AGENDA CITY OF WHEAT RIDGE PLANNING COMMISSION October I'7, 2002 Notice is hereby given of a Public Meeting to be held before the City of Wheat Ridge Planning Commission on October 17,2002, at 700 in the City Council Chambers of the Municipal Building, 7500 West 29th Avenue, Wheat Ridge, Colorado. 1. CALL THE MEETING TO ORDER 4. APPROVE THE ORDER OF THE AGENDA (Items of new and old business may recommended for placement on the agenda.) I rT 6. PUBLIC FORUM (This is the time for any person to speak on any subject not appearing on the agenda. Public comments may be limited to 3 minutes.) A. Case No. WZ-02-02: An application submitted by Roger Loecher for approval of a Planned Commercial Development final development plan and plat for property located at 3502 Wadsworth Blvd. ILTMAMVIUMI.- WIMM =101M. } � R _� The case was presented by Mary Austin. She advised the Commission that all noticing requirements had been met and there was jurisdiction to hear the: case. She entered all pertinent dM cuments into the record which were accepted by Chair WEISZ. Ms. Austin reviewed the staff report and gave a digital presentation. Sta ff, recommended approval of the application for reasons outlined in the staff report. in answer to a question from Commissioner SNOW, Ms. Austin stated that a letter of approval had been received from the Arvada Fire Department. Kent (inaudible) Grey Wolf Studio Appearing as a representative of the applicant, he stated that the proposed plan would provide separation between employee parking and truck traffic and reduce the slope of the entry drive to improve safety conditions within the site. It was moved by Commissioner SNOW and seconded by Commissioner PLUMMER that Case No. WZ-02-11, a request for approval of an amendment to a Planned Industrial Development final development plan for property located at 10619 West 50 Avenue be recommended to City Council for approval for the following reasons: Planning Commission Page 3 October 3, 2002 Commissioner McNAMEE asked if Mr. White was aware of any changes in zoning laws in surrounding municipalities that could account for the increase in applications to Wheat Ridge A& V-1ent es to allow for more restrictive regulation of tattoo parlors. Lawrence Marchese 10908 West 44' Avenue, Wheat Ridge Mr. Marchese stated that his wife has operated a tarot reading business in their home for the past three years. He expressed concern that the proposed ordin ' ance would put them out • business. He asked the Commission to consider grandfathering those businesses already in eyistence. Thomas Heath 7011 West 25' Ave., Wheat Ridge He expressed objection to the proposed ordinances and did not believe the subject businesses should be discriminated against. Commissioner McMILLIN asked if pawn shops are presently required to be located on the 44 outer limits" of commercial zoning. Mr. White explained that pawn shops come under speci uses within C-2 zone districts. # shops presently existing within the city are most grandfathered, Planning Commission Page 5 October 3, 2002 Linda Hillsbafer 3245 Ames She spoke in opposition to the proposed ordinances. She believed that they would result in putting family enterprises out of business and thought that the improvements to 3 8 Avenue were to create an atmosphere of small family-owned businesses. Mike Johnson 1375 Kipling He spoke in opposition to the proposed ordinances and in support of those who own businesses affected by the ordinance. Robert Bruff 3925 Garrison He spoke in opposition to the proposed ordinances because he felt they are unfair. Tyral Thomas 8060 E Girard, Denver Mr. Thomas is a partner in Tribe Tattoo that opened in Wheat Ridge three weeks ago. Planning Commission Page 7 October 3, 2002 Robert McGhee 5940 West 38 Avenue, Wheat Ridge He spoke in opposition to the ordinances. He expressed concern about amortization which would result in closing businesses. Vance Edwards Wheat Ridge City Council ti n • n th Mr. Edwards stated the intent ♦ City Council's mo on is to look at optio s for regulati g e specific uses set forth in the ordinances. He stated he had no desire to restrict these uses to industrial zones or be amortized out but, rather, be grandfathered. In the future, new businesses should be required to go through a special use public hearing process to give residents a right for input. She stated she is a youth counselor and believes people need a safe clean place if they wish to get a tattoo. Scott Pasternack 6851 West Colfax, Lakewood Mr. Pasternack returned to the podium to state that he believes the city is attempting to close down pawn shops and not allow any more in the city. Chair WEISZ asked if there were others who wished to address this matter. Hearing no response, she closed the public hearing, Commissioner McNAMEE commented that she did not believe nonconforming businesses should • eliminated. She would also like to see all • the subject businesses placed on th, e use chart in the code and restricted to cornmercial zones. Commissioner SNOW stated that she was upset that these three ordinances were sent to the Commission with little background information. It was her preference to continue the discussion until such time as more information was available relating to health and safety in kkerxitnxici •, lities. how manv of the subiect businesses exist in the city, Planning Commission — - ----- Page 8 October 3, 2002 Commissioner COLLINS commented that pawn shops are the only businesses that generate tax revenue for the city. It was moved by Commissioner PLUMMER that existing businesses set forth in the ordinances be grand fathered in and any future uses restricted to commercial-one. The motion died for a lack • a second. Recreational Vehicle Parking — Commissioner McMILLIN offered a possible solution to the regulation of RV parking. The purpose of the request is to allow construction of a luxury car rental facility with an additional, undetermined tenant space. H. CASE MSTORY I . Changed conditions in the area have rendered the property undesirable under the existing zonin ' 2. Planned Commercial Development zoning could be appropriate at this location to provide a lanl. use transition between Wadsworth Boulevard and the low density neighborhood to the east. A legal protest from the neighbor at 7575 West 35 Avenue was filed against the «•• of Attached as Exhibits 'A', 'B' and 'C' are Planning Commission minutes dated June 20, 2002, and July 11, 2002 and City Council minutes from the September 9, 2002, public hearing. A meeting for neighborhood input was held • November 6, 200 1. Included under Exhibits 'D' and 'E' are a synopsis • the meeting and a sign up sheet, respectively. it Ow Planning Commission Page 3 October 17, 2002 All technical requirements for a planned commercial development final development plan have been met. ME The property has been platted as a single lot. A 20' right -of way dedication will occur for Wadsworth Blvd. The city's standard language for protection of storm drain areas has been added. Public Service's standard easement language has been added. All requirements of the Subdivision Regulations have been met. The plat document is consistent with the approved preliminary development plan and the submitted final development plan document. V11. STAFF CONCLUSIONS AND RECOMMENDATION Staff has concluded that all conditions imposed by City Council have been complied with and that all requirements for a Planned Commercial Development final development plan have been met. Staff further concludes that all requirements of the Subdivision Regulations have been met. For these reasons, a recommendation of Approval is given for both the final development plan and plat with the following conditions: Option A: "I move to recommend APPROVAL of Case No. WZ-02-02, a request for approval of a PCD final development plan and plat for property located at 3502 Wadsworth Blvd., for the following reasons: development conditions imposed by City Council have been incorporated into the plan set 2. All requirements for a PCD final development plan have been met. 3. All requirements of the Subdivision Regulations have been met. Meredith Reckert replied that they started with C -1 uses, eliminated some uses and then Mr. Loechercontacted neighbors to sae what their preferences were. Chair WEISZ asked to hear from those in the audience who wished to address the matter. Jahn Beaver 7447 West 35 Avenue . Beaver was sworn in by Chair WEISZ. He expressed concern that there are no sidewalks along Wadsworth and suggested that detached sidewalks be installed. He was opposed to a five -Foot setback between the proposed development and the neighbor's property.
