A. Case No. WA-04-03: An application filed by Crawford Holding Corp. for the
Estate of Rosemary & Pete Ricci for approval of a 206 square foot variance from
the 9,000 square foot minimum lot area requirement to allow a two-family
dwelling unit on property zoned Residential-Three (R-3) and located at
approximately 3 821 Otis Street.

I. REQUEST
The property in question is located at approximately 3821 Otis, or Lot 6 of the Anel Subdivision. The prope"I
has Residential -Three (R-3) zoning and is currently vacant with no structures on

11. SITE PLAN
The property is 8,794 square feet, or .202 acres. The property measures 76.83 feet wide, with a curvilinear
eastern property line creating a depth of 146.98 on the north and 93.2E on the south (See Exhibit 2, Survey).

Per the Code of Laws, the director of community development can approve, • deny variance requests of 10
percent or less from the development standards administratively, provided that no additional dwelling units
would result from the approval of the variance. This variance request is approximately 2 percent, however
approval • the request would result in additional units, therefore it is required to go to a public hearing before
the Board of Adjustment.

Staff has the following comments regarding the criteria used to evaluate a variance request:
1. Can the property in question yield a reasonable return in use, service or income if permitted to be
used only under the conditions allowed by regulation for the district in which it is located?
If the request is denied, the property may still receive a reasonable return in use. The property could be
developed as a single-family residence without the need for any variances.
2. If the variance were granted, would it alter the essential character of the locality?

S. Would the granting of the variance be detrimental to the public welfare or injurious to other
property or improvements in the neighborhood in which the property is located, by, among other
things, impairing the adequate supply of light and air to adjacent property, substantially increasing
the congestion in public streets or increasing the danger of fire or endangering the public safety, or
substantially diminishing or impairing property values within the neighborhood?
6. If criteria 1 through 5 are found, then, would the granting of the variance result in a benefit or
contribution to the neighborhood or the community, as distinguished from an individual benefit on
the part of the applicant, or would granting of the variance result in a reasonable accommodation
of a person with disabilities?
The request would not result in a substantial benefit • contribution to the neighborhood, although a
relatively unmaintained vacant lot would be developed. It is the opinion of staff that development of the

1. CALL THE MEETING TO ORDER
The meeting was called to order by Chair BLAIR at 7:30 p.m. in the Council Cham
of the Municipal Building, 7500 West 29 Avenue, Wheat Ridge, Colorado. I

Travis Crane stated that Board Member ABBOTT was correct in his understanding that
the entire existing structure is located four feet above the 100-year flood elevation.

5. The dwelling currently exists in its entirely in Zone AF of the floodplain so if
any of the "items to consider" would currently exist, they would also exist for
the addition.
6. The entire "main level", both living area and garage currently exist at four
feet above the flood plain level.
The amendments were accepted by Board Members BELL and MOLNAR. The
motion passed ".
5. CLOSE THE PUBLIC HEARING
Chair BLAIR closed the public hearing portion of the meeting.
6. OLD BUSINESS
