Adjournment MINUTES OF WHEAT RIDGE URBAN RENEWAL AUTHORITY February 7, 2006 5:30 p.m. 1. CALL THE MEETING TO ORDER The meeting of the Wheat Ridge Urban Renewal Autharity was called to order by Chair Williams at 537 p:m. in the council chambers of the Municipal Building, 7500 West 29th Avenue, Wheat Ridge, Colorado. 2, ROLL CALL OF MEMBERS Authority members present: James Bahrenburg Dennis Boyat Teri Carver Dean Gokey Janet Leo Terrell Williams Pete Ziemke Also attending: Alan White, WRURA Executive Director Corey Hoffmann, WRURA Attorney Ann Lazzeri, Recording Secretary 3. APPROVAL OF MINUTES There being no additions or conections to the minutes of January 3, 2006, they stood approved as presented. 4. PUBLIC FORUM Charles Durbin 3703 Ames Street In response to a question from Mr. Durbin regazding the status of the Comerstone lawsuit, Corey Hoffmann stated there was nothing new to report at this time. He is still awaiting a decision from the Court of Appeals. 5. NEW BUSINESS A. Orientation for New Members Alan White and Corey Hoffinann conducted an orientation for newly appointed Authority members. 02-07-06 B. Review of Land Use Case - WZ-0512 and MS0505/Trailer Source This case was presented by Alan White. The Urban Renewal Authority is required to review land use applications within an Urban Renewal Area to determine compliance with the Urban Renewal Plan. This land use case involves an Amended Outline Development Plan and Fina1 Development Plan and Final Plat for the Trailer Source business located on the west side of Tabor just south of I-70. Modifications to their plans are required because CDOT is acquiring a lazge portion of the current site for relocated on-off ramps to I-70. Following review and discussion, it was moved by Pete Ziemke and seconded by Dennis Boyat that the Authority finds that Land Use Case WZ-05-12 and MS-OS-OS fits the goals and objectives for the Urban Renewal Area based on findings that this use was zoned and established prior to the adoption of the Redevelopment Plan; amendments to the development plans would not be needed without the actions of CDOT in acquiring right-of-way for the relocation of I- 70 ramps; and the existing use was not subject to the architectural guidelines and streetscape requirements since it was established prior to the Redevelopment Plan being adopted; and the proposed development makes a reasonable effort to implement several of the guidelines. The motion passed unanimously. 6. OLD BUSINESS Meetings will be held the first Tuesday of each month for now. A schedule of meetings for the remainder of the year will be discussed at the Mazch meeting. 7. ADJOURNMENT The meeting was adjourned at 7:33 p.m. Terrell R. Your review is limited to providing written findings as to the compliance of the proposed development with the "land area, land use, design, building requirements, timing and procedure" provisions of the Urban Renewal Plan. Your role is not to provide a recommendation was to whether the plans should be approved or not, nor to recommend changes. The item requiring review is a request for approval of a special use p ermit to allow the operation of a casino transportation service out of property located at 7340 W. 44` Avenue. This property is located within the Wadsworth Boulevard Corridor Redevelopment Plan azea. Current zoning on the property is PCD (Planned Commercial Development) with Gl uses. Public or private transit stations are a special use in the C-1 zone district. The property in question is 4.16 acres in size and has a 34,000 square foot retail facility on it. The building is currently being used as an antique mall (Stage Stop antique mall). The property has a curb cut on W. 44`h Avenue and two curb euts to Upham from a large parking lot in front of the building. The applicant intends on operating a casino transportation service out of the existing structure. Improvements would consist of construction of a 600 squaze foot ticket office within northwest corner of the building. No other changes are proposed for the property as the existing pazking lot will be used for customer pazking. Service would consist of coach-sized buses entering the property off W. 44~h Avenue and exiting on Upham Street. This transit stop is coordinated with another stop operated by the same company at the Rodeway Inn at W. 44`h Avenue and Van Gordon. The applicant anticipates around 125 customers per day. Buses will stop on an hourly basis between 6 AM and 2 AM. The Redevelopment Plan recommends this area for CommerciaURetaiURestaurant uses. From a use perspective, the existing retail facility is in conformance with this designation. The proposed transit facility on a long-term basis could be considered inconsistent with the goals of the Redevelopment Plan for improving the physical environment along Wadsworth Blvd, renovating and redeveloping outdated and obsolete uses and improving the physical appearance of the comdor. However, the existing parking area is underutilized and there may be spin-off benefits from the transit operation in increased sales tas generated by patrons shopping at the antique mall. Staff has a deal of great latitude in the granting of special use permit requests. The variables include granting a special use permit to run with the land in perpetuity, as a personal grant to the applicant or for a specific period of time. In this case, staff would support approval for one year with renewal based on verified traffic accidents and receipt of legitimate complaints from the neighborhood. Conditions of approval would include termination of the SUP if the property is redeveloped or if the existing lease is terminated. Summary and Recommended Findings While the proposed Special Use Permit request is contrary to the goals and objections of the Redevelopment Plan, it should not interfere with the existing retail use and may provide increased sales taac opportunities. Approval of the SUP should be on a temporary basis with conditions recommended by Staff.
