HomeMy WebLinkAbout02/03/2005Minutes of Meeting January 20, 2005 The regular meeting of the Wheat Ridge Planning Commission was called to order by Chair Plummer at 7:00 p.m. in the City Council Chambers of the Municipal Building, 7500 West 29th Avenue, Wheat Ridge, Colorado. 2. Planning Commission Page I January 20, 2005 6. PUBLIC FORUM There were none present who wished to address the Commission during this portion of the meeting. A. Case No. ZOA-04-041: An ordinance amending Chapter 26 of the Wheat Ridge Code of Laws pertaining to outdoor lighting standards. This ordinance was reviewed at the last regular Planning Commission meeting and was continuedfor further clarcation of the changes. Those changes are included in the revised ordinance. The case was presented by Alan White. He advised the Commission there was jurisdiction to hear the case and then reviewed the staff report. Commissioner McMILLIN questioned the light measurements of 22 foot-candies in the Applewood Shopping Center. He expressed concern that this shopping center is very dark and the ordinance, which requires 10 foot-candles for parking lots, would reduce the measured foot candles by half. He suggested taking an average of measurements from the brightest spot and the darkest spot. Commissioner SCEZNEY commented that the most important factor to consider is how lighting affects adjacent properties. Commissioner McMILLIN expressed appreciation to staff for their hard work on this ordinance. Lola Wilcox 4471 West 27 h Avenue Ms. Wilcox is a member of the Lighting Committee. She felt that taking two measurements for an average is problematic. Commissioner McMILLIN commented that the ordinance won't require replacement of the lights, but any new lighting would have to conform to the ordinance. Mayor Cerveny stated that she would like to see any new lighting look the same as that already installed. Chair PLUMMER commented that shields could be placed on existing lights without a great deal • expense. New lighting could look the same and still conform to the new lighting standards. There was discussion about giving direction to staff to research and report on options for retrofitting existing street and pedestrian lights It was moved by Commissioner McMILLIN and seconded by Commissioner WESLEY that Case No. ZOA-03-18, proposed amendments to Chapter 26 of the Wheat Ridge Code of Laws regarding the sign code, he approved with the amendment to Section E, 1. The motion passed 5-0 with Commissioners STEWART and WITT absent. B. Case No. ZOA-03-18: An ordinance amending Chapter 26 • the Wheat Ridge C•• i • Laws pertaining to signage. This case was presented by Meredith Reckert. There was jurisdiction to hear the case and Ms. Reckert reviewed the staff report. Time limits on the display of political signs and number of signs allowed per candidate or issue were discussed and whether or not time limits would infringe upon freedom of speech. The changes will improve readability and understanding of the sign code. 2. The changes deal more effectively with negative effects of exterior lighting on adjacent properties. Area E (3300 Youngfield Service Road) has been amended to allow the following additional uses: interior decorating shops, laundry and dry cleaning shops, furniture stores, hardware stores, home furnishing stores, hotels and motels including extended stay facilities, sit down restaurants, animal vet hospitals, appliance sales and service, caterers, drug stores, drive-through restaurants, grocery stores with gasoline pump islands, temporary Christmas tree, produce and bedding plants sales. A notation has been added which would allow administrative approval of site design for Lot 2, Block 1 (3300 Youngfield Service Road) and redevelopment of the Country Cafd lot at a future date. All requirements for a Planned Commercial Development Outline Development Plan have been met. ZONE CHANGE CRITERIA chan l e in zone or a change in zoning conditions, such as adding permitted uses: I . That the existing zone classification currently recorded on the official zoning maps of the City of Wheat Ridge is an error. The official zoning map is not in error. The parcel is currently zoned Planned Commercial Development. Z. That a change in character in the area has occurred due to installation of public facilities, other zone changes, new growth trends, deterioration, or development transitions, and that the evidence supports the finding of the following. This is an area which continues to develop commercially. The property was originally annexed and zoned PCD in 1975. The property is abutted on the east by 1-70 which carries increasingly more traffic each year. 1995 traffic counts indicate that 77,000 vehicles per day travel on 1-70. A more recent CDOT count performed in 2001 indicated that the vehicle trips per day have increased to over 8 1,000 Planning Commission 4 WZ-04-06 & MS-04-08nO W. Business Center 3. That the change of zone is in conformance, or will bring the property into conformance, with the City of Wheat Ridge comprehensive plan goals, objectives and policies, and other related policies, and other related policies or plans for the area. 4. That the proposed change of zone is compatible with the surrounding area and there will be minimal adverse impacts considering the benefits to he derived. 6. That adequate infrastructurelfacilities are available to serve the type of uses allowed by or are under capacity. All responding agencies have indicated that they can serve the property. Any additional upgrades to infrastructure will be at the cost • the applicant. 7. That the change of zone will not adversely affect public health, safety or welfare by creating excessive traffic congestion, creating drainage problems, or seriously reducing light and air to the adjacent properties. Spot zoning is not a concern as the property is already zoned PCD. This will not change. 3291 Youngfield Service Road (Country CaN lot): No changes are proposed to this lot except f I] the joint access with the car wash property to Youngfield Service Road. If and when the service ro is expanded beyond its existing width, this access will be eliminated. This provision has been adde as a condition of approval for the FDP. 13001 W. 32" Avenue (entrance lot): No changes are proposed for this lot except for the relocation of an existing monument sign from the east side • Youngfield Service Road on the existing Conoco site. 13501 W. 32 nd Avenue (duplex lot): No changes are proposed for this lot except for the planting of a landscaped buffer upon relocation of the sign mentioned above. The 10 high fence along the northern boundary of this lot must be constructed within one month of final FDP approval. This provision has been added as a condition of approval for the FDP. 3270 Youngfield Service Road is being proposed to be developed as a 24-hour carwash. There will be two automatic bays and four self service bays, Access will be via a common curb cut to the south between this site and the Conoco station site and by the additional joint curb cut on Lot 1. The applicant is proposing brown and tan brick facades with a forest green standing seam metal roof. MEMO IIII III' VI. FINAL PLAT The applicant is requesting approval of a two -lot subdivision plat to reorient the existing lot line between Lots I (Country Caf6 lot) and 3 (carwash lot). Attached is a copy of the existing lot configuration (Exhibit 10, Existing Plat). The existing lot configuration is modified by transfer of the north portion of Lot 3 (around 18,000 square feet) to Lot I (Exhibit 11, Proposed Replat). No additional right-of-way is required at this time. However, if the retail area to the north develops, additional right-of-way will be needed to accommodate the widening of Youngfield Service Road. Staff feels note No. 2.4. on the FDP is sufficient to ensure this happens. TII# M-POT M �. The developer will be responsible for any needed upgrades to accommodate the carwash development. There are three requests, and each will require a separate motion. The construction of a 24 hour car wash facility in the 70 West Business Center is not really an added use because it has already been approved and exists on Lot 3, 70 West Business Center, Subdivision No. 2 which is the Conoco Station on the adjacent lot to the south and will not therefore create an isolated or spot zone district unrelated to adjacent or nearby areas. The car wash business and retail uses will increase the volumes of business at the Country Caf�, Good Times Restaurant and the Conoco Service Station and thereby increase retail sales tax for the City of Wbeat Ridge. The applicant desires to finish the development of this project and to put the vacant land to productive use. A back-ht monument sign will be constructed on Lot 2, Block 2, 70 West Business Center Filing No. 3(Area "C". This xvill replace the existing 70 WBC monument sign, on W. 32 Ave. that will be lost due to street widening.
