Notice is hereby given of a public hearing to be held before the City of Wheat Ridge Board of Adjustment on March 25, 2004, at 7:30 p.m., in the City Council Chambers of the Municipal Building, 7500 W. 29th Avenue, Wheat Ridge, Colorado. 2. ROLL CALL 3. PUBLIC FORUM (This is the time for anyone to speak on any subject not appearing on the agenda.) A. Case No. WA-04-01: An application filed by Cheryl Wise for Copper Fields Events Chateau for approval of a 10 foot setback variance from the required 10 foot setback for a freestanding sign, resulting in a 0 foot setback for property zoned Commercial-One (C-1) and Industrial (I) and located at 4901 Marshall Street. SUBJECT: Board of Adjustment Meeting/25 March 2004 A dinner meeting has been scheduled for 6:00 p.m. on Thursday, March 18. Community Development staff and the City Attorney will be present to take any questions you may have regarding the public hearing process or specific questions involving previous cases that may have caused some confusion. STAFF CONCLUSIONS AND RECOMMENDATIONS Upon review of the above requests, staff" concludes that the above criteria are supportive of the variance request. Staff has found that there are unique circumstances attributed to this request that would warrant approval of a variance. Because of the unusually large setback on Marshall St., we are seeking a variance to allow us to install said sign with no additional setback. The Copper Fields Events Chateau is located at 4901 Marshall Street. Sign code requires the sign be ten feet back from the property line. We are asking fora variance of this code because DOT possesses the first thirty feet from the road. If the sign is installed ten feet from the DOT line, it would not be noticed from the road. Air '^ .t A4L 9 RKDARS YINr A LIMB W, CITY OF WHEAT RIDGE BOARD OF ADJUSTMENT Minutes of Meeting December 3, 2003 Board of Adjustment Page l 12/fl3/03 Board Member ABBOTT commented that the only issue the Board can address is whether the property can accommodate a duplex and asked staff to address the issues of parking, number of people living in the dwelling, etc. Travis Crane replied that Board Member ABBOTT was correct that the Board's decision should be based upon the square footage issue and whether or not the property could Board of Adjustment Page 2 12/03/03 support a duplex. The other issues, such as cars parking on the lawn, should not be a part of that consideration. If parking • other infractions occur, code enforcement would address those issues. He also noted that the Board has the flexibility to require certain conditions of approval such as delineating parking areas from landscaped areas. In response to a question from Board Member ABBOTT, Travis Crane stated that lie did not know how many neighborhood complaints have been made to code enforcement regarding this property. In response to a question from Board Member HOVLAND, Ms. Fieldman stated that she would have no problem with placing a concrete delineation between the public sidewalk and the driveway and a further delineation to prevent people from using her neighbor's curb cut to leave her property. Chair DRDA commented that there did not seem to be adequate proof of hardship in this case, Board Member ABBOTT stated that he believed the situation of backing out onto 32 nd Avenue is a hardship in that it presents a danger for both the person leaving the property and other drivers on 32" Avenue. He also commented that he would be opposed to the project if the fence were a solid wall, but the decorative cutouts in the fence make the substance of the wall to be within the four foot requirement. Board Member BLAIR commented that the proposed fence would not be inconsistent with other fence heights along 32 nd Avenue. - Upon a ► secona D—oard memMrJ, the following resolution was stated: Board of Adjustment Page 6 12/03/03 Whereas, the applicant was denied permission by an administrative officer; and Whereas, Board of Adjustment Application Case No. WA-03-22 is an appeal to this Board from the decision of an administrative officer; and Whereas, the property has been posted the fifteen days required by law, and in recognition that there were no protests registered against it; and Whereas, the relief applied for may be granted without detriment to the public welfare and without substantially impairing the intent and purpose of the regulations governing the City of Wheat Ridge.
