PUBLIC FORUM
There was no one to appear before the Commission at this time.
PUBLIC HEARING
The case was presented by Bob Goebel. The proposed ordinance follows safety guidelines set
forth, by the American Association of State Highway and Transportation Officials Policy on
Geometric Design. He reviewed the staff report which recommended approval of the
ordinance.
In response to a question from Commissioner VVEISZ, Mr, Goebel stated that he did not know
exactly how many intersections would be affected and it is planned to correct sight distance
triangles as staff becomes aware of them.
There were no members of the public in attendance to address the ordinance.

information would be required from the developer at the Outline Development Plan stage.

It was moved by Commissioner MeNAMEE and seconded by Commissioner PLUMMER
to recommend approval of Case No. ZOA-02-03, an ordinance amending Articles 1, 111
and IV of the Wheat Ridge Code of Laws concerning preliminary development plans and
preliminary subdivision plans with one amendment to Article I — Development Review:
Section 26-102 be changed to Section 26-106.
It was moved by Commissioner SNOW and seconded by Commissioner McMillin to
amend the motion to provide that the preliminary plan be retained for any piece of
property that does not require rezoning to a planned development. The motion failed 5-3
with Commissioners COLLINS, COOPER, McNAMEE, PLUMMER and WITT voting
no.
A vote was taken on the original motion which passed by a vote of 8-0.

JURISDICTION:
The property is within the City of Wheat Ridge, and all notification and posting requirements have been
met, therefore, there is jurisdiction to hear this case.
IL CASE ANALYSIS
Since there is no public dedication required, Planning Commission will be the final deciding body in
respect to the final plat.
The meeting for neighborhood input was held on July 24, 2001 in the Municipal Building located at
7500 West 29 Avenue. A sign in sheet (Exhibit 5) and synopsis of the meeting (Exhibit 6) are
included.
One letter in opposition was submitted to the City on July 27, 2001, and has been added as Exhibit
44 7".
All responding agencies have indicated that they may serve the property, and any improvement costs
will be incurred by the property owner. The Water and Fire Districts have indicated that a fire hydrant
is required at the northwest comer of 39t Avenue and Kendall Street, The cost of installation of the
hydrant will
• the responsibility of the property owner.
V. CRITERIA
Staff has the following comments regarding the criteria used to evaluate a change in zone (change of
zoning conditions):
1 That the existing zone classification currently recorded on the official zoning maps of
the City of Wheat Ridge is an error.

2. That a change in character in the area has occurred due to installation of public
facilities, other zone changes, new growth trends, deterioration, or development

portion of the parcel to a residential classification. Currently, the entire lot could be developed
as a low intensity commercial site, extending north to 39 Aven ' ue. The proposed zone change
will essentially extend the R- I C zone boundary from the neighboring properties to the east.

3. That the change of zone is in conformance, or will bring the property into conformance,
with the City of Wheat Ridge Comprehensive Plan goals, objectives and policies, and
other related policies or plans for the area.
The Comprehensive Plan designates this area as Transitional Residential (TR) and Single Farniflo
subdividing and rezoning lots I and 2 to R- I C, the uses would be more consistent
with the Comprehensive Plan. I
4. That the proposed change of zone is compatible with the surrounding area and there
will be minimal adverse impacts considering the benefits to be derived.

lots in the neighborhood. Currently, the lot stretches more than 380 feet from W. 38' Avenue.
This change of zone will reduce the amount of Restricted Commercial land, creating a buffer
from the more intensive uses of 38 Avenue.
5. That there will be social, recreational, physical and/or economic benefits to the
community derived by the change of zone; and
This could • a benefit to the area. The current zoning will allow a low-intensity commercial use
• the property extending north to W. 39 Avenue. The rezoning will create two residential lots
on W. 39h, thereby creating a buffer to the neighborhood to the north.
7. That the change of zone will not adversely affect public health, safety or welfare by
creating excessive traffic congestion, creating drainage problems, or seriously
reducing light and air to adjacent properties.
