(The regular meeting was preceded by a dinner training session held in the second floor
conference room at 6:00 p.m.)
I. CALL THE MEETING TO ORDER
The regular meeting of the Wheat Ridge Planning Commission was called to order by Chair
Plummer at 7:00 pm. in the City Council Chambers of the Municipal Building, 7500 West 29th
Avenue, Wheat Ridge, Colorado.
2. ROLL CALL
Commission Members Present: Anne Brink-man
Staff Members Present: Alan White, Community Development Director
3. PLEDGE OF ALLEGIANCE
Following is the official set of Planning Commission minutes for the public hearing of March
17, 2005, A set of these minutes is retained both in the office of the City Clerk and in the
Community Development Department of the City of Wheat Ridge.
4. APPROVE ORDER OF AGENDA
It was moved by Commissioner WESLEY and seconded by Commissioner STEWART to
approve the agenda as presented. The motion passed 7-0.
5. APPROVE MINUTES — March 3, 2005
It was moved by Commissioner STEWART and seconded by Commissioner BRINKMAN
to approve the minutes of March 3, 2005. The motion passed 5-0 with Commissioners
PLUMMER and SCEZNEY abstaining.
6. PUBLIC FORUM
There were none present who wished to address the Commission during this portion of the
meeting.

Jurisdiction
All notification and posting requirements have been met; therefore, there is jurisdiction to hear
this case.
I. CASE ANALYSIS
The property owners are requesting approval • establishment of Planned Commercial
Development zoning for parcels located south of Highway 58, west of 1-70 and north of West
32nd Avenue (Exhibit 1, Letter
• Request). The request also includes an Outline Developm,
Plan. The properties are approximately 178.2 acres in size. I

properties. The SUP was a request to allow excavation and deposition of fill material in excess of
20,000 cubic yards. The Special Use Permit was approved with a number of conditions, listed as
follows:

Because the request does not include any major site development, referral comments have not
been submitted for review. The referral comments, as well as discussion regarding drainage,
traffic and complete development standards will be forthcoming with the "full" application.
Jefferson County had no comments. The Department has received no comments relative to this
"interim" ODP.
Staff has the following comments regarding the criteria used to evaluate a change in zone:
1. That the existing zone classification currently recorded on the official zoning maps
of the City of Wheat Ridge is in error.
The official zoning map is not in error. The property was recently annexed into the City

of Wheat Ridge, and there is no zoning designation currently.
2. That a change in character in the area has occurred due to installation of public
facilities, other zone changes, new growth trends, deterioration, or development
transitions, and that the evidence supports the finding of the following.

3. That the change of zone is in conformance, or will bring the property into
conformance, with the City of Wheat Ridge comprehensive plan goals, objectives
and policies, and other related policies or plans for the area.
4. That the proposed change of zone is compatible with the surrounding area and
there will be minimal adverse impacts considering the benefits to be derived.

S. That there will be social, recreational, physical and/or economic benefits to the
community derived by the change of zone.
This particular change of zone will not have a social, recreational, physical or economic
benefit to the community. When an amended GDP is submitted that addresses a range of
commercial uses, there will be an added benefit to the community.
6. That adequate infrastructure/facilities are available to serve the type of uses allowed
by the change of zone, or that the applicant will upgrade and provide such where
they do not exist or are under capacity.

7. That the change of zone will not adversely affect public health, safety or welfare by
creating excessive traffic congestion, creating drainage problems, or seriously

Wheat Ridge, located generally west of 1-70, south of Highway 58 and north of West 3211d
Avenue. The property is approximately 28.62 acres in size.
11. CASE ANALYSIS
The property was annexed into the City of Wheat Ridge on February 28th along with an
additional 169 acres of land west of f-70 between highway 58 and West 32nd Avenue. This
particular portion of property is owned by Coors Brewing Company. The applicant wishes to
construct a new water storage facility on the subject parcel. Water storage is an allowed use on
the Outline Development Plan.
111, FINAL DEVELOPMENT PLAN
The Final Development Plan shows the development of the water storage facility (Exhibit 2,
FDP). There are no criteria for review with Final Development Plans, as would be found with
rezoning requests. The Final Development Plan must be consistent with the approved Outline
Development Plan and comply with the established development standards. The following

accessible to the general public. The access point is provided for maintenance vehicles. There
is a small parking area located adjacent to the pump house.

Jurisdiction
All notification and posting requirements have been met; therefore, there is jurisdiction to hear this
case.
I. REQUEST
The City is requesting approval of establishment of zoning for a portion of Highway 58 between 1-701
and Eldridge Street. The property contains State Highway 58 and associated right-of-way. The
property is approximately 19.82 acres in size. I
IL CASE ANALYSIS
The property was annexed • February 28 th along with an additional 178 acres of land west of 1-70
between Highway 58 and West 32 d Avenue. This particular portion of property is owned by the State
• Colorado. There will be no physical changes to the property as a result of this rezoning. State statute
requires establishment of zoning for annexed land within 90 days of annexation. The property was
annexed into the City of Wheat Ridge • February 28, 2005.
1. That the existing zone classification currently recorded on the official zoning maps of the
City of Wheat Ridge is in error.
The official zoning map is not in error. The property was recently annexed into the City of
Wheat Ridge, and there is no zoning designation currently.
2. That a change in character in the area has occurred due to installation of public facilities,
other zone changes, new growth trends, deterioration, or development transitions, and
that the evidence supports the finding of the following.
There has been no change in character in the area.
3. That the change of zone is in conformance, or will bring the property into conformance,
with the City of Wheat Ridge comprehensive plan goals, objectives and policies, and
other related policies or plans for the area.

comprehensive plan, it is consistent with the zoning designation for
4. That the proposed change of zone is compatible with the surrounding area and there will
be minimal adverse impacts considering the benefits to be derived.
The establishment • zoning ♦ on this property will have no impact on surrounding properties.
Because the property is state owned and contains a portion ♦ Highway 58, development
opportunities are highly unlikely. If excess right-of-way was ever abandoned and sold, the
property would need to be rezoned to allow development • any substance.

S. That there will be social, recreational, physical and/or economic benefits to the
community derived by the change of zone.
The change of zone will not have a social, recreational physical or economic benefit to the
community.
6. That adequate infrastructure/facilities are available to serve the type of uses allowed by
the change of zone, or that the applicant will upgrade and provide such where they do not
exist or are under capacity.
The change of zone should have no effect on infrastructure or service ability for any of the
districts.
7. That the change of zone will not adversely affect public health, safety or welfare by
creating excessive traffic congestion, creating drainage problems, or seriously reducing
light and air to the adjacent properties.
The change of zone should not adversely affect the public health, safety or welfare of the
adjacent parcels, nor will it seriously reduce light and air to the adjacent properties.
8. That the change of zone will not create an isolated or spot zone district unrelated to
adjacent or nearby areas.
The proposed rezoning will not create an isolated zoned district. The portions of 1-70 which are
located within the City of Wheat.Ridge are zoned A-1. The proposed rezoning will not be
consistent with the designation on the future land use map in the Comprehensive Plan.
The proposal was referred to all adjacent jurisdictions. The Community Development Department has
not received any comment regarding this particular rezoning from, the jurisdictions. All districts which
serve this section of highway will continue to do so.
