Case No. WZ-M : An application submitted • Wadsworth Old Chicago for approval of an amendment to the Applewood, Village Shopping Center Planned Commercial Development final development plan to allow a 50' high freestanding sign with 170 square feet • area south • the structure at 3250 Youngfield Street (Old Chicago Restaurant). B. ' Case No. ZOA-02-04: An ordinance amending Section 26-621 of the Wheat Ridge Code of Laws pertaining to parking in residential areas. I I I 9 1 it Ill 11. 1 4. APPROVE ORDER OF AGENDA It was moved by Commissioner COLLINS a seconded by Commissioner to approve the agenda as presented. The motion passed 6-0 with Commissioners COOPER and WEISZ absent. 5. APPROVE MINUTES Commissioner SNOW requested the following amendments to the minutes of June 20, 2002: Planning Commission Page I July 11, 2002 It was moved by Commissioner COLLINS and seconded by Commissioner McNAMEE to approve the minutes of June 20,2002 as amended. The motion passed 6-0 with Commissioners COOPER and WEISZ absent. 6. PUBLIC FORUM There was no one to appear before the Commission at this time. A. 'Case No. WZ-02-02 (continued from June 20, 2002): An application by Roger Loecher for approval of a rezoning from Residential-Two (R-2) to Planned Commerci Development (PCD) and approval of a preliminary development plan for property located at 3502 Wadsworth Boulevard, I The case was presented by Meredith Reckert. She reviewed the staff report and the memorandum which set forth uses agreed upon • the applicant. The setback in the rear was i three feet from landscaping along Wadsworth. The dumpster location was also revised. - Ms. Reckert entered a letter from Linda Epperson into the record. The letter set forth her opinions on the uses that should be allowed on the subject property. She also entered a letter from Jackie Ingenthrone requesting that only one business be allowed in the building. Commissioner McMILLIN inquired about the possibility of the luxury car rental changing to a standard car rental business in the future. Ms. Reckert replied there would be no problem as long as there are • cars stored outside. Commissioner SNOW questioned a sign shop as an allowed use. If a sign shop is permitted, spray painting, silk screening, etc., should not be allowed on the premises. Roger Loccher, the applicant, appeared before the Commission. He was under oath from the hearing on June 20, 2002. He stated that be has considered the wishes of the neighborhood in arriving at a list of uses to be allowed. Linda Epperson 7520 West 35 Avenue Ms. Epperson was also under oath from the hearing on June 20. She also submitted a letter which was earlier entered into the record. She stated that she di♦ n't object to a loan/finance office but did not want an ATM. She did object to a sign shop. Marlin Wineberg 7500 West 35 Avenue Mr. Wineberg was sworn in by Chair SNOW. He stated he was appearing in support of the neighbors. He was opposed to a five-foot setback between the proposed development and neighbor's property. She also reiterated her request that only one business be allowed in the building. Commissioner COLLINS asked Mr. Martin why the applicant bad been pumping water. Mr. Martin replied that he had • idea why this was done. He suggested moving the wetlands area to the Wadsworth frontage. He expressed concern about well water levels in the area. In response to an earlier question raised by Commissioner SNOW concerrung sales tax revenues, Alan White estimated that sales tax for the proposed application would probably be 20-25% of that which would be provided by a major retail use. It would probably be 30-40% for a less than Major retail use. Mr. Scheurer returned to the podium. In response to a question from Commissioner COLLINS, he stated that it was his understanding that the purpose for pumping was for mosquito control and that the pumping was done without permit. He also stated that there would not be a paint and body shop on the premises. Commissioner COOPER asked if the applicant had considered moving the wetlands area next to Wadsworth. Mr. Simon stated that it had been discussed, but the wetlands are to be used as a buffer to the residential neighborhood. Further, CDOT does not want water draining down Wadsworth. Secondary access to the shopping center is from West 32' Avenue. There is no tenant i.d. sip at this entrance, however, Old Chicago southern wall sign is visible from 32 Avenue, space, Old Chicago was informed of the signage restrictions in the shopping center prior to occupancy of the building. There are several other tenants within the same structure including Radio Shack and other retail and service establishments.
