Minutes of Meeting April 20, 2006 CALL THE MEETING TO ORDER The regular meeting of the Wheat Ridge Planning Comxnission was called to order by Chair Wesley at 7:00 p.m. in the City Council Chambers of the Municipal Building, 7500 West 29th Avenue, Wheat Ridge, Colorado. A set of these minutes is retained both in the office of the City Clerk and in the Community Development Department of the City'of Wheat Ridge. 4. 5. APPROVE ORDER OF AGENDA It was moved by Commissioner PLiJMMER and seconded by Comuussioner STEWART to approve the order of the agenda as presented. The motion passed unanimously. APPROVAL OF MINUTES - March 16 and March 30, 2006 It was moved by Coxnmissioner McNIILLIN and seconded by Commissioner STEWART to approve the minutes of March 16 and March 30, 2006 as presented. PUBLIC HEARING A. Case No. MS-06-01: An application filed by Park Kwang Choi for approval of a 2-lot minor subdivision plat for property located at 4700 Parfet Street. B. Case No. WA-06-01: An application filed by Park Kwang Choi for approVal of a variance to minimum lot size and lot width for property zoned Agricultural-One and located at 4700 Parfet Street. These cases were presented by Meredith Reckert. She entered all pertinent documents into the record and advised the Commission there was jurisdiction to hear the case. She reviewed the staff report and digital presentation. She also advised that the request for variance would require a supermajority vote to be approved. Staff recommended approval of both applications for reasons outlined in the staff report. Lynn Wheatley Park Kwang Choi 4700 Parfet Street Ms. Wheatley stated that they wished to subdivide the property to create two residential lots. They plan to build a new house on lot two and rent the present dwelling. The possibility of a mass rezoning of this azea from agricultural to residential was discussed. . Alan White informed the Commission that city code only allows for mass rezoning when if is to a more intensive zoning. There were no other individuals present who wished to address these cases. It was moved by Commissioner PLi11VI1VIER and seconded by Commissioner STEWART to approve Case No. WA-06-01, a request for approval of a 25,954 square foot variance to the minimum lot size of lot 1, a 32,666 square foot variance to the minimum lot size of lot 2 and 52.85 foot variance to the minimum lot width of lot 2, for property located at 4700 Parfet Street for the following reasons: 1. The request will not be detrimental to the public welfare or injurious to properties in the area. 2. The request would not alter the character of the locality, the proposed lot sizes and widths would match the lot sizes and widths of neighboring properties in the surrounding area. 3. The property as it exists today is deficient in respect to minimum lot size and width in the A-1 zone district. The motion passed 7-0 with Commissioner BRINiCVIAN absent. Planning Commission Page 2 Apri120, 2006 It was moved by Commissioner PLiTM1VIER and seconded by Commissioner SPANIEL to approve Case No. MS-06-01, a request for approval of a two-lot subdivision plat for property located at 4700 Parfet Street, for the following reasons: 1. All requirements of the Subdivision Regulations have been met. 2. All required utility easements are being provided. 3. Adequate infrastructure will be constructed with the development to serve the proposed use. The motion passed 7-0 with Commissioner BRINKMAN absent. C. Case No. WZ-05-12: An application filed by Jim Blumenthal for Skitzo Offshore, LLC, for approval of an amended Planned Commercial Development Outline Deyelopment Plan and approval of a Final Development Plan for property located at 4651 Tabor Street. D. Case No. MS-05-05: An application filed by Jim Blumenthal for Skitzo Offshore, LLC, for approval of a final plat for property located at 4651 Tabor Street. Prior to presentation of the cases, Commissioner STEWART disclosed that she is a neighbor of the applicanf and they have had some dealings in the past. These cases were presented by Meredith Reckert. She entered a11 pertinent documents into the record and advised the Commission there was jurisdiction to heaz the case. She reviewed the staff report and digital presentation. Staff recommended approval of both applications for reasons outlined in the staff report. In response to a question from Commissioner S1'EWART, Ms. Reckert explained that exiting from the property would not be allowed from the north access due to limited sight distance. Jim Blumenthal 4651 Tabor Street Mr. Blumenthal, owner of Trailer Source, stated that CDOT will be taking 64% of his existing property for a new off ramp leaving him with 2.5 acies out of 7 acres. He plans to build a contemporary building on the remaining site to house their operations. He presented azchitectural renderings of the proposed building. He stated his opposition to the city's request for brick wainscoting which he believed would not be consistent with the overall design of the building. In response to a question from Commissioner PLL)NIlVIER, Alan White stated that the type of building materials proposed to be used in this project are within the architectural code guidelines. In response to a guestion from Commissioner STEWART, Mr. Blumenthal stated that the existing building would be demolished. There were no other individuals present who wished to address these cases. Planning Commission Page 3 Apri12Q 2006 Commissioners McMII,LIN and STEWART stated that they were pleased with the plan and felt it would be an improvement to the azea. It was moved by Commissioner STEWART and seconded by Commissioner SPANIEL to recommend approval of Case No. WZ-05-12, a request for approval of an amended Outline Development Plan for property located at 4651 Tabor Street for the following reasons: 1. The modification to the maximum building coverage and front setback standards wffl allow for efficient redevelopment of the property. 2. The amended Outline Development Plan reflects the right-of-way acquisition by CDOT. 3. All requirements for a PCD Outline Development Plan have been met. With the following conditions: 1. A note be added regarding the northern curb cut restricting it to one way in. 2. The property owner's signature block be modified so that all three documents are consistent. The motion passed 7-0 with Commissioner BRINKNIAN absent. It was moved by Commissioner STEWART and seconded by Commissioner McMILLIN to recommend approval of Case No. WZ-05-12, a request for approval of a Final Development Plan for property located at 4651 Tabor Street for the following reasons: 1. It will allow for redevelopment of the property. 2. It is consistent with the proposed Outline Development Plan. 3. All requirements for a PCD Final Development Plan have been met. With the following conditions: 1. One of the freestanding signs allowed on the property be a monument sign. 2. A note be added that signage will not be illuxninated when the business is closed. 3. A note be added to the northern curb cut restricting it to one way in. 4. An escrow account be provided for public improvements from the northern curb cut to the north property line. 5. The property owners' signature block be moditied so that all three documents are consistent. The motion passed 7-0 with Commissioner BRINKMAN absent. It was moved by Commissioner STEWART and seconded by Commissioner SCEZNEY to recommend approval of Case No. MS-OS-OS, a request for approval of a Final Plat for property located at 4651 Tabor Street for the following reasons: Planning Commission Page 4 Apri120, 2006 1. It reflects the right-of-way acquisition by CDOT. 2. Staff recommends approval. 3. All regulations and standards of Article IV of the Code of Laws have been met. With the following conditions: 1. Ten feet of right-of-way be dedicated for the southern portion of Tabor Street. 2. The drainage easement on the south end of the property be shown. 3. Correct miscellaneous typographical errors. 4. The property owner's signature block be modified so that all three documents are consistent. The motion passed 7-0 with Commissioner BRINI{MAN absent. E. Case No. WPA-06-01: A resolution adopting an amendment to the City of Wheat Ridge Comprehensive Plan to include areas outside the current city limits. This case was presented by Alan White. He advised the Commission that proper noticing procedures were followed and there was jurisdiction to heaz the case. He reviewed the draft Comprehensive Plan Addendum for 2006 which included revisions from past work sessions concerning the Three Mile Plan. He handed out an additional memorandum regazding the Intergovernmental Agreement with the City, Prospect Recreation and Park District and the Long's Peak Metropolitan District. He also provided copies of a memorandum from Neil Jaquet, Director of Water Resources for Coors Brewing Company indicating that Coors has no interest in granting new right-of-way along Clear Creek for reasons of liability, safety and redundancy of trail alignments. Flora Andrus Prospect Recreation and Park Distriet She stated that she was very pleased with the way the plan has been worked out. It was moved by Commissioner McMILLIN and seconded by Coimuissioner PLUMIVIER to recommend adoption of the addendum as presented with one change: the zone between the Cabela's property and Clear Creek be designated as open space. Alan asked if his language from his memo could be included in the motion. It was so moved by Commissioner McMILLIN. The motion passed 7-0 with Commissioner BRINKMAN absent. 8. OLD BUSIlVESS There was no old business to come before the Commission. 9. NEW BUSINESS There was discussion about methods of notification when a Commissioner is unable to attend the meeung after working hours. There was a consensus to amend the bylaws to the Planning Commission Page 5 Apri120, 2006 effect that any cases that can't be heard due to lack of a quorum would be automatically continued to the next meeting. 10. CONIMISSION REPORTS There were no commission reports. 11. COMIVIITTEE AND DEPARTMENT REPORTS There were no committee and department reports. 12. REQUEST The applicant is requesring approval of a 2-lot minor subdivision on property zoned Commercial-One (C-1) and The subject property currently has a recently com leted a roximately 7,000 square foot commercial building with associated parking areas and drive aisles . The new lot which is roposed to be created with this request is cuxrently vacant with no structures on it °S . The applicant is requesting to create a new lot that is approximately 6,580 square feet in size. The new lot created will also keep the current zoning with this request, which is Commercial One (C-1). II. ANALYSIS This request is only for the subdivision of the subject property, and does not include any site plan approval, variances, or zone change requests. No structures or uses are proposed at this fime for the new lot. The new lot would be approximately 6,680 squaze feet in size, or approximately 51' X 125' with an irregular shaped front lot line adjacent to Benton Street. The new lot, if approved, would also retain the current C-1 zoning. The C-1 development standards (Sec. 26-218) do not require a minimum lot size or lot width, therefore the new lot would be a conforming lot in this regard. Any new development on the lot would however be subject to the other development standards for the C-1 zone district, including setbacks, lot coverage, landscaping and pazldng. The new lot created, if approved, would be relarively small; however no plans for physical improvements to the property are proposed at this rime. It is therefore difficult to ascertain if development would be problematic on this new lot. The crearion of a small lot that may be problematic for future development is not a criteria staff can use to evaluate the request and make a recommendation. Currently the area which may encompass the new lot, although not formally landscaped, acts as a buffer between the new commercial development to the north and the residential uses to the immediate south. Creating a freestanding Gl zoned lot would enable an addirional commercial use on the new property, provided that all development standards can be met. If the applicant were to ulrimately request a zone change to residential, for example, all residential development standazds must be met as well. The applicant has expressed that the intent of the subdivision request is to ultimately create a residentially zoned and used property . As noted however, this request is only for the subdivision of the land and does not involve any additional requests for the use of the land or othenvise. New freestanding residenrial shuctures aze not permitted in the Gl zone dishict. IV. AGENCY REFERRAI,S All agencies are currently able to serve the property and can conrinue to do so with the proposed minor subdivision. Any service upgades required by the refenal agencies will be addressed if the applicant submits for a building pemut. Of note was the response from the Wheat Ridge Urban Renewal Authority BEEIMM. STAEF CONCLUSIONS AND RECOMMENDATIONS The requirements of the Subdivision Regularions have been met and the parcel to be created meets all applicable development standards for property zoned Commercial-One. Therefore, staff recommends APPROVAL of the minor subdivision request for the following reasons: 1. All requirements of the City's Subdivision Regulations have been met. 2. The Plan was prepazed by Winston Associates and Community Development Department staff over the course of the last seven months. The preparation of the plan fulfills one of Council's strategic goals to prepare plans for subareas in the City in order to prepare for growth and its opportunities. This area was selected for one of the first subarea planning efforts because of the Fastracks plan to build the Go1d Line with an end of the line station near Wazd Road and 50th Place. The Park `n Ride at I-70 and Ward will be relocated to somewhere in the area. Not only will iransit passengers potentially arrive by automobile, but by bus. This amount of activity has the potential to transform the azea dramatically. Four public design workshops were held with landowners, business owners and tenants during the last seven months. RTD officials and planners from neighboring jurisdictions also attended the meetings. The plan envisions a mixed use "village" or "mini-downtown" for the area azound the proposed station location. The core area would consist of retail, office and service uses on ground floors with higher density residential uses on upper floors and as a stand alone uses away from the core, transitioning to existing low density neighborhoods. Parking for the station users would be dispersed through the core azea. The area south of the core area, generally south of the tracks, would remain as an employxnent area with light manufachxring and affice/warehouse uses. A grid slreet system is proposed with new or improved connections to major roads to the east, west and south. "New urbanism" concepts of zero front setbacks, parking to the side or rear, wide sidewalks, on-street parking, mixed uses, quality architecture, and street trees aze proposed in an effort to create a village where people want to live and/or work. Construction of the Gold Line is nine years away and the Plan discusses what the City and landowners can do in the meantime until the market for a mixed use village emerges. The Subarea Plan is proposed to supercede the Comprehensive Plan for the area. The existing Comprehensive Plan recommends primarily industrial uses for the azea. Without a change to the plan, the area would likely become a series of unconnected industrial pazks with an 800 car pazldng lot next to the station. This item has been scheduled for a public hearing. Notice as required by state statute for the hearing has been provided. _(Notice in the_Transcript newspaper.) In addition, notices and draft plans have been sent to a mailing list of approximately 50 persons who have attended the workshops. Winston Associates will be at the hearing to present the Plan. The regulations are found in the Intemational Building Code and International Residential Code, both of which are adopted by reference in Chapter 5 of the Code of Laws. There are also regulations in Chapter 26, which is why this ordinance involves Planning Commission. The provisions of Section 26-107 (3) conflict with those of the referenced building codes. The building codes provide that a permit is valid so long as work is started within 180 days of issuance and that work is not abandoned for a period of more than 180 days. The Chapter 26 provision reduces the start up time to 60 days and the abandonxnent period to 120 days. No other guidance is given as to what constitutes abandonment of the work. Is work not abandoned if an inspection is called in every 179 days? If one more stud is nailed in place since the last inspection? If one more outlet is wired since the last inspection? If a permit doesn't expire if something is done every 179 days, a permit can literally be valid for years. This results in complaints from neighbors. Under the current regulations, we have no way to deal with owners or contractors whose projects aren't brought to complerion. Under the proposed ordinance, a building permit is valid for 180 days from the date of issuance, period. This is sufficient time for most construction projects except large commercial projects, new residences, and maybe some additions and tenant finishes if they are complex. Most contractors want to finish jobs quickly to move on to the next job. The Building Official is authorized to issue one or more extensions to the 180 days upon a justifiable cause being demonstrated. This will likely be standard pracrice for most projects. For endless construction proj8cts, the ordinance gives us the ability to not issue any further extensions, take the owner to court, and have the court order the completion within a specified time. This may sound hazsh, but it is the only way we haue to deal with the worst cases. Staff recommends approval. WHEREAS, pursuant to its home rule authority and C.R.S. § 31-15-601, the City of Wheat Ridge (the "City") possesses the authority to adopt regulations concerning the construction of homes and other structures within the City; and WHEREAS, pursuant to C.R.S. § 31-16-201, et seq., the City possesses the authority to adopt codes promulgated by other agencies by reference; and WHEREAS, in accordance with the above, the Ciry Council ("Council") of the City of Wheat Ridge, Colorado ("City") previously acted to adopt the 2003 International Building Code ("IBC") and the 2003 International Residential Code ("IRC") by reference; and WHEREAS, the Councii also adopted certain amendments to the IBC, codified as Section 5-76(b) of the Wheat Ridge Code of Laws ("Code"), and amendments to the IRC, codified as Code Section 5-85(b); and WHEREAS, both the IRC and IBC currently provide that any permits issued thereunder remain valid as long as any amount of work is performed once every one hundred and eighty (180) days; and WHEREAS, the Council finds and determines that such provisions create the potential for unreasonable delay in the completion of projects for which building permits have been issued; and WHEREAS, the Council therefore desires to amend said provisions to provide that permits shall expire one hundred and eighty (180) days after issuance unless the City building official grants the permitee an extension; and WHEREAS, pursuant to C.R.S. Title 31, Article 23, the City is explicitly granted the power to promulgate rules related to the planning and zoning of the City; and WHEREAS, in accordance with this Article, the City has previously adopted Code Section 26-107 (A)(3); and WHEREAS, said Section currently provides that any permits issued under Code Chapter 26 remain valid as long as any amount of work is performed once every sixty (60) days; and WHEREAS, the Councii finds and determines that such provisions create the potential for unreasonable delay in the completion of projects for which building permits have been issued; and WHEREAS, in the interest of consistency among Chapter 26, the IBC and the IRC, the Council therefore desires to amend said Section 26-107 (A)(3) to provide that permits shall expire'one hundred and eighty (180) days after issuance unless the City building official grants the permitee an extension; and WHEREAS, the Council finds that the amendments adopted by this ordinance are necessary to prevent unreasonable delay in building projects in the City in the interests of the public health, safety and welfare, while providing an avenue for extensions of time for those projects that reasonably cannot be completed in one hundred and eighty (180) days.
