CALL THE MEETING TO ORDER The regular meeting of the Wheat Ridge Planning Commission was called to order by Chair WEISZ at 7:00 p.m., June 6, 2002, in the City Council Chambers of the Municipal Building, 7500 West 29th Avenue, Wheat Ridge, Colorado, 2. ROLL CALL Commission Members Absent: Staff Members Present: ; 3. Following is the official set of Planning Commission minutes for the public hearing of June 6, 2002. A set of these minutes is retained both in the office of the City Clerk and in the Department of Planning and Development of the City of Wheat Ridge. PLEDGE OF ALLEGIANCE 4 APPROVE ORDER OF AGENDA It was moved by Commissioner COLLINS and seconded by Commissioner PLUMMER to approve the agenda as presented. The motion passed 6-0 with Commissioners SNOW and MeMILLIN absent. 5. APPROVE MINUTES It was moved by Commissioner PLUM ER and seconded by Commissioner COLLINS to approve the minutes of May 16, 2002. . TTT include a notation that Jerry DiTullio read the memo from Alan White and had not, as yet, read the minutes from the May 2, 2002 Planning Commission Meeting. The minutes were approved as amended 6-0 with Commissioners SNOW and McMILLIN absent. Planning Commission Page I June 6, 2002 6. PUBLIC FORUM There was no one to appear before the Commission at this time. Craig Dunham Architect for Kaiser Permanente Mr. Dunham. presented architectural drawings of the proposed addition to the existing building and a new parking lot to accommodate the expansion. • Mr. Dunham also stated that 67 new parking spaces are planned. The staff report indicated there were only 62. In response to a question from Commissioner COOPER, Mr. Dunham stated that all handicapped parking requirements would be met. In response to a question from Commissioner McMILLIN, Mr. Dunham stated that, once the proposed expansion takes place, there are no plans by Kaiser for ftirther expansion of the facility Chair WEISZ asked if there were others who wished to address this matter. All landscaping along Ward Road and the new parking area be planted as shown on the plans presented at this meeting. The motion passed 7-0 with Commissioner SNOW absent. 1. All minimum requirements of the Subdivision Regulations have been met. With the following condition: 1. The plat drawing be slightly modified to provide full width access to Lot I through Lot 2. The motion passed 7-0 with Commissioner SNOW absent. q DMMMKC99��*!, A. Residential Setbacks Case No. ZOA-01-02 Alan White presented this matter. (This discussion was not advertised as a public hearing,) Residential setbacks were discussed in February at which time the Planning Commission continued the hearing in order for staff to research code changes made in the 1990's regarding setbacks, Mr. White reviewed the staff report that set forth the results of staff's research. Following discussion of this matter, there was a consensus that staff be directed to research the issue further, including City of Denver's pop-top ordinances and bring the findings back to Planning Commission for further discussion. There was also a request that staff bring back drawings depicting various setback and height scenarios. Planning Commission Page 3 June 6, 2002 43 and Kipling - Cornmissioner McMILLIN inquired about the status of the burned out structure located at 43 and Kipling, Alan White stated that a building permit was submitted to the city to replace the structure. However, corrections were requested to the plan and those haven't been submitted to the city as yet. PAULA WEISZ, Chair ME= Planning Commission June 6, 2002 En City of Wheat Ridge Planning and Development Department 1UT DATE: June 14, 2002 At the Planning Commission meeting on October 4 2001 case # WZ-00-09/Autonation was continued to the Planning Commission meeting on December 6, 2001. The case was continued to December 6 in order for the following issues to be resolved: I . Approval from CDOT for the drainage report and plans, 2. Approval from CDOT for access onto Wadsworth. A motion is necessary to continue this case to the July 18, 2001 meeting. Planning Commission Pagel June 24, 2002 The property was previously used as a gas station having been built prior to the incorporation of the City in 1969. The structure was demolished and the fuel tanks removed in 1990. At the time of demolition, it was discovered there was soil contamination from leaking tanks which was remediated by ground pumping and open soil remediation. Based on Section 26-421 of the Subdivision Regulations, .22 acres of land would be required for parkland purposes. Fees in lieu of land dedication would be $13,800. REZONING CRITERIA Staff has the following comments regarding the criteria used to evaluate a zone change request. zone district and to 16 units per acre in Planned Residential Development zone district. It is a successful type of development being built in other cities in the front range and throughout the United States. M VI. FINAL DEVELOPMENT PLAN A final development plan has been submitted which is consistent with the proposed preliminary development plan. A 7800 square foot structure with first floor commercial uses and eight, second story condominium units are shown within the western-most building. Based • Ordinance 1239, a total of sixteen residential units are allowed on the property, The other 12 residential units are incorporated as townhouses in the eastern two buildings. City staff is in the process of reviewing the homeowners association covenants. These should be finalized prior to the hearing before City Council. Detention areas are included as easements with the city's standard language included regarding maintenance. The plat document is consistent with the easements dedicated for the street scape project. The separated sidewalk along Depew is contained within a sidewalk easement. The 25wide landscape easement dedicated by Balmar Consolidation Plat is being vacated upon recommendation by staff, The controlling document regarding use of this area is the final development plan where it is utilized as drive aisle and carports for the residential component of the project. The city surveyor would like a note to be added to the plat regarding maintenance of the detention pond at the northeast comer of the site on Lot 7. The intent of the request was to allow construction of a 4300 square foot office facility with a drive-up lane. The primary user was intended to be a local credit union. Planning Commission held a public hearing regarding this case on December 2, 1999, The request was denied for the following reasons: At the February 2000 City Council public hearing, the request was denied for the following reasons: On May 22, 2000, Case No. ZOA-00-03 was approved by City Council allowing applications for planned commercial development zone districts for properties less than one acre in size. A one - story, pitched roof with earthtone brown shingles, stucco, block, split -face block, glass and brick will be employed in the construction. The owner's property landscaped area after dedication will be 22.9% of land use, greater than the 20% required by the City. Dedicated property to the City and State will add another 3,181 square feet of landscaping. Three varieties of trees, totaling 1 and &;7 bushes, will be found throughout the landscaped area. One freestanding sign not to exceed 5 feet in height and 40 square feet will be located curbside on Wadsworth Boulevard. Physical benefits derived will be the elimiination of an "eyesore" property that has plagued the city and neighborhood for years.
