PLEDGE OF ALLEGIANCE Greg Knudson, City Engineer Ann Lazzeri , Secretary The following is the official set of Planning Commission minutes for the public hearing of April 20, 2000 A set of these minutes is retained both in the office of the City Clerk and in the Department of Planning and Development of the City of Wheat Ridge. 4. APPROVAL OF ORDER OF THE AGENDA It was moved by Commissioner GOKEY and seconded by Commissioner COLLINS to approve the order of the agenda. The motion carried 8-0. It was moved by Commissioner GOKEY and seconded by Commissioner COLLINS that the minutes of April 6,2000 be approved as presented. The motion carried 8-0. Case No. WZ-00-02: An application filed by the George T. Sanders Co. for approval of a combined outline and final development plan and plat, consolidation plat, and rezone of two properties from A-I (Agricultural-One) to Planned Industrial Development for the purpose of wholesale, warehouse, and office uses for property located at 10210 West 49th Avenue, The case was presented by Martin Omer. He reviewed the staff report and presented slides and overheads of the subject property. He entered all pertinent documents into the record and advised the Commission that there was jurisdiction to hear the case. Staff recommended approval the application based upon reasons outlined in the staff report, Commissioner GOKEY asked if 50th Avenue right-of-way would affect the development of Mr. Sanders' property. Mr. White replied that the right-of-way is already figured into Mr. Sanders' plan. Commissioner COOPER asked if those people who attended the neighborhood meeting were satisfied with the outdoor storage proposal as shown on the plan. Mr. Omer replied that none of the neighbors attended the meeting. Commissioner SNOW asked if a traffic impact report was available for consideration. Greg Knudson replied that a traffic impact study was not required for this case, Alan White further explained that the applicant did not do a traffic impact study due to the department's initial analysis that there were not significant impacts to warrant a traffic impact study. David Langley Box 5848, Woodland Park, CO Mr. Langley, architect for the project, was sworn in by Chair MACDOUGALL. He invited questions from the Commission. In response to a question from Commissioner SNOW, Mr. Langley explained that the central area of the project is set back approximately 120 feet from the main building and will serve as a loading area. The design, using decorative concrete block, will serve to limit visibility from the street. Commissioner SNOW asked if the design would allow everything presently stored outside to be stored inside. Mr. Langley replied that it would. In response to a question from Chair MACDOUGALL, Mr, Langley stated that the completed project will have less exposed concrete to be visible from 49th and Miller than the existing building, Planning Commission Page 2 April 20, 2000 Chair MACDOUGALL asked if there were others present who wished to address the matter. `There eras no response. It was moved by Commissioner SNOW and seconded by Commissioner GOKEY that Case No. WZ-00-02, a request for approval to rezone 0.76 acres from A-1, Agricultural, to PID, Planned Industrial Development, be APPROVED for the following reasons: 1) Proposed uses for the Planned Industrial Development have already been in the neighborhood for many years and are not expected to make significant changes or negative impacts to the surrounding property owners and/or property uses. 2) The rezoning request is consistent with changes in the character in the area. 3) Adequate infrastructure will be available to serve the site. Commissioner COLLINS stated that he felt uncomfortable about voting on an application that contains only a detention and drainage plan note. UMEMMMEEMM 1) The proposed uses for the Planned Industrial Development have already been in the neighborhood for many years and are not expected to make significant changes or negative impacts to the surrounding property owners and/or property uses. 2) The amendment to the Planned Industrial Development is consistent with changes in the character in the area. 3) Adequate infrastructure will be available to serve the site. With the following conditions: 1) The applicant will be required to construct curb, gutter and sidewalk along the Miller Street frontage of the property. Planning Commission Page 3 April 20, 2000 2) Upon request of the City, the area marked as reserved for future right-of-way be dedicated by applicant to the City. 3) The city attorney will approve the language and/or documents required by the zoning ordinance requirement for unified control. The motion passed 8-0. B. Case No. ZOA-00-02: An application filed by the City of Wheat Ridge to amend Zoning Ordinance Section 26-25 (IV)(B)(2)(b) to delete the minimum lot requirement necessary to obtain a zoning designation of Planned Commercial District (PCD), The case was presented by Alan White. He reviewed the staff report which recommended approval of an ordinance which would eliminate the one-acre minimum lot size. Commissioner SNOW stated that she would like to see a requirement for site plans. She also referred to page 1748.2 and suggested there should be a provision to allow a requirement for larger setbacks. Mr. White stated he would take her recommendation forward to City Council after discussing the matter with the city attorney. Commissioner GO KEY expressed concern that such a requirement could make the city more vulnerable to litigation. Commissioners TI- OMPSON and COLLINS felt the city should have some flexibility to place controls, especially in light of the many infill situations that exist in the city. The motion passed 8-0. CLOSE PUBLIC HEARING Chair MACDOUGALL declared the public hearing closed. 9. OLD BUSINESS Plannin- Commission ZL Page 4 April 20, 2000 Commissioner SNOW requested that, in the future, Planning Commission should not consider applications where the applicant makes up his own list of uses. She cited the Ficco case as an example. Commissioner THOMPSON stated that she would like an ordinance amendment that allow the imposition of increased restrictions in cases where C- I or RC zoning is located adjacent to residential uses. A. Planning Commission WorkshOD - There are two Commissioners planning to attend the workshop on May S. If others desire to attend, they should contact Alan White before May 1. B. Neighborhood Meetingi - Commissioner COOPER requested that staff reports inclull notes from neighborhood meetings. C. RV America - Commissioner THOMPSON expressed concern that transients are staying in the house on the property. Mr. White informed that the owner is planning to remodel the house into an office for sales and rental of RVs. D. Draingee Re arts - Commissioner SNOW stated that she did not believe it was the intent of the City Council's motion that Planning Commission is to no longer receive drainage plans in the packets, Mr. White will check the minutes of the Council meeting. He also informed the Commission that a representative from the Public Works Department will be present at future Planning Commission meetings. 11. The purpose of the variance request is to allow for the construction of an enclosed entryway vestibule within 20' of the Miller Street right-of-way, Two separate motions will be required. 11. CASE HISTORY In 1998, Compass Montessori began preliminary planning to occupy the farm market building on the western parcel as a Jefferson County charter school. In April 1998, a conditional use permit was granted to Compass Montessori for development of a children's playground on the eastern parcel (A -1 zoning district). See Exhibit 3, minutes of the April 16, 1998 meeting. In August 1999, Compass Montessori was granted a conditional use permit to expand classroom space into the existing building on the eastern parcel. This classroom occupied the structure which was formerly a single family home. See Exhibit 4, minutes of the August 5, 1999 meeting. SITE PLAN Application for a conditional use permit requires submittal of a site development plan. The applicant has submitted proposed elevations (Exhibit 5, Elevations) and a site plan for proposed improvements (Exhibit 6, Site Plan). The 10' side yard setback variance requested by the applicant applies to the west side of the existing school building at Miller St. The addition of an enclosed entryway vestibule is planned to provide a sheltered area for the west doors into the building. This addition would be constructed within 20'of the Miller St. right-of-way. Staff has received no objection to or public comment regarding this conditional use permit and variance request thus far. CE C RITERIA, Staff has the following comments regarding the criteria used to evaluate a variance request: 1. Can the property in question yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by regulation for the district i1r, which it is located? If the request is denied, the property may yield a reasonable return in service and income. The property is currently used for a school and this use may continue on the property, regardless of the outcome of the variance request. 2. Is the plight of the owner due to unique circumstances? — ------ - Vlarini n Commission rage a CUP-00-021Compass Montessori 3. If the variation were granted, would it alter the essential character of the locality`' Approval of this request would not alter the essential character of the neighborhood. The entryway would provide an enclosed waiting area for parents and students. 4. Would the particular physical surrounding, shape or topographical condition of the specific property involved result in a particular hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out? The school site is situated on 2 rectangular shaped parcels and the property is relatively flat. The inconvenience relating to the site comes from the placement of the farm market building on the 30' setback line. This situation leaves no other options for incorporating an enclosed entryway onto the west side of the building. 5. Would the conditions upon which the petition for a variation is based be applicable, generally, to the other property within the same zoning classification? Other property owners in the same zoning classification may request the same type of variance. However, each application is reviewed on a case-by-case basis and evaluated based on the circumstances pertaining to each request. Therefore, the outcome in each case may be different. 6. Is the purpose of the variation based exclusively upon a desire to make money out of the property The requested variance is not based on any desire to make money out of the property. The property is currently being used as a school and will continue to be used as a school, The purpose of the request is to construct an enclosed entryway at the west doors of the school building. 7. Has the alleged difficulty or hardship been created by any person presently having an interest in the property? The building being used to house the school was originally constructed to be used for a farm market. The applicant and owner, Compass Montessori, had • interest in the *roperty when the building was constructed. However, the required side yard setback 30 feet was in existence when property was purchased for the school facility. There are no other alternatives for locating an enclosed entryway at the west doors. 8. Would the granting of the variations be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located? Approval of this variance should not be detrimental to the public's welfare or injurious to other property or improvements in the area. The addition of the entryway would be an Planning Commission Page 7 CUP-00-02/Compass Montessori improvement to the facility which could be beneficial to noise impacts on the area by providing a protected waiting area for students and parents. There is no evidence of code complaints regarding this school facility. 9. Would the proposed variation impair the adequate supply of light and air to adjacent property or substantially increase the congestion in the public streets or increase the danger of fire or endanger the public safety or substantially diminish or impair property values within the neighborhood. Approval of the variance request would result in an individual benefit to the property owner and could also be considered a benefit to the neighborhood and comiminity. The closed entryway would provide a small safe area of assembly for entering and exiting students and parents, Approval of this request is not expected to result in the reasonable accommodation of a handicapped person. VIII. STAFF CONCLUSIONS AND RECOMMENDATION improvements shall be approved prior to commencement of construction. 3. All items listed in condition #2 above and landscaping shall be inspected and approved prior to occupancy of the building". He noted that a completed Building and Dumping/Landfill permit would be required prior to construction of the playground. Chair THOMPSON asked if the residence driveway would also be used for access to the school. W McCartney informed that the Commission could make a condition to the approval that the residential driveway not be used for access to the school. *iane Otten 1010 15th Street, Golden, CO Plannina Commission Page 3 04/16/98 In response to a question from Commissioner SNOW, Ms. Otten replied that the property is owned by Compass Montessori, Inc., but the school is funded by Jefferson Countv. She also noted that they plan to enroll 150 children and that there is capacitv for 180 children. Patricia Trapp 502 Park Court, Golden, CO Ms. Trapp was sworn by Chair THOMPSON. Ms. Trapp described the construction ♦ the playground stating that they do not plan to change the irrigation • the site and that a chain link fence would • c► ' nstructed between the playground and the Garranione residence. She informed that the playground must meet requirements set forth by the Department • Social Services and that she was agreeable to considering a single access from Miller Street into the school. I Commissioner GOKEY expressed concern about the increase in traffic which would result from transporting 150-180 children to and from the school and asked if a traffic impact study had been completed. Bob Goebel replied that the traffic engineer had assessed the situation and felt it was advisable to close the access from 44th Avenue because of the heavy traffic on that street. Ms. Trapp informed that starting times would • staggered and that school parking exceeded Jefferson County school standards. She also noted that the parents and directors of the school are very concerned about traffic safety. Commissioner COLLINS asked what the intended use of the Garramone residence would be, Ms. Trapp replied that, if they are able to purchase that additional property, the playground would be expanded and the house would become a part of the school. Commissioner GOKEY expressed concern that the School District is not accountable to the City as far as building permits, inspections, etc. are concerned. Chair THOMPSON asked why the school was requesting the conditional use permit instel- of the Garramone's who presently own the land in question. She stated that she was representing her mother, Helen Newdorp, who was concerned about the use • the playground during times the school was not in operation. Case No. ANX-98-3 and Case No. WZ-98-8: An application from Tom Hartley for approval of an annexation of the area approximately located at 13500 West 44th Avenue in the county of Jefferson and initial zoning of the area to PID. The case was presented by Martin Orner who stated that the applicant was requesting annexation to the City of Wheat Ridge of approximately 51 acres of undeveloped land located in Jefferson County. He informed that the applicant has requested zoning of Planned- Industrial District with a provision for two acres • commercial/retail land use. Planning Commission Page 2 August 5, 1999 EXHIBIT 4 Commissioner THOMPSON asked if it would be possible to put a condition on the CUP to require the school to seek rezoning for any future changes to the buildings. Alan White stated that it would probably • possible to place a condition that any further modifications than those allowed in the last CUP should be pursued as rezoning, but reminded her that rezoning would allow many other uses ♦ that property should the school ever leave. Commissioner THOMPSON expressed concern about the possibility of parents driving both ways on this driveway in cases of inclement weather, etc. and asked if the driveway is wide enough for two-way traffic. Mr. McCartney replied that the driveway is 15 feet in width and 22 feet is standard for two-way traffic. Commissioner DOYLE asked if modifications would meet fire codes and, also, how many children would be in the building. Ms. Sherk replied that the changes would meet fire code arl there are plans for twenty children to use the building. Commissioner THOMPSON expressed concern that, because it is a residential property whic will be used as a commercial piece of property, she would like to see controls on the access because of the nature of 44th Avenue. I Commissioner SNOW asked if a ramp would be installed in this building for disabled students, Ms. Sherk said their plans do not call for that at this time; however, the main building is entirely handicapped accessible and therefore. no children would be turned away from the school because of the lack of handicapped accessibility. In response to a question from Commissioner SNOW, Ms. Sherk stated that she is a parent of a Compass Montessori student. In response to a question from Commissioner COLLINS, Ms. Sherk replied that the R- I team inspected the building for asbestos and will remove any asbestos found. I Chair,BRINKMAN called a point of order and asked Commissioner GOKEY to limit discussion directly to the Conditional Use Permit. Commissioner GOKEY asked about the driveway., Mr. Fulton replied that he is confident the parents will comply with the school's request to avoid use of the driveway; however, the school would be willing to install a gate. Planning Commission Page 4 August 5, 1999 Commissioner COLLINS inquired about the school's income tax status. %Ir. Fulton replied that they are nonprofit and the status is 501(3)(C). Commissioner MACDOUGALL asked Mr. Fulton if he felt the school is at capacity with 200 students and if there were plans for future expansion. Mr. Fulton replied that, given the present facilities, they are at capacity and that they would like to build a multi-purpose room on the site some time in the future.
