Minutes of Meeting
May 16, 2002
1. CALL THE MEETING TO ORDER
The regular meeting of the Wheat Ridge Planning Commission was called to order by Chair
WEISZ at 7:00 p.m., May 16,2002, in the City Council Chambers of the Municipal Building,
7500 West 29th Avenue, Wheat Ridge, Colorado.

Commissioner SNOW stated she made the request to clarify the law concerning executive,
sessions for the Urban Renewal Authority and whether or not the law is different than the law
for City Council executive sessions.
Commissioner COOPER commented that the Planning Commission was in unanimous
agreement to request the legal opinion.
Commissioner McNAMET stated that she was not in agreement with this request made during
the May 2 Planning Commission meeting.

Jerry DiTullio stated that the Urban Renewal Authority hired consultants to talk with potential
developers; however, there have never been any secret meetings between any developers and
the City Council or the Urban Renewal Authority, He took exception to the insinuation that
such meetingshave occurred. He suggested that Planning Commissioners contact the City
Council when such questions arise.
Chair WEISZ commented that she was in agreement with the request because she just wanted
ftirther clarification as to how the Planning Commission fits into the ur an renew process.
Commissioners PLUMMER, McMILLIN and COLLINS also indicated that this was their
purpose for the request.
A. Case No. WZ-02-01: An application by the Buckeye Group, LLC for approval of a
rezoning from Restricted-Commercial Restricted-Commercial (R-C) and
Residential-One C (R- I C) for property located at 645 5 West 3 8 th Avenue.
Commissioner SNOW asked if the 35 foot detention pond easement was a part of lot 3. Mr,
Crane replied that it was a part of lot 3 and the owner of that lot would be responsible for
maintenance of the pond. Commissioner SNOW questioned number 4 of the notes regarding
dedication of the sidewalk, Mr. Crane explained that the Public Works Department did not
recommend dedication but suggested the sidewalk be placed in an easement, Commissioner

Chair WEIS Z asked the applicant if the Buckeye Group planned to build single story homes.
Ms. Cavness stated there are no development plans at present but would expect those rights
afforded under the zone district.
In response to a question from Commissioner McMILLIN, Travis Crane stated there are no
single story height limit restrictions in any zone district in the city.
There were no other individuals who wished to address the Commission. Chair WEIS Z closed
the public hearing.
It was moved by Commissioner PLUMMER and seconded by Commissioner SNOW, thl
a request for approval of a rezoning for property located at 6455 West 38 Avenue be
approved for the following reasons:
Commissioner McMILLIN complimented the applicant for presenting a good design which
willserve as buffering between residential and commercial along 38' Avenue, In regard to the
concerns expressed about single story houses, he reminded the neighbors that commercial
zoning has a height limitation of fifty feet.
Commissioner SNOW advised the neighbors that there is no way, other than subdivision
covenants, to limit houses to one story. She further stated that state law does not allow the city
to prohibit modular homes.
• Case No. MS-02-02: An application by the Buckeye Group, LLC for approval of a
lot minor subdivision plat on property located at 6455 West 38'�'Avenue. i
This case was associated with the prior case. There were no questions of staff or the applicant.
Chair WEISZ asked to hear from members of the public. The following addressed the
Commission:

Mr. DiManna was sworn in • Chair WEISZ. He expressed concern about increased parking
that would result from the proposed development because the street is very narrow. He
expressed concern qbout Ae d ould be a breeding ground for mos2uitoes.

Commissioner SNOW asked if there was any way to restrict parking in the area. Travis Crane
replied that there was not.

The applicant requests approval of a site plan to allow an 1 1,200 square foot expansion to the existing Kaiser
Permanente building at 4803 Ward Road. A two-lot subdivision request is also being considered.
H. CASE HISTORY
In the spring of 2VI Planning Commission reviewed a request tor approval or a our-Yor minor slii
a site plan for development for vacant property to the north. Attached as Exhibit 'B' and are reduced copie
of the plat and development plan approved by City Council on March 19. At the time of this writing, three of t j
four structures have been completed.

The existing site conditions include the structure with 38,000 square feet of building area, existing parking and
drives on the east and north sides. Access is via a private drive at a signalized intersection with Ward Road.
This private drive provides access to the three new buildings to the north and the vacant land to the northwest
(Lot I of this plat). A large portion of the existing bung grounds is comprised of slopes and a large detention
area with an informal pedestrian access around

The proposed landscape plan meets the city standards for size and quantities. An additional 13 street trees a
being added to the Ward Road frontage. All formal landscaped areas are serviced by an automatic irrigationj
system.
The additions will not exceed the existing building height and will • constructed of matching materials. Roof
top mechanical equipment will be screened • parapet walls.
Staff concludes that the site plan is in conformance wi he U- I zone district regu7at an a - p - eTt - nient
commercial development standards.
The proposed plat document creates two parcels out of the remainder of the Kaiser ownership. Lot 2
be a freestanding, developable parcel. The access drive to the property from Ward Road continues through the
property as a common drive. The plat drawing should be slightly modified to provide full width access to Lot I
through Lot 2,
A note has been added regarding blanket cross access through all parking and drive areas through the
development. The stormwater detention area has been reserved as an easement with the city's standard
maintenance language included as a plat note. All necessary right-of-way for Ward Road has been previous""
dedicated. a

Staff concludes that all requirements of the subdivision regulations have been met and the site plan is consistent
with the C- I regulations and pertinent commercial development standards. For these reasons, a recommendation
of approval is given with the condition that the access easement on Lot 2 extend fully to the common property
line with Lot 1.

Submitted herewith for your review is the Kaiser Permanente Wheat Ridge Medical
Office Addition Site Plan application prepared by Davis Partnership Architects. This
project is for a new 11,200 s.f building addition and a 57 space parking lot addition to
the existing Kasier Perrnanente medical office building located at 4803 Ward Road-

It is expected that development of this site will commence immediately upon issuance of a building
pen-nit. Anticipated construction is to start in late September 2002 and to end 14-15 months thereafter.
Kaiser Permanente is expected to occupy the building addition in the Winter of 2003.

The Kaiser Permanente building addition will house standard medical office operations, The medical
office will have normal office hours into early evening and the Pharmacy will be open Saturdays. 52
parking spaces will be added, plus 5 accessible spaces will be added,for a total of 290,
