A set of these minutes is retained both in the office of the City Clerk and in the Department of Planning and Development of the City of Wheat Ridge. Planning Commission Page I April 5, 001 5. APPROVE MINUTES It was moved by Commissioner COLLI NS and seconded by Commissioner THOMPSON to approve the minutes of March 1, 2001 as presented. The motion passed 4-0 with Commissioners GOKEY, MILLER and WEISZ abstaining. 11. PUBLIC FORUM M There was no one to appear before the Commissil A. Case No. CUP-01-01: Application by Foothills Academy for approval of a Conditional Use Permit to allow expansion of a private school on property zoned Agricultural-One and Residential-Two (A) and located at 4725 Miller Street. Prior to her presentation, Meredith Reckert distributed copies of a letter received April 5. 2001, from Karen Heine expressing concern about traffic in the school area. This letter was made a part of the case file. Ms. Reckert reviewed the staff report and presented slides and overheads of the application. All pertinent documents were entered into the record and accepted by Chair McNamee. Staff recommended approval of the application with conditions as outlined in the staff report. Commissioner THOMPSON commented that she observed school traffic during student pick- up time. She expressed concern about unsafe practices such as making u-turns in the middle of the street and parked cars on 47 and Miller that obstruct sight triangles. She inquired as to whether traffic counts had been done on these streets that are designated as Class 6. Steve Nguyen informed that traffic counts are within the range for Class 6 streets. Ms. Faddick replied they have been working with Montessori on shared facilities and traffic mitigation and that there would probably be cooperation for shared parking, also. She also commented that the families involved with Foothills Academy are pleased with this plan, especially as it relates to traffic mitigation. In response to a question from Commissioner GOKEY. Mr. Dierschow stated that he has discussed his concerns with representatives of the school and found them to be very cooperative. He did believe, however, that they did not have a true understanding of the traffic impact on the neighborhood. He was in favor of eliminating parking on Miller Street. Chair McNAMEE referred to the speeding problem on Miller and asked if it would be possible to install flashing school signals on Miller. Steve Nguyen replied that there are school zone Planning Commission Page 3 April 5. 001 In response to a question from Commissioner GOKEY, Mr. Nguyen replied that a traffic island on Miller would be feasible. Commissioner COOPER commented that the island would 11111110=51= Commissioner COOPER asked about the neighborhood traffic management plan (NTMP) process. Mr. Nguyen explained that the process is started with a petition that must be signed by 75% of property owners. Petitions have been sent out to this neighborhood, but have not been returned. He was in favor of waiting until the 300-foot pick-up lane is installed to restrict parking or install traffic -cal mi jig devices. Chair McNAMEE asked if there were others present who wished to address the Commission. Hearing no response, she closed the public hearing. (Chair McNAMEE declared a recess at 8:45 p.m. The meeting was resumed at 9:00 p.m.) It was moved by Commissioner THOMPSON and seconded by Commissioner GOKEY to approve Case No. CUP-00-01, a request for a conditional use permit to allow expansion of a private school in an A-1 and R-2A zone located at 4725 Miller Street for the following Commissioner COOPER offered an amendment to add condition no. 10 which would require redesign of the plan to add additional parking spaces for the school vans. The amendment was accepted by Commissioners THOMPSON and GOKEY. Commissioner GOKEY offered an amendment to add condition no. 11 which would require vertical landscape buffering between the school property and adjacent houses. The amendment was accepted by Commissioner THOMPSON. Planning Commission Page 5 April 5, 2001 The motion passed unanimously. B. Case No. ZOA-01-01: An ordinance amending Article 11 of Chapter 26 of the Wheat Ridge Code of Laws concerning the addition of a Conservation Zoning District. Chair McNAMEE asked if there were any individuals present who wished to address this ordinance. Hearing no response, she closed the public hearing. Commissioner COLLINS commented that the proposed ordinance, even though there are some flaws, is better than R- ) zoning for the greenbelt. In response to a question from Commissioner THOM PSON, Mr. Dahl replied that property owners have options of placing conservation easements on their property: leaving the property unimproved regardless of zoning or requesting a conservation district zone. Commissioner THOMPSON expressed concern about control of noxious weeds in conservation areas. Mr. Dahl will check to see if this is covered in the weed ordinance. Commissioner GOKEY suggested that the word "pristine" be used to describe property that can be zoned as conservation district. He expressed concern that once a property is zoned as conservation, it would be difficult to have it rezoned for any other reason. Mr. Dahl explained that this zoning is no different than any other where a property owner can request a rezone. Commissioner GOKEY also expressed concern about a possible mass rezone to conservation district. Mr. Dahl commented that a city cannot downzone to leave a property with no economic benefit. He also advised that the ordinance could contain wording that property can only be changed to conservation at the owner's initiation. Chair McNAMEE expressed concern about the possibility that benches, trails, etc., would not be allowed in the greenbelt under this ordinance. Commissioner THOMPSON stated that she Planning Commission Page 6 April 5, 2001 did not believe the greenbelt and Dena Gulch would fall under the intent of this ordinance and suggested that the greenbelt could be designated as a combination of conservation area and park. Do W IN The Commission reached a consensus to support option no, 5 in the memorandum that is to stay the course. The city would continue to require owners to prove the second unit was lawfully established. If no proof was provided, the unit would need to be removed or the structure altered so that it was not a separate unit. However, situations should be considered on a case by B. Comnrehensive Plan - Commissioner THOMPSON suggested that the color designated on the Comprehensive Plan for Foothills Academy is in error and should be changed. This should be changed from red (Community Commercial Center) to yellow (single family - not to exceed 6 du's/acre) to match surrounding properties. Meredith Reckert suggested that this change be considered during the annual review of the Comprehensive Plan. COMMISSION REPORTS There were no commission reports. COMMITTEE AND DEPARTMENT REPORTS There were no committee or department reports. PC Staff Report Page l May 3, 2001 The applicant requests approval of a preliminary and final subdivision plat for property located at 9737 West 32' Avenue. This application also includes a request for approval of a variance to the maximum cul-de-sac length specified in the Subdivision Regulations. Pursuant to Section 4-13-5 of the Subdivision Regulations, "cul-de-sac centerpoints shall not be, longer than 500' from the centerline, intersection of streets serving the subdivision". See attached Exhibit 'A' which are minutes from the November 2, 2000, public hearing, Planning Commission has requested that land use cases not be published for public hearing until all outstanding items have been resolved, In this case. while there are minor issues with the plat document, tile drainage report and other civil drawings need substantial modification. This case was set and published for Planning Commission public hearing at the direction of the acting City Manager. The applicant has requested that certain correspondence be included in the packet. This correspondence has been included as Exhibits *13% 'C' and 'D, The property is currently zoned R- 1, Residential-One, is comprised of two parcels and has an existing house located on the southern portion of the western lot, The remainder of the property is vacant. The property has a substantial grade change with over a 45drop from the southern boundary (adjacent to West 32"' Avenue) to the northern limits. At the steepest point (roughly midway), the grade is 7%, The Rocky Mountain Ditch defines the northern boundary of the property. The applicant has submitted both a preliminary plat and a final plat which show a ten-lot, single family residential design accessing West 32 Avenue via,a cul-de-sac bulb, The plats contained in this packet are substantially the same documents reviewed by Planning Commission on November 2, 2000, However, since the past review by Planning Commission, the storm water drainage system has been redesigned to run along the north subdivision boundary, cross under the Rocky Mountain ditch and proceed through a residential property PC Staff Report Page 2 May 3. 2001 IV. AGENCY REFERRALS The Wheat Ridge Fire Protection District has requested a 50' radius for the cul-de-sac bulb if on-street parking is desired. This has been incorporated into the final plat. The Westridge Sanitation district approved a request by the developer to extend a sewer main over to Independence as there is no sanitary sewer in West 32' Avenue. The developer negotiated with the property owner of 3395 Independence Street to purchase an easement across his property for extension of the main along the south side of the existing home, This sewer line has already been installed, Consolidated Mutual Water District can serve the property with a mainline extension from West ,32 "d Avenue. VARIANCE The applicant is requesting a 122.9 F variance to the 500 maximum cul-de-sac provision in the subdivisil regulations. This standard is in place primarily • address emergency access issues and to encourage an integrated public street system instead of a series of unconnected cul-de-sac bulbs throughout the city. Staff has the following comments regarding the criteria used to evaluate a variance request. (The criteria used are from the old code since this application was submitted when it was in effect.) I. Can the property in question yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by regulation for the district in which it is located? The property can still be used if the variance is not granted. However, the resulting subdivision may have an inefficient design and would probably require the use of flag lots which are discouraged. 2. Is the plight of the owner due to unique circumstances? 3. If the variation were granted, would it alter the essential character of the locality? Granting of the variance would not alter the character of the area, Cul-de-sacs serving adjacent subdivisions both exceed 500' in length. To the west. Jellison Street was dedicated in 1970 as part of the Wheat Ridge Knolls Subdivision and is 712' in length. Independence Street within Davo Subdivision was platted in 1952 and is 92- in length. The 5170' cul -de -sac restriction has been in the subdivision regulations since original adoption in 1972. An alternate design could have been to make a connection to either Jellison or Independence Street. Although there are no vacant lots to either the east or west, the applicant could have purchased a homesite and demolished the house to make room for the connection. Staff believes that this scenario would have had a negative impact on the residents adjacent to the street intersection. 4. Would the particular physical surrounding, shape or topographical condition of the specific property involved result in a particular hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out? The property has unique physical attributes in regards to length of the property (over 700') and the slope (about 7%). PC Staff Report Page 4 May 3, 2001 5. Would the conditions upon which the petition for a variation is based be applicable, generally, to 'the other property within the same zoning classification? 6. Is the purpose of the variation based exclusively upon a desire to make money out of the property? Lengthening the cul-de-sac maximizes the number of developable lots within the development. Fewer lots could be created without the variance, PC Staff Report Page 5 May 3, 2001 Staff has concluded that while the requirements specified in the subdivision regulations have been met for the preliminary and final plat documents, the supporting technical information and documents requested by the city Public Works and Building Departments have not been finalized and reviewed. Because of the severe slope of the property, staff has concluded this additional information is crucial not only for the welfare of potential buyers but for adjacent property owners as well. Planning Commission has three options with this request: 1) approve the request with a list of conditions, 2) continue the hearing and request the additional information, or 3) deny the request. Recommended motions have been provided for each option. The three options have been listed alphabetically and are not meant to constitute a preterence staff. Mr, Carl is general manager of a firm which is located adjacent to the subject property. He spoke in favor of the application and felt it would be an improvement to the neighborhood. It was moved by Commissioner DOYLE and seconded by Commissioner COLLINS that Case No. MS-00-06, a request for a two-lot minor subdivision for property located at 47- Independence Street be APPROVED for the following reasons: I 1. Ms. Reckert stated that a homeowners association would be required to maintain landscaping along 32nd Avenue right-of-waN% detention pond and the access easement to the detention pond. I Garcia explained that it would contain a I 00-year-storm and release at historic flows. Negotiations are in process between the developer and the Rocky Mountain Ditch Compan regarding release • storm water into the ditch. Dennis Bearnis 6998 Robb Street, Arvada In answer to a question from Commissioner COLLINS as to how the water would flow to the retention ditch. Mr. Beamis stated there would be a piping system as well as the use of swales Commissioner THOMPSON asked who would be responsible for maintaining the drainage systems. Mr. Beamis replied it would be the responsibility of the homeowners association and that the drainage system should be cleaned when sediments become apparent. Commissioner SNOW asked what the water depth would be in the detention pond. Mr. Bearnis replied that it would be approximately five feet deep for a 24-48 hour period during a I 00-year storm, A I 0-year storm would be approximately three feet deep. draining within 10- 1 2 flours. Five year storm water would be retained in the underground detention, Chair MacDOUGALL expressed concern that flooding of the Rocky Mountain Ditch would cause problems for the lots on the north side of the ditch on 3 )4th Avenue. Commissioner THOMPSON asked how the proposed subdivision compared with the subdivision on Jellison in regard to topography and grading. Mr. Beamis stated they would be Commissioner SNOW asked if building footprints have been submitted to the city. Mr. Beam replied that these had not been requested by the city. In response to a question from Commissioner McNAMEE. Mr. Be is stated there is no unstable Land in the subject area. Staff also indicated they were not aware of any unstable land. Commissioner THOMPSON asked if fewer developed lots would mitigate the drainage issues. Mr. Goebel replied that any reduction in impermeable surfaces would reduce the amount of runoff. Planning Commission Page November 2, 2000 Gerald Dahl explained that the developer must satisfy the city's drainage requirements regardless of an agreement with the ditch company. The question is whether or not the Commission feels they have adequate information to make a decision. He advised that any continuance should be a continuance of the hearing rather than just continuing it for action to give opportunity for more testimony. 3333 Independence Street Ms. Goldfarb was sworn in by Chair MacDOUGALL. She has lived at this address for 41 years and testified there have been many flooding problems in the area and the area of the proposed development is wet most of the time. She expressed concern that the development will cause more runoff into her neighborhood. John Gammon 3305 Independence Court Mr. Gammon was sworn in by Chair MacDOUGALL. He has lived at this address for 8 years. He expressed concern that the development would increase drainage into his property which already experiences many drainage problems. Commissioner GOKEY asked Mr, Dee's opinion about the possibility of building walkout basements or basements if the water table is high in this area. Mr. Dee replied that this would depend upon the permeability • the soil. IW IL-72 lumIlLmlow"lugg P A IIIIIII Dave Oldham 3232 Jellison Mr. Oldham was sworn in by Chair MacDOUGALL. He purchased his home three years ago and is aware of three homes on Jellison that flood occasionally. There are three swampy areas Planning Commission Page 7 November 2, 2000 on the adjacent property and he expressed concern about more drainage coming onto his property. He expressed further concern about maintenance of the detention pond, He stated that he is a homebuilder and would not build on the property without doing a lot of subexcavation and installing proper drainage systems, He also expressed concern about the steep slope of the street in regard to icy winter conditions. Bob Goebel commented that the Clean Water Act requirements would not apply to cities under 100.000 until sometime around 2003 ) . Planning Commission Page 8 November 2, 2000 Commissioner GOKEY asked which lots would have the option of having walk-out base mients. Mr, Bearnis replied that lot 7 would be the only walk-out. Lots 3 through 6 and 8 through 10 could possibly be garden level. In response to a question from Commissioner'SNOW, Alan White explained that the length of the cul-de-sac affects the design of the subdivision. It would be an option for the Commission to take action on the variance at this meeting. Meredith Reckert commented that the drainage plan would have to be revised again if the request,for variance is denied. Commissioner COLLINS stated that he would not support the motion because there is not enough information at this time in regard to drainage issues. The motion failed bv a vote of 5 to 3 with Commissioners COLLINS, COOPER and DOVLE voting opposed. (A motion to approve a variance would require a super-' majority of 6 affirmative votes.) Commissioner COOPER indicated that she voted against the motion for the same reason stated by Commissioner COLLINS, F" , -ommissioner SNOW suggested that it might be appropriate to reconsider the motion regarding the variance because she should have made a motion to continue. Commissioner COOPER moved and Commissioner GOKEY seconded to reconsider the motion on the variance. The motion passed unanimously. Commissioner SNOW moved and Commissioner THOMPSON seconded that the reques for approval of a 123-foot cul-de-sac variance on R-I zoned property located at 9737 We 32nd Avenue be continued to a date uncertain. The City is in receipt of the storm sewer easement for the parcel between the Rocky Mountain Ditch and W. 34th Drive. This document is under review and any subsequent comments will be required to be completed. 2. Please include "Exhibit A" and "Exhibit B" that is referred to in the License Agreement submitted between Rocky Mountain Ditch Company and Applewood Building Company, Inc. 3. Since the previous submittal, a storm sewer has been added as well as drainage designed along the Lot lines. Therefore, ALL of the Utility Easements indicated on this plat are to be designated as Drainage AND Utility Easements. 4. The storm sewer along the North end of Lot 7 needs to lie within a Drainage and Utility Easement.
