He reviewed the staff report, entered a I pertinent • the :ommission there was - jurisdiction to hear the case. He presented slides and overheads of the subject application. Staff recommended approval of the application for reasons as outlined in the staff report. Commissioner Mc E expressed concern about possible ground contamination at the site from chemicals such as DDT since the area had been used for greenhouses for many years. John Michael Jones 1585 Leyden, Denver Mr. Jones, the applicant, was sworn in by Chair THOMPSON and entertained questions frol the Commission. Joanna Long 3220 Otis Street Ms. Long was sworn in by Chair THOMPSON. She stated her home faces the proposed single family dwelling and indicated she was in favor of the application. There was a consensus of the Commission to leave item "B" as written. There was a consensus of the Commission to change item "C" to read "Height: Maximum thirty-five (35)feetfor structures containing commercial and residential uses; thirty-five (35) feet' for freestanding residential structures. " There was a consensus of the Commission that item I'D" should read: "Lot coverage: Maximum eighty percent (80 %). There was a consensus of the Commission that item "E" should read: "Density: Maximum of sixteen (16) units per acre. " Alan White was directed to rewrite the sentence about how the density is calculated with one-half of the commercial building footprint to be subtracted from the lot area to calculate density. There was a consensus of the Commission that item 'IF" should read: "Landscaping: Minimum twentypercent (20%). Amount of landscaped area covered by nontivingplant material may comprise up to a maximum of 50% of the landscaped area; otherwise landscaping must be consistent with Section 26-502. " There was a consensus of the Commission to change item 'IG to read- "Parking: Based upon specific use consistent with Section 26-501: Allowances may be madefor shared parking spaces if it can be demonstrated to the satisfaction of the City thatparking demand for different uses occurs at different times. Applicability. This zone district can only be used in the mixed use areas shown on the streetscape classirication map in the streetscape and architectural design manual " Purpose would become subsection 8. OLD BUSINESS There was no old business to come before the Commission. 9. NEW BUSINESS A. Janua 3 2002 Plannin Commission Meetin - It was moved by Commissioner SNOW and seconded by Commissioner McNAMEE to cancel the January 3, 2042 Planning Commission meeting. The motion passed 7-0 with Commissioner PLUMMER absent. B. Alan White advised Commission members that a joint City Council/Planning Commission meeting is scheduled for January 21, 2001 at 7:00 p.m. 10. Can the property in question yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by regulation for the district in which it is located? If the request is denied, the property may yield a reasonable return in service and income. The newly created lot would have 94.17 feet • frontage on Saulsbury St. This lot width exceeds the 75minimum lot width for development • a single family home. Therefore, the property could be developed with a single family home. 2. If the variance were granted, would it alter the essential character of the locality? 3. Does the particular physical surrounding, shape or topographical condition of the specific property involved result in a particular and unique hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out? 4. Has the alleged difficulty or hardship been created by any person presently having an interest in the property? If criteria a through e are found, then, would the granting of the variance result in a benefit or contribution to the neighborhood or the community as distinguished from an individual benefit on the part of the applicant, or would granting of the variance result in a reasonable accommodation of a person with disabilities? Approval of the variance request would result in an individual benefit to the property owner. it would not result in a beneficial contribution to the neighborhood or the community. Approval of this request is not expected to result in the reasonable accommodation of a handicapped person. VI. This is in contrast to the highest point of the roof in the story definition.
