Notice is hereby given of a Public Meeting to be held before the City of Wheat Ridge Planning
Commission on May 6,2004, at 7:00 p.m., in the City Council Chambers of the Municipal
Building, 7500 West 29th Avenue, Wheat Ridge, Colorado.

1. CALL THE MEETING TO ORDER
The regular meeting of the Wheat Ridge Planning Commission was called to order by Chair
PLUMMER at 700 p.m. in the City Council Chambers of the Municipal Building, 7500 We
29th Avenue, Wheat Ridge, Colorado. I
Following is the official set of Planning Commission minutes for the public hearing of April 15, 2004.
A set of these minutes is retained both in the office of the City Clerk and in the Community
Development Department of the City of Wheat Ridge.

Code of Laws concerning the submittal of applications subject to the site development
review process.
The motion passed 6-0.
A. Lighting Standards Study Session
Commissioner McMILLIN made a digital presentation and presented materials for the
Commission's review.
It was moved by Commissioner McMILLIN and seconded by Commissioner
STEWART to direct staff to draft an ordinance adapted from the International
Dark Skies Association's model lighting code with the purpose of cutting light
trespass, light pollution to the night sky, and harmful glare to motorists and others
and to bring back in three months.

II. CRITERIA
Staff has the following comments regarding the criteria used to evaluate a change in zone:
1. That the existing zone classification currently recorded on the official zoning maps
of the City of Wheat Ridge is in error.
The official zoning map is not in error. The parcel is currently zoned Residential One.
2. That a change in character in the area has occurred due to installation of publ'
facilities, other zone changes, new growth trends, deterioration, or developme.

3. 7 rhat the change of zone is in conformance, or will bring the property into
conformance, with the City of WheatRidge comprehensive plan goals, objectiv

One access point has been provided from West 38' Avenue. This access point meets the standard of
minimum width for an access point in the commercial zone districts. The Wheat Ridge :lire District
has reviewed and approved not only the access point, but also all interior - turning radii.

The Public Works Department is requiring funds in escrow for the construction of public
improvements along West 3 8`" Avenue adjacent to the property. No additional right-of-way dedication
is required. The City is undertaking a capital improvement project in the area sometime in the future
and will use the funds to construct curb, gutter and sidewalk on the north side of West 38' Avenue
adjacent to the property.
VI. STAFF CONCLUSION & RECOMMENDED MOTION (S)
All responding agencies have indicated that they can serve the property, and the applicant will bear the
cost of upgrading any service to the property.
The required neighborhood meeting was held on November 25, 2003 and there were several neighbors
in attendance. The attendants were generally accepting of the proposal. A few questions were asked
about traffic, Lena Gulch and site lighting. A meeting synopsis and sign in sheet have been included
for review (Exhibit 5, Neighborhood Meeting Synopsis & Exhibit 6, Neighborhood Sign In Sheet)

Outline DeveloprnentPlait
Staff concludes that the proposed zone change is consistent with the Comprehensive Plan. The
proposed use will be compatible with adjacent land use and zoning. Therefore, staff recommends
APPROVAL of the zone change and accompanying Outline Development Plan.

"I move to recommend APPROVAL of Case No. WZ-04-01, a request to rezone from Residential One
to Planned Commercial Development for property located at 10135 W, 38 Avenue, for the following
reasons:
1. The change in zone will be in conformance with the City of Wheat Ridge
Comprehensive Plan goals, objectives and policies.
2. The proposed use is compatible with the surrounding area.
3, The change of zone will not adversely affect the public health, safety or welfare.
With the following condition:
A note shall be added to the Outline Development Plan that reads: "Tracts A &
B are non-buildable tracts, and may be used as pedestrian walking trails and
open space."

Dr. Ron and Mike Frennuth propose to build a dental clinic as shown on
the attached site plan. The building will be one story with approximately
5,000 s.1:. The materials will be coniplinientary to the rec. center to the
north and the residential to the west. Preliminary elevations are also
included. Adequate parking will be provided to the south of the building
with landscaped islands. Access to the site is located to far west property
line so that the entry is as far west of the 38"' street and Kipling
intersection,
The property is currently zoned residential and will have to be rezoned
for this commercial application.
