It was moved by Commissioner SNOW and seconded by Commissioner THOMPSON to approve the agenda as amended. The motion passed 6-0 with Commissioners COLLINS late and BRINKMAN absent. 5. APPROVE MINUTES It was moved by Commissioner SNOW and seconded by Commissioner COOPER to approve the minutes of September 6, 2001 as presented. The motion passed 5-0, with BRINKMAN absent. 6. PUBLIC FORUM There was no one to appear before the Commission. A. Case No. MS-t 1: An application • Ryan Schacklett for approval of a two-lot minor subdivision plat ♦ property zoned Residential-One (R-1) and located at 12225 West 35" Avenue. Commissioner COOPER asked if the proposed lots would be similar in size to others in the neighborhood. Ms. Austin replied that there are mixed lot sizes in this neighborhood. These lots will be as large as others in the area but not as large as some of the surrounding parcels. Will meet a proven public need in that it will fill a void in necessary services, products or facilities especially appropriate at the location proposed, considering available alternatives. Staff cannot determine whether the proposed espresso kiosk will fill a void in products and services available in this area. There is a similar freestanding kiosk in the 4300 block • Wadsworth Blvd. which seems to be quite successful. Traffic counts • Wadsworth in that vicinity are roughly 42,000 vehicles per day, Vehicles per day on West 44 Avenue are one third that amount. 2. Will not have a detrimental effect upon the general health, welfare, safety and convenience of persons residing or working in the neighborhood of the proposed use. The proposed kiosk could contribute toward the convenience of persons living and working in the neighborhood. 3. The kiosk would be erected in an area of the parking lot which is rarely used. There is adequate circulation room around the kiosk for vehicle stacking and maneuverability. 7. Will be appropriately designed, including setbacks, heights, parking, bulk, buffering, screening and landscaping, so as to be in harmony and compatible with the character of the surrounding areas and neighborhood, especially with adjacent properties. The proposed coffee kiosk will ♦ located in a paved parking lot, oriented toward West 44 Avenue. There should be no impact on adjacent properties. Land uses immediately adjacent to the kiosk include a vacant car repair facility to the east and the rear of a family restaurant on the west. V. Will not overburden the capacities of the existing streets, utilities, parks, schools and other pubIM facilities and services. I This pre-fabricated, self-contained building will have no impact on utilities. An electrical drop will be needed for power to it. Patronage will be primarily captured from cars passing by on West 44 Avenue a*d shon at the antigue mall. A small amount of destination oriented traffic may occur as a result of this amenity. There is adequate capacity on West 44' Avenue to handle any additional traffic generated. 9. History of compliance by the applicant with Code requirements and prior conditions, if any, regarding the subject property. There has been previous zoning code enforcement action • the property. The most recent violation it for junk behind the building which was not attributable to the tenant or property owner, but random dumping. Planning Commission Page 4 WZ-00-09/AutoNation The landscape plan proposes a total of 1,660 tree/shrub specimens. This exceeds the code ref,uirements for a commercial site, AdditionallVnar - M* - *T17 beds. The tree and shrub specimens meet or exceed code requirements for minimum size. Based on 1,699 feet of frontage along Wadsworth Ave., W. 35h Ave., and W. 36' Ave. a total of 57 street trees are required. These street trees are required to be placed within the minimum front yard setback. The landscape plan shows 55 street trees within this setback. Ornamental trees do not qualify as street trees, All landscaped areas will be irrigated. Shrub and plant beds will be covered with a minimum depth of 3" of mulch. Wetland Area A wetland has been designed for the site along the western edge of the property. It is shown on the FDP site plan and landscape plan and is incorporated into the drainage plan and report, This wetlands area with its associated vegetation serves as a landscape buffer for the adjacent residential uses. A court stipulation from 1998 requires construction • the wetland. A letter from the Army Corps of Engineers (Exhibit 6) has indicated they are no Ion 4-a.,rt. for the wet not monitor establishment of it. According to the court stipulation, improvements are required to be Planning Commission Page 5 WZ-00-091AutoNation completed for the wetland feature within 90 days after final approval of the FDP by City Council. Signage Signage for the property includes two monument signs placed in landscaped areas. One is located near the comer of Wadsworth Blvd. and W 35 Ave., and the other is located where W. 36t Ave. meets Wadsworth Blvd. These signs are located outside the required sight triangles. Wall signs will be mounted to the building, as shown on the sign plan. These signs comply with the City's sign code limitations. The proposed directional signs meets size limitations and will not need a permit. V. FINAL PLAT The final plat creates two lots. The property is currently vacant and fronts on Wadsworth Blvd. and Ave. This is a minor subdivision with public street dedication and as such, requires action by both Planning Commission and City Council. Street dedication as reflected on the plat meets the requirements of the Public Works Department. That portion of the site reserved for the wetlands area is also shown on the plat. Wheat Ridge Fire Protection District will serve the property with improvements at the applicant's expense. The Public Works Department has approved a drainage report and plan for the site. No approval of the drainage plan has been received from CDOT. Without that approval it is not known whether or not there would be impacts to the design of the site. Water on site will drain to the wet�land area, Water will be released on a delay from the wetland area into a storm sewer pipe in Yukon Ct. that flows into the existing storm sewer located in W. 38th Ave. Public improvements will be required along all Elway street frontages of Wadsworth Blvd., W. 35' Ave., and W. 36 Ave. At this time the City has received no approval from CDOT for the proposed Wadsworth Blvd. improvements. Furthermore, the City has no indication whether or not the improvements are acceptable, at least in concept. This may affect the final right-of-way dedication and street design. The City must have a response from CDOT before the plans can be finalized for the CDOT permitting No= Staff concludes that there are critical outstanding issues relating to this project. CDOT approval for any of the elements of the project is a crucial missing component. Recreational Vehicle Ancillary Storage Areas. Chapter of the Wheat Ridge Code of Laws is amended by the addition of a new Section 26-628.1, to read as follows: 1 The property must be contiguous and immediately adjacent to the property upon which is located the recreational vehicle sales lot which the ancillary storage area is proposed to serve. 2. The property must be owned by the same person wh owns the recreational vehicle sales lot. 3. The property shall not have a residential zone designation. 4. The property may be used only for storage of unsold inventory recreational vehicles, which vehicles must be owned by the owner of the adjacent recreational vehicle sales lot. 5.
