HomeMy WebLinkAbout07/11/1988 CITY COUNCIL MINUTES CITY OF WHEAT RIDGE, COLORADO July 11, 1988 The City Council Meeting was called to order by the Mayor at 7 30 p m Councilmember~ present Kent Davi~, Tony Flasco, Doris Ibbi~on, Larry Merkl, Moe Keller, and Randy West Claudia Worth wa~ absent Nancy Snow arrived at 7 35 p m Also present Deputy City Clerk, Chri~ta Jones, City Administrator, Mike Smith, City Attorney, John Hayes, Director of Planning and Development, Glen Gidley, and interested citizens APPROVAL OF MINUTES of June 27, 1988 Motion by Mrs Keller for the approval of the Minutes of June 27, 1988, seconded by Mr Davis, carried 5-0 with Mr FIasco ab~taining since he had not attended the meeting CITIZENS' RIGHTS TO SPEAK There was no one present to speak --- LOCAL LIQUOR LICENSING AUTHORITY MATTERS Item 1. Application for a new Cla~s G - Hotel & Restaurant Liquor Licen~e, for Patzcuaro, Inc , dba Re~taurant Taqueria Patzcuaro, 7000 W 38th Avenue, Wheat Ridge, Colorado Applicants Judy Almanza and Francisco Almanza, 8210 Ingalls Circle, Arvada, were present and sworn in by the Mayor Mrs Ibbison a~ked that they attend the City Clerk's Liquor Seminar Motion by Mrs Keller to approve the application for a new Clas~ G _ Hotel & Restaurant Liquor License with extended hours for Patzcuaro, Inc , dba Taqueria Patzcuaro, 7000 W 38th Avenue, Wheat Ridge, Colorado for the following reasons 1) All applications and fees required by statute have been filed and paid, 2) Notice of hearing and posting of the premises have been accompli~hed according to statutory requirements, 3) The applicant will be entitled to occupancy of the premises by virtue of a signed lea~e dated June 1, 1988, 4) The officers of the corporation have been shown by investigation to be of good moral character, 5) and that i~suance of this licen~e is consistent with the needs of the neighborhood under consideration, seconded by Mr Flasco, carried 6-0 Item 2 Application for a new Class F - Beer and Wine License, for Ingrid Hunt, dba Alpen Haus Cafe & Sandwich Shop, located at 4980 Kipling Street, #12, Wheat Ridge, Colorado Applicant Ingrid Hunt, 6608 Cole Ct , Arvada, was present and sworn in by the Mayor Mrs Ibbison a~ked that Mr~ Hunt attend the City Clerk'~ Liquor Seminar CITY COUNCIL MINUTES July 11, 1988 Page -2- Motion by Mr We~t to approve the application for a new Cla~s F - Beer & Wine lioense for Ingrid Hunt, ~ba Alpen Hau~ Cafe & Sandwioh Shop, 4980 Kipling Street, #12, Wheat Ridge, for the following reason~ 1) All applioation~ and fees required by ~tatute have been file~ and paid, 2) Notioe of hearing and posting of the premise~ have been aooomplished aocording to statutory requirement~, 3) The applicant will be entitled to oocupanoy of the premi~es by virtue of a signed lea~e dated Ootober 1, 1987 4) The individual owner ha~ been shown by investigation to be of good moral oharaoter, 5) The evidenoe adduoed at the publio hearing on July 11, 1988 established that the de~ires of the residents of the neighborhood under consideration are for granting thi~ lioense, as evidenoed by petitions bearing 76 signatures in favor of issuanoe, 7 signatures in opposition, 18 signatures evidenoing no opinion and that issuanoe of thi~ lioense i~ oon~istent with the needs of the neighborhood under oonsideration, seoonded by Mr Flasoo, oarried 7-0 PUBLIC HEARINGS AND ORDINANCES ON SECOND READING Item 3. Applioation by Wheat Ridge United Methodi~t Churoh for approval of a 3-lot Minor Subdivision at 7530 West 38th Avenue (Case No MS-88-1) Glen Gi~ley presented the oa~e Henry M. Townsend, 3425 Pieroe Street, business manager of Wheat Ridge United Methodist Churoh, was present and sworn in by the Mayor Motion by Mr West that Case No MS-88-1, a request for approval of a 3-lot Minor Subdivision for 7530 West 38th Avenue, be approved for the following rea~ons 1 Staff and Planning Commi~sion reoommend approval 2 Approval of the subdivision will faoilitate the sale of Lot~ 1 and 2 3 All requirements of the Sub~ivi~ion Regulations have been met, seconded by Mr Merkl, oarried 7-0 Item-i_ Council Bill 352 - An Ordinanoe vaoating a portion of dedicated Urban Street, within the City of Wheat Ridge, County of Jeffer~on, State of Colorado (Case No WV-88-1) Counoil Bill 352 was introduoed on seoond reading by Mr Davis, title read by the Clerk, Ordinanoe No 769 as~igned Glen Gidley presented the case Allan R. Ojala, 6425 W 52nd Avenue, Arvada, repre~enting the applioant, wa~ sworn in by the Mayor Motion by Mr Davis that Counoil Bill 352 - Ordinanoe 769, a request for approval of a right-of-way vacation for a portion of Urban Street be approved for the following reasons 1 Staff and Planning Commission reoommend approval 2 The right-of-way does not serve as aooess for any adjaoent property 3 It is not likely there will be a need for it to extend north or south, seoonded by Mr Flasoo, oarried 7-0 CITY CUUNCIL MINUTES July 11, 1988 Page -3- Item 5 Council Bill 356 - An Ordinance authorizing the conveyance of certain real property owned by the City, declaring the property exces~ property, and approving the Special Warranty Deed conveying said property to Jo~eph F Lombardi. Council Bill 356 wa~ introduced on ~econd reading by Mrs Keller, title read by the Clerk, Ordinance No. 770 as~igned Motion by Mrs Keller for the adoption of Council Bill 356 - Ordinance 770, on second reading with the amendment that the deed not be conveyed to Mr Lombardi until such deed is received by the City from Prudential, seconded by Mr FIasco, carried 7-0 DECISIONS, RESOLUTIONS, AND MOTIONS Item 6. Motion to affirm Mayor's appointments to Richards Hart Estate Advisory Committee Motion by Mrs Ibbison to affirm the appointment of Janet Thompson to the Richards-Hart Estate Advisory Committee, term to expire in 1991, and to reappoint Connie Burkepile for three years, term to expire in 1991, seconded by Mr West, carried 7-0 CITY ADMINISTRATOR MATTERS Mike Smith referred to "information item only" in the packet, concerning Council targets, call if there are any questions, Ordinance re Sales Tax Incentive Program became effective yesterday, details regarding Mr Biehl's application are still being discussed, encouraged Council to sign up for Sunday's picnic CITY ATTORNEY'S MATTERS John Hayes referred to his memo on the EMS Ambulance contract, major problem was resolved He would be interested in Council's comments There will be a Resolution on the July 25, 1988 Agenda Two other points have been requested to be added, fire district itself should provide medical insurance and malpractice insurance, and the agreement should be specific in that it Covers the entire City He requested an Executive Session under Section 5 7(b)(1)(A) of the Charter Motion by Mrs Keller to hold an Executive Session, seconded by Mr FIasco, carried 7-0 ELECTED OFFICIALS' MATTERS Larry Merkl a~ked that RTD be called to enquire when they would put in a Park and Ride at 44th & Ward Road CITY COUNCIL MINUTES July 11, 1988 Page -4- Kent Davis a~ked about the ~tatus of the work on 44th Avenue, a couple of businesses have been almost ruined Mr Smith replied that thi~ had been followed up--he had talked to the State about it Mrs Snow stated she had talked to the representative to the highway commis~ion about this Nancy Snow wondered if sometime this year we should have a hearing on 38th Avenue and not wait until we have the money, just to see what the neighbors think, so they know what's going on and can make suggestions Don't wait until the last Minute Doris Ibbison referred to her dislike of illegal fireworks and stated ~he had a big fire over the 4th of July weekend, which had been caused by firework~ She has not left her home on the 4th for forty years She i~ grateful to the Wheat Ridge Volunteer Fire Department for saving the buildings on the property Randy West moved to adjourn after the Executive Session, seconded by Mrs Keller, carried 7-0 Executive Session was held.
