City Council, City Administrator, and Department Heads have a discussion prior to that review at 5 30 pm, seconded by Mr West, carried 5-3 with Councilmembers Flasco, Keller, and Snow voting NO CITY ATTORNEY'S MATTERS John Hayes informed Council that a trial has been sCheduled for June 21, 1988 regarding the complaint filed by Sgt Goracke Negotiations for EDARC have resumed, there was a meeting with Ross/Trammel/Crow last Friday, will meet again this week ELECTED OFFICIALS' MATTERS Nancy Snow addressed House Bill 1006 (Water Bill) Motion by Mrs Snow that the City of Wheat Ridge pass a Resolution in favor of House Bill 1006 and send it to legislators, seconded by Mr West, carried 7-1 with Mr FIasco voting NO Motion by Mrs Snow to cancel the April 4 Study Session because of Democratic and Republican Caucuses that night, ~econded by Mr West, carried 8-0 Larry Merkl stated that the CML policy committee will meet February 5, asked Council if they would let him know if they want him to have any input on it Mrs Snow questioned bill that all City Clerk's provide absentee ballots in braille Moe Keller asked Mr Smith about an informational letter sent to property owners affected by Urban Renewal, keeping them informed as to how negotiations are going, has that been sent?
