Case No. MS-97-2/Daddis Page 2 The applicant requests approval of a two-lot minor subdivision on property located at 4445 Parfet and 11050 West 45th Avenue. The property in question contains 13 acres and is "L-shaped" with frontages on both Parfet Street and West 45th Avenue. The purpose of the subdivision is for the sale and construction of a single family residence on the 45 Avenue parcel (Lot 1). ♦ the time of this writing, there are no specific plans for development on the Parfet Street parcel The property is split-zoned with Residential-Two zoning on the northern portion and Residential-Thre" zoning on the south. Lot 2 (southern lot) is-to011y encompassed with R-3 zoning where Lot I (northe lot) has R-2 zoning on the northern 150 f6et, with the southern 65 feet zoned R-3. Staff has indicated the location of the zoning boundary line in red pen on the plat. All minimum requirements of the R-2 and R-3 zone district have been met Based on lot width restrictions, only a single family residence can • built on Lot 1. There is a 75 foot wide Public Service Company casement which traverses the property restricting development on both lots. No permanent structures can be built within this easement, however, it can • used for driveways and landscaping with ornamental-sized trees. The prospective purchaser of Lot I is aware of the encumbrance on the property and has been designing the house layout accordingly. A 10 foot right-of-way dedication will occur for West 45th Avenue. No additional right-of-way is required for Parfet Street. Existing mature trees have been located on the plat. A note should be added that these trees cannot be removed unless in direct conflict with a building envelope. Despite legal description problems which need to be corrected prior to review • City Council, all requirements of the Subdivision Regulations have been met. Water mainlines are in Parfet and W. 45th Ave. to serve the property. If the property is used for development other than a single family residence, additional mainlines and hydrants may be needed to meet Arvada Fire Protection District requirements. Also, if additional lines were needed, the owner would need to provide the necessary right of way to the District. The cost of any additional water mains and fire hydrants would be the responsibility of the property owner. 2. No water taps or water service lines are currently servin the property.
