Notice is hereby given of a Public Meeting to be held before the City of Wheat Ridge Urban
Renewal Authority on Tuesday, March 21, 2006, at 5:30 p.m., in the City Council Chambers of
the Municipal Building at 7500 West 29th Avenue, Wheat Ridge, Colorado.

CALL THE MEETING TO ORDER
The meeting of the Wheat Ridge Urban Renewal Authority was called to order by
Chair Williams at 5:35 p.m. in the council chambers of the Municipal Building,
7500 West 29th Avenue, Wheat Ridge, Colorado.

APPROVAL OF MINUTES
It was moved by Dennis Boyat and seconded by James Bahrenburg to
approve the minutes of February 7, 2006 as presented. The motion passed
unanimously.
APPROVAL OF AGENDA
The agenda was amended to include Item B under New Business: Discussion of
goals for the remainder of 2006. .
PUBLIC FORUM
Charles Durbin

Mr. Durbin inquired about the status of the Cornerstone lawsuit. Corey Hoffmann
stated there was nothing new to report at this time. He is stil] awaiting a decision
from the Court of Appeals.

5. NEW BUSINESS
A. Review of Land Use Case - SUP0602/Casino Transportation
This case is a request for approval of a special use permit to allow operation of a
casino transportation service from property located at 7340 West 44'h'Avenue.
The property is located within the Wadsworth Boulevard Corridor
Redevelopment Plan area.
During discussion of the case, concerns expressed included noise associated with
this business as buses arrive late at night, whether or not there was adequate
parking for bus patrons and potential littering of the area by bus patrons.
However, the proposed use would only be granted for a yeaz under the special use
permit process and the use is consistent with the present use at that site.
It was moved by Dean Gokey and seconded by James Bahrenburg that the
Authority finds that the use is not in compliance with the Urban Renewal
Plan, but given the fact that there are no major structure or site
improvements, future development in compliance with the Urban Renewal
Plan would not be impeded. Also, giving a one-year time frame on the
special use and assigning a special use permit to the owner and the current
bus company would further ensure that this would not impact the Urban
Renewal Plan.
The motion passed 4-1 with Terri Carver voting no.
B. Discussion of WRiIRA Plans for Remainder of 2006
• Potential projects for WRURA were discussed. The following possibilities
surfaced from this discussion:
1. Survey businesses in redevelopment corridors to see if there aze
individuals interested in starting a project with WRURA to assist their
cunent businesses.
2. A WRURA representative will attend Wheat Ridge Business District
meetings. (Teri Carver volunteered to attend the Business District
meetings and report back to the Authority.)
3. Talk to the owner of an abandoned restaurant to see if WRURA could play
a role in helping to get his business going again
4. Consider purchasing a property in need of redevelopment and fixing it up
for use as an office or some other use.
5. Consider whether or not to pursue additional blight studies in the city.
• Teri Carver stated that several properties have recently been sold at 38"' and
Depew and asked if staff would reseazch this and bring the information back

to the next meeting to see if this might be a situation where WRURA could be
of some assistance.
• Alan White will review the WRURA budget at the next meeting.
• Dean Gokey informed the Authority that he would not be present for the
second meeting in March.
• Frequency of WRURA meetings was discussed. A schedule was not set;
however, it was decided to hold the next meeting on Mazch 21, 2006.
6. OLD BUSINESS
There was no old business to come before the Authority.
7. ADJOURNMENT
It was moved by James Bahrenburg and seconded by Dennis Boyat to
adjourn the meeting at 7:02 p.m. The motion passed unanimously.

The City's Zoning and Development Code requires the review by WRURA of Yand use
applications in an wban renewal area. The Code requires a written recommendaYion from
WRURA based on its review of the application "against the provisions of the urban
renewal plan with respect to the land area, land use, design, building requirements, timing
and procedure." You are not making a recommendation on whether the request should be
approved or not. Your task is to determine if the request is in cotnpliance with Yhe
applicable Redevelopment Plan. Your finding will be one factor to be considered in the
approval process.
MS 06-02/Roach
This request is for the consolidation of two pazceis of land located in the Wadsworth
Boulevard Corridor Redevelopment Plan azea. The owner is proposing an addition to the
existing building. Consolidation of the two lots simplifies building code requirements.
The Wadsworth Boulevard Corridor Redevelopment Plan does not specifically address
the subdivision or assemblage of land. In general, however, consolidating pazcels
reduces the number of potential future ownerships. This, in turn, makes assemblage of
land for a future redevelopment project easier because there are fewer owners.
Suggested Finding: The request has no material effect on the Redevelopment Plan. The
consolidation of parcels reduces the number of owners in the area and would be
advantageous in the event land assemblage is pursued in the future for a redevelopment
project.
MS 06-03/Advance Auto
This request is to subdivide an existing parcel into two lots; one lot would contain the
Advance Auto Parts store currently under construction; the second lot would be used to
build a two-family dwelling. The second lot is zoned C-1 and would need to be rezoned

to allow residential uses. The owner was advised to combine the subdivision and
rezoning requests, but has elected not to do so.
The 381h Avenue Corridor Redevelopment Plan does not specifically address the
subdivision or assemblage of land.
The subdivision without rezoning would create a commercial lot 50 feet in width. If the
rezoning to a residential zone district is not approved, a commercial lot with limited
development potential would be created. In addition, the creation of an additional
ownership would make assemblage of land for a future redevelopment project more
difficult.
One could argue that the commercial zoning extends too far south along Benton to be
used effectively for commercial purposes and that rezoning to residential is appropriate.
Suggested Finding: The subdivision increases the number of owners in the area and
would not be advantageous in the event land assemblage is pursued in the future for a
redevelopment project. Without rezoning, the subdivision creates a commercial lot o£
limited utility and is not in conformance with the 38~h Avenue Redevelopment Plan.
MS 06-04/Wheat Ridge Cyclery
This request is for the consolidation of two parcels of land located in the 38`h Avenue
Comdor Redevelopment Plan area. The owner is proposing an addition to the existing
building and consolidation of the lots simplifies building code requirements.
The 38`h Avenue Corridor Redevelopment Plan does not specifically address the
subdivision or assemblage of land. In general, however, consolidating pazcels reduces
the number of potential future ownerships. This, in tum, makes assemblage of land for a
Future redevelopment project easier because there are fewer owners.
The expansion of this business is envisioned in the Redevelopment Plan and
consolidation of the parcels provides an advantage to the owner in the construction of the
addition to the business.
Suggested Finding: The request facilitates the expansion of an existing business and is
therefore in conformance with the 38`h Avenue Corridor Redevelopment Plan. The
consolidation of pazcels reduces the number of owners in the area and would be
advantageous in the event land assemblage is pursued in the future for a redevelopment
proj ect.

Attached are two documents with two pages each. The first document is the 2006 Budgef
for the Authority. There are two funds: the Town Center Fund and the Walgreens
Project Fund. The second docuxnent is a spreadsheet showing revenue received and
expenses, both actual and anticipated, in each of the escrow accounts we were required
by the Court to establish as a result of the Walgreens lawsuit.
The Court's order requires us to:
• Deposit into the Walgreens Escrow Account the property taac increment
payments received from the Town Center URA up to $200,000 per yeaz. This
increment was pledged to the Walgreens project for four years.
Deposit any property tax and sales tax increments generated from the
proposed Walgreens site into the Walgreens Escrow Account. There has been
no redevelopment, hence no property or sales tax increments generated in the
project area.
Request approval by the Court to pay any bills (legal fees, utilities for the
Ames property, etc.). This order has been modified by the Court with the
agreement between the parties. We can now pay our bills without the Court's
permission, but we agreed to deposit an additional $200,000.00 into the
Walgreens Escrow Account by June of 2006. $100,000.00 was deposited last
year, so we need to deposit an additional $100,000.00 vlus the $200,000.00 in
property tax increment from the Town Center.
To further complicate our budget, the City has been calculating the sales tax increment
from the Town Center incorrectly according to the Intergovemmental Agreement (IGA)
between the parties signed in 1996. We aze not certain if the WRT JRA was underpaid or
overpaid for the last 10 years. We are investigating this issue with the City. Until this is
resolved, the City has paid WRi JRA $100,000.00 of the $200,000.00 projected in the
year end 2005 budget. (Note: the $100,000.00 was a cap placed on the sales tax
\\srv-ci-eng-002\users$\awhiteV.ll Files\URAVNemos\3-15-06 memo re budgeLdoc
increment paid to WRURA in the 1996 IGA. A new IGA was adopted in 2003 and is
discussed below.)
What this means is that instead of a 2005 projected fund balance of $255,002.00, the fund
balance was actually $122,792.00. The 2006 sales tax increment won't be paid to
WRURA by the City until the beginning of 2007. Town Center property tax increment is
remitted to WRURA monthly as it is collected by the County. All of the monthly
payments must be transferred to the Walgreens Escrow Account until $200,000.00 is
deposited. That will take until about June of this year. We also need to deposit the
additional $100,000.00.
As our revenue stands now, without a new intergovemmental agreement with the City
concerning the Town Center sales tax increment and the possibility of additional payment
from the City, WRURA has approximately $20,000.00 to operate on until about June.
After that, we will have additional Town Center property tax revenue to use, up to an
estimated $70,000.00, but this revenue will be collected in three or four payments.
The Town Center property tax increment stops this year. There is one more yeaz to
collect, but $200,000.00 must be deposited into the Walgreens Escrow account.
The Town Center sales tax increment was extended in a 2003 IGA "for so long as is
necessary for the Authority to pay its financial obligations for the purpose of
redeveloping the Town Center and the 381h Avenue Corridor Redevelopment Area."
Without this revenue, WRiTRA cannot operate.
