5. APPROVE MINUTES
It was moved by Commissioner SNOW and seconded by Commissioner COLLINS to
approve the minutes of November 15,2001 as presented. The motion passed 5-0 with
Commissioner BRINKMAN abstaining and Commissioners PLUMMER and WEISZ
absent.
6. PUBLIC FORUM
There was no one to appear before the Commission.
A. Case No. MS-01-03: Reconsideration of condition of approval of Scott Subdivision.

to vote on this case.
It was moved by Commissioner COOPER and seconded by Commissioner McNAMEE to
approve Case No. MS-01-03 with all conditions previously stated with the exception of the
cost sharing condition.
Commissioner SNOW stated she would not support the motion because, in the past, when

B. Case No. WZ-00-09 (continued ftom October 4, 2001): An application by John El
Autonation for approval of a preliminary and final development plan and final plat to
property zoned Planned Commercial Development (PCD) and located at 3501
Wadsworth Boulevard for the purpose of operating an automotive dealership.

E. Case No. WS-01-02: An application submitted by Dan Turgeon and James Turgeon
for approval'of combined six-lot preliminary subdivision plan and final subdivision plat
for properties zoned Residential-Two (R-2) and Residential-Three (R-3) and located at
11680 and 116•0 Wet 46 Avenue.
Cases No. WZ-01-03, WZ-01-04, and WS-01-02 were presented • Meredith Reckert. S�
reviewed the staff reports, entered all pertinent documents into the record and advised the
Commission there was jurisdiction to hear the case. Slides and overheads of the subject
property were presented. Staff recommended approval of the cases for the reasons and wil
conditions outlined in the staff report. I

Commissioner SNOW asked if there would • a homeowners association who would be
responsible for maintenance of drainage structures. Bob Goebel explained that owners of those
properties containing drainage easements would be responsible for maintenance.

Ms, Stewart was sworn in by Chair THOMPSON. She spoke in favor of the applications. She
requested approval of the third speed bump on West 46 Avenue east of the West 46�
intersection.
With the following condition:
1. The removal of the 1980 condition be effective only upon approval of Case No.
WZ-01-04, the rezoning from R-3 to R-2 on vacant property south of 11680 and
11690 West 46' Avenue.
The motion passed 6-0, with Commissioners PLUMMER and WEISZ absent.
It was moved by Commissioner COLLINS and seconded by Commissioner SNOW to
approve Case No. WZ-01-04, a request for approval of zone change from Residential-
Three to Residential-Two for vacant property located south of 11680 and 11690 West 46
Avenue for the following reasons:
1. The rezoning to,R-2 is generally consistent with land use and zoning in the vicini
2. It is closer to conformance with the land use designation specified in the
Comprehensive Plan than the existing R-3 zoning.
3. The neighborhood is generally in support of it with theproposed platting for
duplexes. I

F. Case No. WZ-00-12: An application submitted by Skitzo Offshore LLC dba Trailer
Source for approval of a rezoning from Agricultural-One (A-1) and Planned
Commercial Development (PCD) to Planned Commercial Development (PCD) and for
approval of an outline development plan. Said properties are located at 4651 Tabor
Street, north of 4651 and 4601 Tabor Street.

Commissioner BRINKMAN asked if the 1500 separation between car and boat sales lots
applied to this case, Meredith Reckert explained that this application was processed under the
old regulations and therefore does not apply.

Mr. Blumenthal, was sworn in by Chair THOMPSON. He stated that Trailer Source
improved a run-down area since taking ownership in 1995. Many hours have been spe

consulting with city representatives and neighbors to arrive at the proposed applicati I

Commissioner SNOW inquired about truck sales. Jim Blumenthal stated that they typically
purchase about two trucks a year which are customized to match horse trailers. They have sold
less than ten trucks in the past five years and the trucks are stored in an indoor showroom.
In answer to questions from Chair THOMPSON, Jim Blumenthal stated there would be no
issue with restrictions on painting and body work, other than pounding out some dents. He also
stated there is no reason to store semi's other than the one owned by Trailer Source.
J.R. Blumenthal stated that the detention pond would be delineated with rocks to prevent
parking in the detention area.

At 11:00 p.m., Chair THOMPSON asked if the Commission wished to continue the meeting.
It was moved by Commissioner SNOW and seconded by Commissioner McNAMEE to
continue the meeting. The motion passed unanimously.

Commissioner COLLINS stated he would vote against the motion because the proposal does
not fit the Comprehensive Plan and it will just add additional trailer sales in the area. Although
it may improve delivery of the owner's supplies, that should not be up to the city to correct.
The motion passed 4-2 with Commissioners COLLINS and ►RINKMAN voting no and
Commissioners PLUMMER and WEISZ absent.

City Council directed staff to brim this ordinance back to Planning Commission for a
recommendation, Council has adopted the ordinance on first reading. Second reading is set for
January 14 21142.
Attached are the ordinance, my memo from the first time this was brought to Planning
Commission, and the minutes of that meeting.

WHEREAS, pursuant to Colorado Revised Statutes of Section 23-23-301, the City

WHEREAS, the city has identified desirable future land use in certain areas within the
City as "Mixed Use" in the Streetscape and Architectural Design Manual; and,
WHEREAS, the City has regulations pertaining to Planned Residential Development
and,Planned Commercial Development Districts, but neither zone district has adequate
provisions for a true mixed use development within the City.

Section 1. Chapter 26 of the Wheat Ridge code of Laws is amended by the addition of
the following Section 26-306.5, which shall read in its entirety as follows:

D. Lot Coverage: No maximum,
E. Density: As permitted by approval of the preliminary development plan.
F. Landscaping: No minimum coverage. Landscaping shall be consistent with Section 26-
502.
H. Fences and Walls: As specifically detailed on the approved final development plan,
otherwise follow requirements of section 26-603.

follow requirements of Article VIL
Section 3. Severa• ility. If any clause, sentence, paragraph, • part • this Zoning Code

In a PRD, the amount of commercial space is limited to 25% of the lot area. Similar to the above
allowed and the number of units allowed.
The result is that under the current regulations mixed uses become arbitrarily restricted and
economically infeasible.

perhaps the best alternative. The restrictions on PRD's and PCD's should probably remain as
they are in the Code now so that PRD's remain primarily residential, and PCD's remain
cortmercial.
Consideration • the proposed ordinance has been noticed as a public hearing. A
recommendation to City Council is requested. Staff recommends approval.

C. Case No. ZOA-01-07: An ordinance amending Article 11 of Chapter 26 of the Wheat
Ridge Code of Laws concerning the addition of a Planned Mixed Use Development
District (PMUD)
This case was presented • Alan White. He reviewed the staff report and stated that proper
notice had been given for the hearing of this ordinance. A development has been proposed to
the city that would combine commercial on the first story with residential units above. The
1 - troposed ordinance would address such development.
Commissioner BRINKMAN commented that the Comprehensive Plan supports the concept of
combining commercial and residential.
Commissioner SNOW expressed concern that the streetscape and architectural design manual
contains mixed use when so much effort was put into getting rid of the multiple land use in the
Comprehensive Pl She also expressed concern about the fifty foot height limitation.
A suggestion was made that wording be included to limit density to that of a PRD.
Commissioner BRINKMAN asked Alan if he thought the height limitation would work against
PMUD. He replied that it should be workable with 3 5 feet.
Commissioner PLLTMMER suggested modifying present regulations to allow development
with residences built above commerciall He would like to see the city have flexibility with this
type of development without having to come up with a new ordinance.

A. Commissioner BRINKMAN announced that she would not be present at the next
Commission meeting.
B. Alan White announced that Marilynn Force has been selected as the new Economic
Development Director for the city and will be starting early December.
