It was moved by Commissioner BRINKMAN and seconded by Commissioner COLLINS
to approve the minutes, of October 18, 2001 as presented. The motion passed 7-0 with
Commissioner THOMPSON absent.
6. PUBLIC FORUM
There was no one to appear before the Commission.
A. Case No. Z -01 -0 7. An application submitted by Semper Development for approval
of a final development plan and subdivision plat for property located at 12700 West
32" d Avenue.
Alan White presented this matter and requested continuance because adequate informati
regarding drainage had not been supplied to staff for a complete review. i

B. Case No. ZOA-01-04: An ordinance amending Section 26-303.A of the Wheat Ridge
Code of Laws allowing Planned Residential Developments (PRD's) to be less than one
acre in size.
Commissioner SNOW questioned why someone would want to rezone a legal nonconforming
use. Alan White stated that since a nonconforming structure cannot be enlarged or altered
unless it is single family
• duplex, thii ordinance would allow a multi-family property to be
brought into conformance so improvements could be made to the property. For example, the
Housing Authority might want to increase the salability of a property by adding carports, etc.
In response to a question from Commissioner COOPER, Alan White replied that the ordinance
would be somewhat cumbersome in that zoning maps alone would no longer be sufficient to
tell what the requirements are on a PRD. It would be necessary to go to additional documents
such as the recorded plans, minutes, ordinances, etc.

Commissioner SNOW expressed concern that the ordinance would allow every owner of an
3 lot with apartments on it to request a PRD and add a unit or two. I

higher density properties into residential neighborhoods.

3. The Comprehensive Plan clearly denotes two different types of planned residential
development, one not to exceed twelve units per acre and the other not to exceed
sixteen units per acre, and the proposed ordinance would sidestep the future land
use designated in the recently adopted Comprehensive Plan.
The amendment was accepted by Commissioner COOPER and the motion passed 7-0
with Commissioner THOMPSON absent.
C. Case No. ZOA-01-07: An ordinance amending Article 11 of Chapter 26 of the Wheat
Ridge Code • Laws ' concerning the addition of a Planned Mixed Use Development
District (PMUD)

Commissioner SNOW expressed concern that the streetscape and architectural design manual
contains mixed use,-Nvhen so much effort was put into getting rid of the multiple land use in the
Comprehensive Plan. She also expressed concern about the fifty foot height limitation.

PMUD. He replied that it should be workable with 35 feet.
In response to a question from Commissioner COOPER, Alan White stated that if a project
would not fit into PRD or commercial, the PMUD would come into play.
Commissioner PLUMMER suggested modifying present regulations to allow development
with residences built above commercial. He would like to see the city have flexibility with this
type of development without having to come up with a new ordinance.
8. OLD BUSINESS
There was no old business to come before the Commission,
9, NEW BUSINESS
A. Commissioner BRINKMAN announced that she would not be present at the next
Commission meeting.
B. Alan White announced that Marilynn Force has been selected as the new Economic
Development Director for the city and will be starting early December.
10. COMMISSION REPORTS
There were no commission reports.
12. ADJOURNMENT
It was moved by Commissioner SNOW and seconded by Commissioner COLLINS to
adjourn the meeting at 8:40 p.m. The motion passed unanimously.

The property is within the City of Wheat Ridge, and all notification and posting requirements have been
met, therefore, there is jurisdiction to hear this case.
II. CASE ANALYSIS
The properties in question are a combined 104,695 square feet in area. The current zoning is Restricted
Commercial for the area identified on the plat as "Lot 1", and Commercial One for the area identified
as "Lot 2" (Exhibit 5, Vicinity Map).

A streetscape easement will be dedicated on 32 d Avenue adjacent to Lot I with the final plat. The
required right-of-way for the remainder of 32 d Avenue and the Youngfield Street frontage will be
reserved for dedication at the time Lot 2 is developed, There is a functional cross access agreement in
place which grants access

Drainage ,
Drainage has been reviewed and approved by the Public Works Department. The applicant plans on
using underground detention which releases at an acceptable rate into the City storm sewer. Site
conditions will be greatly improved when this property develops because all run-off will be controlled
and minimized.
Architecture
The building will be constructed out of brick, and will utilize complementing colors as accents. The
entrance at the northwest comer of the building is situated at an angle, contains a canopy'and is higher
than the main building to create added interest.
Final Plat
The final plat meets all standards set forth in Chapter 26. Staff recommends that an access easement
which provides vehicular access to the cell tower be relocated.

The City Attorney has opined that a Special Use Permit for the drive through is not necessary. Included
with the PCD approval is the drive through for the Walgreens only. t drive through uses
would require a Special Use permit.
Staff concludes that the proposed use is consistent with the Preliminary Development Plan, and all

Properties will be acquired and platted into two (2) legal lots. The ownership entity is
anticipated to be a limited liability company or corporation.
MGMUMM
A preliminary development plan has been submitted which enumerates uses, setbacks,
landscape percentages, etc. for the property.
The vacant Diamond Shamrock and Day Care will be demolished for the development
a Walgreens, drug store. The current plans for Walgreens anticipate a first class
development that will utilize creative site design, high quality architecture and building I
materials, and attractive landscaping within the site and adjacent to the residential
neighbors on the east and south.
To accomplish compatible development with adjacent commercial, residential and/or
industrial land uses through proper land use transitions and buffering techniques.
2. To promote flexibility in design and permit diversification in the location of

3. To promote the efficient use of land to facilitate a more economic arrangement of

The applicant requests approval of a three-lot minor subdivision on property located at 9733 West 32nd Avenue,
H. SUBDIVISION DESIGN
The property is zoned R-1 and has an existing single family home on it, The property is bordered on two sides

August 13, 200 1 . Attached as Exhibit 'A' is a reduced copy of the plat.
The proposed second filing will obtain access from Iris Court as platted by Applewood Preserve. No access will
be allowed from Lot I to West 32 Avenue via a note on the plat. The second filing will tie into the drainage
system for the adjacent subdivision which was designed to accommodate excess storm water capacity, The new
lots will also utilize the sanitary sewer improvements completed by the developer of that project.
At the time of this writing, the owner has not decided whether the existing house will remain or • demolished.
See attached Exhibit '13' which is a site plan for development. If the existing house remains, it will be contained
within Lot 2 with setbacks meeting the R-I standards. Included on the site plan are existina, mature trees which

will be saved. This site plan will be incorporated into the recorded plan set as a second sheet.
Staff has instructed the developer to prepare homeowner's covenants to include provisions for maintenance of
the drainage structures and sanitary sewer improvements not located in city right-of-way. The covenants must be
reviewed by staff and the city attorney prior to recordation of the plat.
All minimum standards of the R- I zone district regulations have been met or exceeded. All requirements of the
Subdivision Regulations have been met.
A meeting for neighborhood input was held on October 10, 2001. Attached as Exhibits 'C' and 'D' are a
synopsis of the meeting and a sign-up sheet.
The property owner to the east at 9625 West 32"d Avenue has voiced concerns over the development of the
property.
IV. AGENCY REFERRALS
All agencies can provide service with improvements completed at the developer's expense,
Public Works has approved a drainage report allowing this subdivision's storm drainage to flow to the street and
then continue north into the detention pond on Tract A of Applewood Preserve Subdivision. The installation of
