The regular meeting of the Wheat Ridge Planning Commission was called to
order by Vice Chair CHILVERS at 7:00 p.m. in the City Council Chambers of the
Municipal Building, 7500 West 29°i Avenue, Wheat Ridge, Colorado.

PUBLIC HEARING
A. Case No. ZOA-06-05: An ordinance amending Chapter 26 of the Wheat
Ridge Code of Laws to provide for the zoning of social clubs.
This case was presented by Alan White. He entered all pertinent documents into
the recard and advised the Commission there was jurisdiction to hear the case.
He reviewed the staff report and digital presentation. The proposed amendments
define social clubs, list social clubs separately in the use chart for commercial and
industrial uses, and allow social clubs as permitted uses in the C-1, C-2 and I zone
districts. They would also be allowed in PCDs and PIDs unless specifically
prohibited ar not listed. A companion ordinance amends Chapter I 1 and requires
owners of such establishments to obtain a social club license. The companion
ordinance does not require Planning Commission review.
Vice Chair CHILVERS asked if inembers of the public wished to address this
ordinance. Hearing no response; the public comment portion of the hearing was
closed.
Commissioner McMILLIN commented that the ordinance allows social clubs to
participate in the local market and provides controls if problems arise.
It was moved by Commissioner MATTHEWS and seconded by
Commissioner REINHART to recommend approval of the proposed
ordinance amending Chapter 26 to provide for the zoning of social clubs.
The motion carried 5-0 with Commissioners BRINKMAN, SCEZNEY and
STEWART absent.
B. Case No. ZOA-07-01: An ordinance amending Article VII of Chapter 26
concerning the regulation of billboards.
This case was presented by Alan White. He entered all pertinent documents into
the record and advised the Commission there was jurisdiction to hear the case.
He reviewed the staff report and digital presentation. Cunent regulations do not
contain provisions to provide guidance for permitting of billboards. The proposed
ordinance vests the current 16 billboard locations with the underlying property.
The ordinance also repeals the B-1 District since it is no longer needed. Three
alternatives have been examined to deal with the lack of specifics in the Code:
(1) codify the procedures and policies used in two instances in the past three years
where ground leases were expired; (2) vest the right to a billboard with the current

permit holder; or (3) vest the right to a billboard with the landowner where
billboards are currently located.
In response to a question from Commissioner McMILLIN, Mr. Dahl addressed
mobile billboards. He stated that, first of all, it would be necessary to determine if
the city has the quantity of mobile billboards necessary to develop regulations.
Secondly, a case would have to be made that there is some kind of public safety
concern involved as opposed to advertisement on the side of a vehicle such as a
moving van. This is something that can always be addressed at a later date if it
becomes a problem.
Commissioner McMILLIN stated that he would not pursue the matter further but
mentioned it because of personal concern that they could add to traffic congestion
in the city.
Commissioner MATTHEWS commented that he would have more concern with
mobile billboards parked on private property than those occurring on;highways.
In response to a question froin Commissioner McMILLIN, Mr. White stated that
there are regulations prohibiting banners or attached signs to parked vehicles.
Vice Chair CHILVERS asked if there were members of the public who wished to
speak at this time.

Mr. Scherer is general manager for CBS Outdoor for metropolitan Denver. He
stated that he was not aware of any inunicipalities that have ordinances against
mobile billboards and stated that CBS'is not in the mobile billboard business.
Mr. Scherer stated that CBS' Outdoor is in 42 metro inarkets across the country
and there is no case where the property owner controls the billboard rights. A
billboard comes up for a new location only every 10-I5 years. The 16 billboards
in the city provide a windfall for 15 property owners who are reimbursed to have
a billboard placed on their property. The ordinance would preclude any property
owner who does not have a billboard to ever have one on his property. He stated
that CBS owns the property next to Medved which has two billboards on the
property. He asked if these would be grandfathered if the ordinance takes effect.
He asked that no changes be made to the billboard process. He stated that
billboards drive commerce into the city and expressed concern that the ordinance
would lead to elimination of all billboards.
Commissioner McMILLIN asked Mr. Scherer if he was aware of any cities that
have banned billboards. Mr. Scherer replied that Douglas County and Greenwood
Village have restrictions against billboards. Denver does not allow any additional
billboards.

Coinmissioner MATTHEWS asked if the lot with two billboards would be
grandfathered if the ordinance is passed. Mr. Dahl stated that he would look into
this further and commented that the intent of the ordinance is not to eliminate or
reduce the number of billboards but rather to permit the present locations.
Vice Chair CHILVERS asked if other members of the public wished to address
this ordinance. Hearing no response, the public comment portion of the hearing
was closed.
It was moved by Commissioner McMILLIN and seconded by Commissioner
MATTHEWS to recommend approval of the proposed ordinance amending
Article VII of Chapter 26 concerning the regulation'of billboards.
Commissioner REINHART commented that he was not convinced of any clear
public purpose in choosing one of the three courses of action suggested in the
staff report. Billboards do provide a windfall far specific property owners. He
did not believe staff would be overwhelmed in administration of the ordinance.
Commissioner McMILLIN cominented that billboards will probably be reduced
over the years and replaced as thoseproperties are developed for other uses. He
did not believe billboards advertising businesses outside the city are of any
economic importance to Wheat Ridge. The ordinance would tend to preserve the
status quo regarding the number of billboards in`the city.
Commissioner REINHART stated that he believed that grandfathering would be
in the public interest.
Commissioner MATTHEWS commented that the revised process would help
insulate the city from lawsuits.
Commissioner Mc1VIILLIN summarized Commission's findings that the
ordinance will be clear and fair and will prevent lawsuits such as happened in the
previous process.
The motion carried 5-0 with Commissioners BRINKMAN, SCEZNEY and
STEWART absent.
8. OTHER ITEMS
• Alan distributed copies of a inemo inviting Planning Commission members to
attend a City Council study session on June 18`h . The subject will be an
update on the draft plan for the Fruitdale Subarea.

• Commissioner REINHART asked about the status of the Wadsworth Comdor
Study. Mr. White stated that staff is in a process of finalizing negotiations
with the consultant to help with the additional work on the study. Council has
directed that this process be finished by October and it should be done well in
advance of that date.
9. ADJOURNMENT
It was moved by Commissioner McMILLIN and seconded by Commissioner
REINHART to adjourn the meeting at 8:06 p.m. The motion passed
unanimously.

I. REQUEST
The applicant is requesting approval of a Final Development Plan for the purpose of
constructing a bank (Exhibit 1, Letter of Request). The current Planned Commercial
Development zoning designation allows a wide range of commercial uses. The applicant
wishes to construct a 4,477 square foot bank, one of the allowed uses listed on the approved
Outline Development Plan. The property contains an abandoned gas station, which ultimately
would be removed. The property is bounded by Youngfield Street to the west and West 32"a
Avenue to the north, and is 29,578 square feet in size.
The property was rezoned to Planned Commercial Development in 2001, in conjunction with
the constnxction of the Walgreen's drug stare. The gas station remained operational unri12006,
when the underground tanks, gas pumps and canopy were all removed.
The property is still owned by the Walgreen Corporation. The applicant has received proper
consent from the property owners to pursue this application.
II. FINAL DEVELOPMENT PLAN
The Final Development Plan (FDP) shows the site layout including building layout, pazking
areas, landscape areas and typical building elevations (Exhibit 2, FDP). The FDP conforms to
the general layout and development standards as established in the Outline Development Plan.
Existing Conditions
The site currently contains an abandoned gas station. The gas station was operational until
2006, at which time the gas tanks, gas puxnps and canopy were removed.
The property has free access on West 32"d Avenue and on Youngfield Street. These access
points will be closed with the redevelopment of the site.
It should be noted that a traffic generation letter was submitted which indicates that the
proposed use will result in a decrease of vehicles per day as compared to the previous use, a
gas station.
Building Setbacks
Page 2 of the FDP shows the site layout. The ODP specified minimuxn setbacks and maximum
lot coverage for the property. The ODP states that a minimum setback of 25 feet is required
when adjacent to any right-of-way or residential properties, and all other setbacks shall be 10
feet. The building complies with the minimum required setbacks. The ODP specifies that a
masimum of 80% of the lot may be covered by paving and structure. The FDP proposes 73%
lot coverage, far below the maacimum allowance.
Landscaping
The Final Development Plan details 27% landscaping on the property. The Outline
Development Plan specified that at least 20% of the rezoned area (lots 1 and 2) must be
landscaped. When the Walgreen's was constructed, approximately 18% of the Walgreen's lot
was landscaped. As a result, the subject parcel must contain 22% landscaping, giving a total
landscaped area of 20% for lots 1 and 2. There will be 12 street trees located adjacent to right-
of-way, surpassing the minimum requirement of 9 street trees. Adequate trees and shrubs are
being shown on the landscaping page.
Parking/Access

The ODP references the Zoning Code for parking standards. The Code requires a minimum of
1 space for each 200 square feet of building area, less any dedications. Based on this
requirement, a total of 23 parking spaces aze required. The FDP details 24 parking spaces to be
located on the site.
The existing curb cuts on the property will be removed. The property will gain access from
West 32"d Avenue and Youngfield Street; two access points on the adjacent property. When the
properties were rezoned in 2001, cross access easements were established in an attempt to
control access to both properties. The result is one access point on West 32"d Avenue and one
on Youngfield Street to serve both properties. Each access point is restricted; vehicles leauing
the site may only turn right out onto eastbound West 32"d Avenue or northbound Youngfield
Street.
Elevations
Page 4 of the Final Development Plan shows some typical building elevations. These
elevations are representative of the standards established on the Outline Development Plan.
The Outline Development Plan requires that any building must be constructed of brick, glass,
masonry and/or rock, and that the buildings on lots 1(Walgreen's site) and 2(subject parcel)
sha11 have consistent and cohesive design. The elevations shown meet the minimum
requirements established on the ODP.
There are areas of public dedication shown adjacent to West 32"d Avenue and Youngfield
Street. These areas consist of real property to be dedicated to the City and easements dedicated
to the City for the conshucdon of public improvements. These areas of dedication will be
conveyed by separate instrument.
It is pertinent to note that the applicant has also requested approval of a special use permit for a
drive through use associated with the bank. Pursuant to Section 26-114 of the Code of Laws,
the special use pernut process starts as an administrative review. If during a ten-day posting
period any objections are received, or if the application does not meet one or more of the
special use criteria, the special use request shall be heard before City Council. Because the
applicant is requesting approval of a Final Development Plan which requires approval by City
Council, the special use permit will be reviewed by City Council.
III. AGENCY REFER1tAL
All responding agencies have indicated that they can serve the properry, and the applicant will
bear the cost of upgrading any service to the property.
A final drainage report and plan has been reviewed by the Public Works Department. While
some minor issues need to be resolved, Public Works is satisfied that the applicant will detain
all drainage onsite to be released at historic flow rates and will mitigate any negative impacts
to surrounding properties.
IV. NEIGHBORHOOD MEETING
The required neighborhood meeting was held on April 12, 2006. There was 1 attendee at the
neighborhood meefing. The attendee asked about access points and traffic. A meeting synopsis
has been included as Exhibit 3.

V. STAFF CONCLUSION & RECOMMENDED MOTION(S):
Staff concludes that the Final Development Plan conforms to the standards established on the
Outline Development Plan. Therefore, staff recommends approval of the Final Development
Plan.

The existing site formedy served as a gasoline service s[a[ion. Although the underground gasoline [anks have been
removed, [he existing retail building remains. The proposed si[e cons[ruction will consist of total demolition of
existing buildings, structures and removal of all existing asphalt paving. Accommodations for the future
reconstruction of 32nd Ave. & Youngfield St. intersection are provided.
The proposed project is a one-story branch bank of Fics[Bank rotaling approximately 4,460 square feet. Ex[erior
building materials most likely will include a masonry veneer in combination with fixed glass in an aluminum
storefront system. Access [o the si[e will be provided by [wo existing wrb wts, one each on 32"d Avenue and
Youngfield St. Two exis[ing curb cuts on Youngsfield St. and one on 32nd Ave. will be abandoned with this proposal.
Drive lanes, drive through queuing and parking for vehicular traffic have been organized in such a way as [o provide a
safe and efficient circulation system for both drivers and pedestrians.
Site planning and pedes[rian concerns have been addressed and are in compliance with design guidelines and
restrictions. This proposal is wmpatible wi[h [he surrounding area by offering a neighborhood financial service. The
size and scale of [he proposed building is similar in nature to other single use developments along 32nd Ave, &
Youngfield St.
This submittal includes a scaled Site Plan, copy of [he Property Deed, Landscape Plan, Drainage Report and Plan,

Issues discussed: There was one neighbor in attendance. Questions were asked about access
to the property, roadway improvements needed at 32nd and Youngfield
and if a traffic study would be submitted.
The applicant felt it was a good plan and a good use of the property, and
that it would improve existing conditions.
